Ironically, I ended up coming out of this video feeling more annoyed with EA than I did Nike.
I remember when it happened. If EA didn’t make that move Madden would have died like Live did. 2k football was light years ahead.

One of the reasons they settled for such a low amount is basically that. They wouldn't be able to actually prove damages and enforcing copyright on an advertisement is well.. kind of hard as they do not have clear narratives like other media forms.

This seems to stem from your misunderstanding of what the law says. Mimicking someone else's advertising or brand representation associates you with the company and product being copied in the public eye. It doesn't matter what you're selling. Nike, for instance, has been involved with other video games through product placement.
Every time I forget how much I hate EA something pops up to remind me why I'll never buy another EA game again. I've been EA free for almost 10 year so far.

It's an obvious parody. Nike might have had a case if it had been used by a competitor in the sports wear market in order to deceive or confuse the public but Sega weren't even competitors in the same market and it being a commercial for a video game no one could have been confused or deceived. It's also different enough from and clearly poking fun at the Nike commercial.

Dark Mountain Productions are you kidding? It’s a shot for shot rip off. You can’t legally do that. I would wager that some guy was trying to make a name for himself at the ad company and “came up with the idea” hoping nobody would notice. This actually happens a LOT in the Creative industry because being creative on demand is extremely hard.
Believe me, I know it's hard to be creative, but I also know not to risk everything on plagiarism. It may be a shot for shot, but Nike's was clearly meant to be taken seriously, while Sega's was clearly meant for laughs, while also making fun of the Nike original. That is a parody, and falls under fair use laws. Why do you think Weird Al doesn't get in trouble for his parodies?

Fair use has nothing to do with asking permission. Weird Al asks because he wants to stay on the good side of whomever he parodies.
Today, this commercial would have been protected as being a parody of the original ad (which it was). Too bad they didn't fight it.

Another thing of note about NBA 2K2 is that it's one of just 3 games to have appeared on _every_ 6th-gen console - Dreamcast, PS2, Xbox and GameCube; the other two being _Puyo Pop Fever_ and _Capcom vs. SNK 2._
If Nike's lawyers and marketing dept were smart, as part of the lawsuit settlement, they should have just demanded that Sega include their branding/logos in the next installment(s) of their NBA (and maybe NFL) sports titles. Free marketing/partnership.
It sounds like a good idea but in fact it wasn't. They weren't in the position to make that decision. Think about it, what if the game failed? It could have a negative impact on the Nike brand. And also what if they want partnership with the big bad boy EA instead for $? It would be hard when they already have one with Sega. So demanding royalty and damaging fee is a safer bet.
@@twilinter5229 the game wasnt gonna fail. It was the third installment and each one was getting good reviews. But that deal would have been way more beneficial for Nike than for Sega, Sega ended up paying just 100k
2k1 NBA, and 2k2 were absolutely incredible.
They were good games....but NBA Live 2003 shut all of that down. 2K didn't really recover for a few years.

Nfl2k was incredible. Playing on dreamcast with friends online was absolutely insane, especially when I connected at 24 something kbps. The fact the game ran smoothly was crazy. My phoneline was busy 24/7 between nfl2k & phantasy star online.

Yep, over the concept of Donkey Kong because Universal Studios thought it resembled King Kong, a film which they supposedly still had the rights to. But when it came to light Universal's copyright to King Kong had since expired, the suit was dropped against Nintendo.

But Donkey Kong clearly _aped_ King Kong. DK is a big ape that takes a woman up a skyscraper, and has Kong as his last name. You have to be deluded to say this was all a coincidence. Universal was right to sue them. You don't have to take Nintendo's side just because you're a fan.
At least Nintendo proved that Universal is a bunch of greedy fucks that didn't want to admit they had no rights to King Kong and was in public domain.

What I appreciate is your understanding and explaining of the history that includes not only the development, but the economics, the politics, and all other things associated with the industry. Never forget the battle of 2002...
I feel like the history of Visual Concepts and the Sega 2K series vs EA Sports should be it's own video. It was a major shift in the video games industry and has political / economic ties as well (monopoly issues, both the NFL itself and the Madden franchise; hell the NFL does it in other areas too, like forcing players to use concussion causing helmets instead of newer safer ones b/c they were the official brand). Lots of interesting stuff there... how the Dreamcast failure actually propelled the 2K series to new heights (b/c now it was on all the consoles), they sold for $20 just as EA raised its prices from $50 to $60 / year, and how 2K was on a roll and picked up the ESPN franchise (and really did a lot with it), scaring EA into pulling out a $1 billion dollar check to get a monopoly.
Fun fact: I have not bought an EA sports game since that happened. Don't really regret it either.
What did they do that was bad in Europe? Not developer a football (soccer) game? The 2K sports series I think was specifically only for NA (since I'm pretty sure Europeans don't care about American football), so I'm not sure how that hurt in Europe. However, 2K couldn't (and still can't) really make a football game. Just like American football, EA has exclusive deals with so many football clubs / teams that pretty much nobody else can make a game. I guess you could make the case that by making the 2K series and having EA abandon the Dreamcast that hurt European sales... but I'm not sure how much FIFA drives sales of consoles in Europe, especially in the late 90s/early 2000s.

