I’ve lived in Manchester 21 years and it’s even worse back home in Ireland, which since Covid, has turned full communist, even in my home village in Ireland near Dublin - the Gardai (police) are totally corrupt, are involved in all sorts of criminality and they behave like Nazi stormtroopers - the Irish courts are totally corrupt, just like every TD in Dáil Éireann from the Taoiseach down, of all parties - this situation is doubly heartbreaking given Ireland’s tragic history - since December 2019, I was last home in Dublin in August and October 2022 and as soon as I got off the ferry from Holyhead, I was horrified by what I saw in Dublin alone, as I’d also lived in Dublin for 3 years - by comparison Manchester got off lightly, even in comparison to other parts of the U.K. during Covid, as the Irish Covid restrictions were much tougher and went on for far longer
Of course, they regard any private citizen who films or “takes photos” in any public place “on private land” as having “mental health issues” as in the “who the hell does he think he is” type of attitude, which I’ve overheard thier private conversations to this effect, which is especially the case in city centre locations

Nice post. Actually, The whole area is probably privately owned by some Corporation. The guard works for the company you was photographing. His authority ends when he crosses the line in the pavement. The owners of the land may ask you to leave but that’s going to take hours, days for them to do so. I get this all the time as a street and architecture photographer. Good to see you standing your ground.
Spinningfields is a POPS. Privately Owned Public Space. A place where private security act like as a private police force. And where policies and rules trump the law. According to the people who work for the company.

The first guy says “ unless it’s for personal use “, yet security bother everyone with a camera and never bother asking whether it’s for personal use. Wasn’t always like this around here, early in 2019 I was around there with a mate and one of the security guys came chatting to us, let us take a few Street Portraits of him, so did one of the guys on the door of the Ivy and the first one gave us the heads up about the Blackpool Rebellion Punk Festival, that turned out to be one of the best days of Street Photography, mainly Street Portraits, that I’ve ever had. These days they are just power hungry, even tried to stop me as I was walking through after getting off the train at Salford Central and cut through over the bridge, through Spinningfields to get to Deansgate, didn’t even have my camera in my hands, just on a strap yet if you have a mobile or small point and shoot type camera it’s fine, no wonder more and more Street Photographers are going for new iPhones cameras like the Ricoh GRiii, no wonder the Fuji X100v is sold out worldwide

For the definition of “public place” in section 9(1) of the M4 Public Order Act 1936 there shall be substituted- “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”.
Not the correct law to use. That's a piece of legislation amending a law about the wearing of a uniform for political purposes. It's useful to quote section 33 of the Criminal Justice Act 197 when gaslighting and making out that you know the law, but it's not totally accurate. The only part that is valid is the term "public place". The term is a used in many other places in legislation. From anti-social behaviour to the knife crime. It basically means any place designed for the public, open to the public, or used by the public. Case law has further defined it. See Williams vs DPP 1992 Harriot vs DPP 2005. In Harriot a forecourt to a hostel was not a public place since only residents could enter the hostel. In Williams the corridor in a block of flats was a public place since the public used it as a shortcut.

Seeing these NPC's have their brains explode when you tell them you aren't going to do what they want is a beautiful thing.
The tragic part is that they know they are being filmed as soon as they step anywhere near a business or town/city centre but ignore all that and attack the guy on his own filming.
Maybe it's peoples way of having someone real in the flesh that they can show their displeasure at about being filmed in public.
