It’s funny how they simultaneously celebrate him “backing down” but also granting that it was best for his business to settle. The schadenfreude is amazing, assuming you see this as a loss.
I work in insurance and we settle cases we know we can win because it cost more in legal fees to win than it would to settle.
Scenario..Dishonest person hurts themselves but is convinced by shady lawyer to sue (knowing they will likely get a decent settlement). Medical costs are $50K but it’s the injured person’s fault. Lawyer Sue’s for $1M because the property owner’s policy has a $1M limit.
Lawyer can legally drag it out for two years and get paid $50K and lose, leaving injured person bankrupt from legal fees and costing the insurance company $150K in legal fees that they can’t recover by suing the broke injured person.
So the settle for $100K and save themselves $50K and two years in court. Lawyer gets $50K, injured person gets $50K for hurting themselves, and everybody’s insurance goes up (because insurance companies never lose money).
Just because Eric July settled out of court doesn’t automatically mean he would have lost the case.
Tony and his tadpoles aren't that smart they think (he is admitting he is losing vs settling as he was going to do anyways).
Nuisance value is a real thing. However, it's getting gamed so hard in recent years you are gonna start to see companies take it to the Mat to set a precedent to keep the buzzards away.

Trademark lawsuit is very different from what you just mentioned. The ministry has Isom trademark for 20 years, it's a fact not an opinion. They have class 9 and 16 registered under their trademark. Class 16 mentioned many things like audio book, cook book, AND COMIC BOOK. Eric F'd up when he made that video because he helped the ministry instead because on their letter to Eric, the ministry only mentioned class 9. Eric's video just told the ministry that they forgot to put class 16 on their letter on Eric lol
@@justanotherguy3294 I think you completely missed the point of his comment. The point was that settling doesn't signal guilt. The only surefire signal a settlement is is that it was cheaper than trial.

Let’s just say what this actually was. Someone tried to hurt Eric with this lawsuit simply because they don’t like him. Some sad soul put a lot of work into making him lose money in some way. And when he said he’d fight it, they could not allow their hard work to go to waste. They had to press the issue on this to take the little win they set out for initially. The goal was to force his hand to fight the case and potentially lose everything, or don’t fight and lose a little. The mastermind behind this feels really clever and probably got a cut of the settlement money. Fair play. I hope Eric knows these pathetic people don’t quit and he has to protect his neck out here.
You act like the ISOM ministry doesn't have a right to defend their name when they owned the ISOM trademark long before Eric made his comic.

that's been debunk. There's no way that email instigated the lawsuit. Check the date of the email on Eric's own video. There's no way to build a case and serve someone in less than 2 weeks. Cases like this takes 6-7months. I think the ministry served Eric 2 days after that email was sent and added that email 2 weeks later on and sent to Eric.
@@jezkerjamez7110 Eric made it clear in multiple posts on X that his comics won't be changing their names at all and will not be using Good Shepard's trademark to do so. This means that their trademark was never violated as you claim. If there were a violation, then Eric would need to change the name of his comics and/or pay them a licensing fee, he is doing neither.

Pretty shitty way to try and represent Erics position in all this. Everyone knows Erics book in no way infringed on any trademarks. Everyone knows the entire lawsuit is a sham designed and intended to hurt Rippa LLC and Eric himself financially.
Trying to play it off as arrogance or 'toxic masculinity' when he fights such blatantly malicious lawfare just makes you look like a detractor. Making the best decision he can for his company has nothing to do with pride. Looking for more options is the smartest move, settling for only the options presented to you is foolish.

No, everyone doesn't "know" that. Some people believe there is potential for legitimate trademark infringement here, including Nick Rekieta.

@@-Monad- We support the truth of the matter. The truth is there isn't any evidence that Eric tried to infringe on anyone's IP. Now what I do know is there are vultures in business that will swoop in and claim that someone stole an ip when they didn't.
Any time this discussion comes up, noone tries to see if this is simply a ploy to get money from someone out of court. In court or on youtube, noone can say Eric ripped off an ip, whether intentional or otherwise.
So this seems to be a quick money grab.

A federal judge is the only person that has the authority to declare whether or not infringement has occured. You are not a federal judge.

Wow, 7 minutes and 47 seconds and you weren't correct on a single thing. Nick Reketa along with a friend of his who are both actual laywers already went over the case and explained very well why it had literally no teeth. A settlement does not mean guilt. And a settlement is quicker and easier than fighting something he'd win, but end up having to take time out of his day and money out of his pocket.
Nope, towards the end after Eric made that video "fight like hell", it was getting worse for him and even Nick agreed. Because under that video, many comments were saying "As a Christian" and such. Eric is smart to settle despite him looking like a hypocrite after attacking the ministry and saying he was going to like hell.

