  • The murder trial of romance novelist Nancy Crampton Brophy resumes Tuesday with opening statements from her defense. Brophy was arrested in September 2018 in the shooting death of her husband Daniel Brophy.
    Multnomah County Senior Deputy District Attorney Shawn Overstreet has told jurors Crampton Brophy was motivated by greed and a $1.4 million insurance policy.
    Lead defense attorney Lisa Maxfield has said Crampton Brophy and her finances both deteriorated after Brophy's death, far from the prosecution's claim that she profited from ill-gotten gains.
    Brophy previously entered a not guilty plea to the charge.

    Defense is just so unprepared, and they haven't prepared these witnesses. This is a mess. And we don't get back from break? This is nuts.

      Agree they also should have prepared their client to answer without elaborating. She only dug herself a deeper hole. I watched The Behavior Panel analyze her body language. Very revealing.

    Is there a stipulation that prevents stating that Dan Brophy was killed or was murdered? They keep referring to "the day Mr Brophy died" or "before Dan Brophy's death"

      I also noticed people on the stand, answering "Uh huh" in lieu of "Yes". I'm surprised the judge hasn't instructed those who do (and some throughout their entire testimony) to use the word "Yes". Some judges will not allow "Uh huhs", lol!

      That’s very observant! I haven’t checked the court docket for a stipulation but likely there is a defense motion in limine-asking the judge to keep the prosecution from using the term murder repetitively. This is a common request, one frequently granted by judges, in order to avoid any “undue prejudice” to the defendant. This judge was very, very careful. He wanted to ensure there were no appellate issues…

      I’ve heard the defense repeatedly use the phrase ‘after Dan died’ or ‘the day Dan died’. I assumed that they did that intentionally rather than using the term murdered or killed because the term died was more benign and not as prejudicial to their client.

    If they had all the net worth this female Financial investigator says they wouldn't have been robbing Dan's 401k to pay the bills and they certainly would not have been 4 months or more behind on their mortgage

    That Tamara alva,described blackberry bushes, defense lawyer said she was showing size of bushes being as big around as a tennis ball. I'm old,& I've NEVER seen any Anywhere near that size!! And I've seen LOTS of blackberry bushes,none anywhere near that size!!! And she kept calling the prosecutor "honey"!!

      Every time she called him honey I laughed. This woman is craycray and I kinda like her tbh, but I couldn't spend more than 5 minutes with her.

      You’re right. We’ve grown blackberries for many yrs. There were yrs we skipped caning & yrs we kept up daily w/the work. But I’ve never seen a cane approaching the size of a tennis ball! Hardly even a golfball!

    I would love to have heard the cross of the accountant.
    Personally I think that too much energy has been spent on the motive. The prosecutor doesn’t need to prove the motive, just that she pulled the trigger.

      In a circumstantial case, motive helps the jury build a picture of the crime. They have to believe she was the killer wthout having direct physical evidence.

      The defense is consumed with lack of motive, though, so prosecution is heading it off. The volume of Nancy's motive is astonishing.

      @@barbaragrove6097 It sounded like she was trying to convey that if you pay down your credit cards, you're in good shape. Never mind that you cover them with your retirement funds and multi-thousands extra in taxes.
      Moreover, there was no reduction in spending, which is the big tell.

    The witness who was called to "comfort"nb at the school seemed too iffy,not sure of herself or anything!! Think she was trying to hold back to "help"nb testimony!! Bias in other words! And she wasn't respectful the way she answered,um hm,huh uh,mmm,instead of a clear yes or no!!

      Alot of this ladies witnesses gave automated responses that they dont remember or cant remember. Its like the defense, seeing that nancys problem was memory loss, waa trying to maintain this them throughout the witnesses.

    If that one detective hadn't spent enough time around Nancy's van for his brain to register what it looked like, have it be him to talk to Nancy who told him she was at home that morning, and have it be him who saw the video with the same van and her before the murder and realize she lied, there would not have been warrants and discovery of the gun kit and other gun purchases than she'd mentioned, especially the missing barrel - but for that, she would have gotten away with murder. And if she didn't have the answers to logically explain all that away, why take the stand? All the other stuff they went into, which was a waste of time, could be explained except for those initial facts.
    One important fact that I didn't hear mentioned is when they were actually legally married, (it wasn't when they had a wedding in 1997). To me, that would have maybe answered lingering questions of why and why then. Before they were legally married, she wouldn't have been entitled to the house or any inheritance from Dan. His son would have been the next of kin. The prosecution dropped the ball on that.

    Listening to the lawyers, and I'm afraid the judge too, is even more irritating than listening to Nancy.

      Everything with Nancy is smoke and mirrors. EVERYTHING. Probably for years.
      She even took the name Brophy, though she wasn’t married until shortly before she killed him. She even has the ridiculous bathtub story-supposedly from way back-about when she decided to marry him. All fiction…they didn’t get married.

      IKR?! I remember the judge in the Ashley McArthur trial would not allow "Uh huh" answers or anything like it. Only "Yes" responses. People have to show some respect when they come to court.
      I wasn't at all surprised though to see Nancy on the stand w/her arm resting on the back of the chair as she testified like she was just shooting the sh*t. But that was a given just like she's a lazy bum.

    I don't think this judge is allowing the defense to defend by not allowing her to tell why she bought the gun kid won't let the text messages in to prove the state wrong about their flowering relationship I liked this judge to start with but he is beginning to show a lot of bias in favor of the state I don't think there's enough facts in this case to warrant her being on trial let alone guilty

      She can get on the stand and talk about those things, but the defense is not allowed to bring in her text messages or reasons for doing things without it coming from her. You can't just admit evidence for no reason. There are all kinds of rules.