How is it a parody or homage at all, it's literally the same thing with no exaggerated details and nothing different about it. Nike payed people for their original ideas and Sega doing that exact same thing is unfair. People may associate Sega with the Nike commercial pulling down Nike's brand because at the time Sega had a terrible reputation.

I mean, they kinda shot themselves in the foot pretty hard repeatedly on the 32X and Saturn. Dreamcast was about as perfect as they could do, but the damage was done by then.
They might catch a break with this new Sonic movie coming up.
Norman, I hope that you will consider making a history of John Madden football. This video covered one of the interesting aspects, namely their monopoly by forcing people like Sega Sports out of the industry. They totally realize the value of their cash cow. That they can make such minimal gameplay improvements yearly and yet the same people, will by what is basically the same gameplay yearly. Now, multiple that by their attempt to dominate every sports game market at one time or another. As much as 2K pisses me off with their Microtransaction attitudes, I am glad not to give my hundreds just to have the newest players for each sport every year.
But, I am also glad for this because this profit likely lead EA to invest in other types of productions from other studios that weren’t sports related.

Great Episode. This is rather fasinating.
For all out there, never let anyone deceive you the assumption that one time EA was a "good company" as this type of muscling in and bullying has been a key concept of how they've conducted business ever since they were founded in the early 80's.
Looking at it, it does feel like it was made to be a homage to the Frozen Moment commercial. It's not an exact replica, but it's close enough that people would compare the two for sure.

There is pretty much nothing that is "clearly" fair use and parody. By the nature of free expression under the law, "parody" is as vaguely defined as "obscenity". It's a question of what companies choose to fight based on their interests in the future, when someone else tries to do the same thing.

Sega's an easy target for lawsuits in general. Ken Penders pretty much won the legal battle against them after Sonic Chronicles: The Dark Brotherhood. It's why you are getting a trainwreck that is Lara-Su Chronicles. The current ESRB system in place was the result of a lawsuit with Rockman Livid Parents vs. Sega, with Sega ultimately LOSING the case. Sega can't catch a break with the suits, can't they? It's why they play it safe nowadays.

@6:55 The Dreamcast version wasn't a port. The other versions (PS2, Xbox, Gamecube) were ports. The Dreamcast version came out in 2001, while the others debuted in 2002.

People saying it's not a parody because "it's a shot by shot remake". Bro, that's what makes it an OBVIOUS parody. If you take out the hamster wheel or the liquids spilling, etc. then it would be less of a parody. They are not trying at all to hide the fact they're making reference to the original. What would have been dishonest is to change it "just enough", because that's what people do when they it's actually a rip-off.

Nope. It was actually that they wanted an exclusive deal with SEGA to be the only sports developer but Bernie Stolar wasn't going to let that happen
I think having exclusive sports rights on the Dreamcast was a means of compensation for the Saturn’s short lifespan from EA’s point of view. I honestly think Sega made the right decision. Having Madden in Dreamcast wouldn’t have saved it anyway.

All they would have had to say was their consoles give the consumer more choice of sports games than Sega. Remember, we’re talking about a time when Nintendo their own Baseball and Basketball series. Sony had their own sports lineup. Then there was the sports lineup from Midway and Acclaim. So it was a natural step for Sega to have their own competing sports brand.
Some people think EA's nasty attitude is fairly recent. In truth, that attitude is as old as EA itself.

They did, but once Sega made Visual Concepts the sole developer of sports games for the Dreamcast just after it launched in North America, EA found this as the final straw and stopped making games of any sort for Sega and moved on to other consoles.

I remember both ads. I thought the point was to show that in game footage had come far enough to use it in a copy of the Jordan commercial. I remember thinking it was weird because Allen Iverson was never known as a dunker.
Why would Nike be pronounced ny-kee? The name of the greek goddess is apparently kinda like nee-kee but why change only the first sound? Neke is closer to the greek pronunciation and Nike pronounced like Mike seems more sensible. Just my ramblings, though.

Nike probably went after Sega because financially they wouldn't have been able to fight back and by winning the case they would have pretty much a slam dunk settlement to challenge anyone else. I would like to see a video on how EA went about creating a monopoly with the NFL. Keep up the great work.

Suggestion for a future gaming historian episodes:
1) History of Skee-Ball. This one goes back more than a century as the game was invented in 1909.
2) History of Pinball - this one might be interesting to do a long one on as it goes back a while and there were gambling models and this lead to banning of the game in some cities for a while, and hte like.
3) History of Mecc - The educational game publisher that was common in schools in the 1980s and 1990s.
