#1 Mistake Applying for 501c3 Status

  • When applying for 501c3 status for a 501c3 nonprofit, many DIYers make a grave mistake that can completely derail their plans. As a startup nonprofit, you should know how to fill out the 1023 IRS form so you don't have the wrong designation when applying for tax-exempt status.

    Thank you! I hired an attorney to handle my filing, we are in process right now! I dont want to take control of something I have ZERO experience with. Very GRATEFUL to have found an attorney who was willing to DONATE his time to us. #blessed

    I work with nonprofits and this is indeed a HUGE deal. It's costly to fix. Getting that wrong sub-status can lock your org out of grants and sponsorships and unless you fix it, there's nothing I can do to help you.

    Do you happen to have a video that covers how a nonprofit can switch from being a PF to PC? I'm working with a nonprofit right now that did this mistake and it's a pain trying to get everything changed over. Please do a video and include what to do during the 5 year period so I know we aren't missing anything. It's such a horrible mistake for a small nonprofit. 🤦‍♀️🤦‍♀️🤦‍♀️

    Would a community theater be a private foundation or public charity because funds come from donations, ticket sales, and fundraising

      It could be either one depending on your needs. Most theaters I’ve seen are public charities BUT I don’t know specifics and I can’t decide that for you

    This is very helpful information. Thank you. I have a question for you. If a person wants to start a non-profit religious organization (ministry, church, etc.) as a 501c3, should it be a public charity or private foundation?

      Hi, that's an individual decision that you need to make, but that designation moreso depends on how you make money and how you're governed. My expertise isn't with churches though, so I would consult someone with that background.

    Let's say someone made this mistake in the last 3 months of creating my non-profit....not me of course - ok it was me. Would it be better to file the 8940 and pay the huge fee for that, or close down the non-profit and start again - it wasn't that much to start to begin with.

      It really is your decision- based on what you think is easier and cheaper (I’m not going to make the decision for you lol) BUT if you do start over make sure you dissolve the corporation in your state and disperse any assets correctly.

    Thank you for sharing your knowledge. I have a question, where do I find someone who is qualified to look at the 1023 to EZ form I about to fill and check for mistakes?

      Hi, you can check in with a business lawyer who might have a colleague experienced with nonprofits. You can also check with the nonprofit association or community foundation in your area who may be able to direct you to someone. You can also check out the NOLO series on how to start a nonprofit (on Amazon) and it walks you through the forms too.

    If I don’t file for my 501c3 yet can I operate initially without a board of directors. I’m having a hard time finding the board members and I’d rather be able to start making impact and meet people who would be interested in serving while doing so

      The minimum number of required board members is governed by the state you incorporate in. In many states it’s only 1- but you don’t have to incorporate before you start talking to people. You can start making connections first and then start the paperwork.

      I don’t have a template but it doesn’t have to be complicated. Just a general statement that sums up the activities you plan to do.

    Do you have to pay 243$ everytime , filling the Declaration of Directors and officers or the 501-NP?

      are you referring to a specific state form? Every state has different forms but state don't provide federal tax-exempt status- that's the IRS

    Sis I try to explain. There are SEVERAL different types of 501c period. And what people fail to realize is that 501c is only a tax status to keep it you must be compliant

    I’m starting my nonprofit, I haven’t gotten any donations yet, if I apply with the form 1023 by being a public charity, IS IT A HIGH CHANCE FOR THIS APPLICATION REQUEST FOR THE 501c3 determination BEING DENIED?? Or is it easy to be recognized and approved?

      Hi, they approve based on your planned activities to be sure they fit the criteria so it's not necessarily based on how much money you've raised already. Most people have not raised money before they apply for their 501c3 status.

    Great information! Are scholarship foundations that offer an annual scholarship considered as “public” since 100% of the funding comes from the public through donations?

      Thanks for watching! A public charity or private foundation can both provide scholarships, so it depends on what you designate yourself as in the 1023 form. Without knowing a lot of detail, it sounds like you wish to be a public charity.

      @@BossonaBudget Hey that is correct. As of now, just scholarship services with the hopes of adding mentorship and programming to our list of services in the future. According to the checklist, I do qualify for the 1023EZ. However, there’s so many options for the NTEE code I'm not sure what to classify us as on the 1023EZ. I have all of my paperwork and templates but to have a peace of mind, I was wondering If you know if NC offered Pro Bono services for non-profits?

      Make your best judgment on what’s the beat fit but when n in doubt you can always call the IRS.

    I want to run A transitional home so what status do I need to file for that work most of my money will be coming from the state and the government???

      I can’t speak to your specific circumstances, but I recommend that you look at the funders that you want to receive funding from and see what their requirements are. If they require you to be a nonprofit that’s a clue right there. But there’s a lot of government funding that doesn’t require being a nonprofit, so keep that in mind.

    Are private schools private foundation?

      Generally, no, I don’t see how private schools would be set up as private foundations.

      You don’t need funds in the bank to apply for 501c3 tax exempt status.
