From what I understood at the beginning of this incident, it wasn’t the pen that people were questioning, it was the cartridge that they said was marijuana. No one outside of Russia was able to see or test that cartridge and given Russia’s history, they believed the drug claim to be fake so they could have a reason to detain her and trade her for someone in our prisons.