You have those Christians attacking the ministry on Twitter and RUclips because some ashat used your trademark. Now the ministry has a claim for brand confusion. @justanotherguy3294 That isn't the standard for brand confusion, no, Nick did not say that. Stop lying. The standard is the average reasonable person would not confuse the two. This means comparing logos and other branding. Hear say is not valid evidence.
Also, settlements are cheaper, quicker and good enough to shut these people up. It's a gift sweet heart, stop simping for the money laundering front.

Here's the disingenuous part about Eric, he could easily just have settled the lawsuit in private like he is doing now because he is using their mark. Instead, he accused Dick&Vito of instigating with that email. AND there's no way that email instigated that lawsuit. Check the date! it's impossible to build a case and serve people in 2 DAYS! it's usually 6-7months of building cases and serving someone.
The smart play would be to just move on from this quickly instead of trying to spin it. That's what the then-World Wrestling Federation (a brand all about tough guys and attitude) did when they finally decided to change their name to get the World Wildlife Fund off their back and it didn't really hurt them at all long term. They even leaned into their rebranding with the clever "get the F out" advertising campaign.
I think it was a mistake. They should have kept fighting it.
Moving on would be a good idea; the problem is that Eric July is too much of an egotistical moron to just move on. Especially after all he did to rile up his supporters and acting like he's William Wallace or something. As for a clever campaign, see my above comment about Eric's intelligence.
That was a tremendous mistake, WWF was a huge brand with massive recognition. I know it isn’t really linked but about that time is when that company’s quality started to deteriorate.
Why do you guys have such a serious hate boner for this guy? Is it because of his political views, is it because you don't like his books, what is it? Also from what I've seen from the full video, he didn't give in to anything, from what I understand the case will most likely get dropped because it has no standing. At least tell the truth if you're going to report on this. 🤦
The man hit the jackpot as far as being an independent comic creator. He proved it could be done. But when given legit criticism, even from people he considered his friends, he gets extremely defensive and lashes out instead of taking the advice under consideration. When given legal advice, he again lashes out. Even though his sales are lower and lower with each campaign, he refuses to acknowledge the issues in his story and art. It comes off as the same type of arrogance we have been criticizing Hollywood and other mainstream comic companies of for years. It's hypocritical. On top of that when you look at how ISOM himself is written, he is clearly a self insert for Eric himself, something which again he and others have criticized the mainstream of for years.
I have stated multiple times I applaud Eric for his financial success, but if he doesn't improve the quality of the product, it will not be a long term success. If he fights unnecessary legal battles, he will bankrupt himself over legal fees and damages. If he fails, then the mainstream will point to him and say that all indie comics have failed and it will set back the movement significantly. So my problem with Eric is two fold, in that he is acting like the very mainstream industry he has attacked for years, and if he crashes and burns it will damage indie comics as a whole.
I want to like ISOM and the Rippaverse franchise, but I am not going to support him if the quality of the story is not there, just like I refuse to support the mainstream if the quality is not there. I don't just support someone because we share some political overlap. I support good stories and well written characters.

I've seen Dick Masterson's review, there is no legit criticism in it, in fact some of the things he said were in the book are so outlandish, that even I couldn't believe my ears. At this point that's nothing but an excuse to attack him. Leave him alone. At this point you guys look more crazy and childish than you're trying to make him.

And part of what is and is not infringement on a trademark is homogeneity. Said another way, two businesses can both legally have the same trademark like ISOM, if they are in two different arenas and it would be nearly impossible for a reasonable person to mistake them for each other. Considering anyone looking for comics will clearly know they are not a bible school, and anyone looking for a bible school clearly knows that is not a comic book, I think it would take an unreasonable or enfeebled mind to say they are mistakeable for each other.
This has been my understanding of it since forever. I realize there is more nuance to it that that.

If he were self aware and smart he would write this into the actual book and have Isom served in the book for a trademark lawsuit, hence giving him an in universe reason for the name change. It would also serve as a clever Injoke to his readers.

i'm honestly surprised there was problems with isom in regards to the name being it was comic format. but guess if the church has 'rights' even if it doesn't do anything with them then they can do this. it's bs honestly especially since isom doesn't rep the church at all but the law is the worthless law.
