    I really hope they get nothing. This was not the buildings fault or the elevator company's fault. And her didn't get "sucked in". She put her hand on the door and when it started opening she didn't take it away.

      As an ex resort maintenance engineer, it is completely the responsibility of the elevator company and not the establishments. Also, all elevators have enough room to fit anyone's are in as I've had to grab phones for drunk people all the time...
      Also, I'm an ex employee because I found a better paying job for my skills.

    I'd say it was a genuine accident. Kids are unpredictable. Now, for sueing, that's a quick rash decision. Did it jump out and pull her in? No, she fucked around and found out. Like sticking your finger in an outlet.

      yea her arm wasn't sucked in that little girl stuck her out there just being a child and now a company has to pay money because the mother was negligent and not watching her child(ren) and getting them inside the elevator quickly and have them in the back away from the door STUPID!

      Agreed. If anything the building owners insurance should pay the medical part the stitches and antibiotics though those are sometimes free anyway but that's it.
      Oh...and the safety features on the door should be perfected/upgraded.
      If a child were to fall down some stairs at a business the same would apply. People get to much sometimes for the simplest accidents. A few stitches is part of growing up n learning. 😂

      @@bc8648 Having "0" kids doesn't preclude someone from having a sense of reason. Sure, a parent can't watch or control a child 24/7 but that doesn't necessarily mean another party is at fault when that child is injured.

At some point you can't manufacture away risk, unless you start putting harnesses and safety handles that everyone has to hold before the elevator moves, but at that point your making everything in society just super slow and cumbersome, just because some parents are trash.

      The process doesn't change just because it's for public use.
      You go through the process of identifying risks & hazards & then put REASONABLE measures in place to reduce the risks.
      There's a hierarchy of control. The hierarchy is elimination, substitution, engineering controls, administrative controls & PPE.
      If you can't find a way to REASONABLY eliminate, substitute or engineer a solution, then you move on to administrative controls.
      An administrative control could simply be a sign that says not to touch the door & a warning about how you could get trapped.

      It wasn’t negligence smooth brain. You can see that she was literally just leaning on it for a second when it opens, drags her little arm in and pins it inside. It’s a major design flaw that can seriously and did seriously injure a small child.

    It's her job as a parent to ensure her kids are no where by that door when they are riding it and to ensure they are not screwing with the buttons. Not only to keep her kids safe but to also enure they are in the way if someone needs to get in or off the damn thing.

    As a licensed elevator mechanic doors are adjusted to mitigate this risk as much as possible. But when a child is playing within the elevator or escalator like it’s a play toy or some other curious thing… yeah you’re going to get hurt like this kid. It’s not a place to play

      I can see them getting paid, even if she was doing something a bit foolish. I can't see much of a way to stop that from happening other than something like we have on garage doors to stop them crushing things, but that would have to cover the whole door, top to bottom to account for reaching hands, so I'm not sure how practical that would be. A tighter gap would probably just do more damage, it can't be totally sealed. The polished stainless certainly didn't help, that is like glue on skin at times.

    This definitely was accidental. You can only do so much as a parent. Kids are gonna do kid things and learn lessons. She won’t put her hand on the door next time. Blaming the elevator company for negligence is just a cash grab. I think any judge would see this was an accident and wouldn’t reward any money I’d think.

      Maybe not. The elevator should have provisions for something like this. People will touch the door and it shouldn’t be able to suck an arm into the sidewalls when it opens or closes. It should be too small for that to happen.
      They do in fact have a case. But they will measure the amount of responsibility- both for the parent/child and the companies. You get percentages with cases like this. So if they find the elevator company liable for 60%, the parent 30% and the apartment 10% that’s how they base the payment for injuries.

      Agree. It happened fast enough where you can't be paying attention to 3 things at once. I mean she took her eyes off the kid for a few seconds in an elevator. I've never heard of this type of accident before

    They shouldn’t get paid any money for a woman not paying attention to her daughter. It’s entirely the girls fault for having her hand near the door. Elevators don’t suck in anything like some type of vacuum. If the daughter was standing a reasonable distance away and not playing around the door there would be zero chance of her incurring injury. If they get paid any money it’s a gross failure of the legal system. Watch your damn kids.

    Since a little kid elevator safety was drilled into my head, the same with escalators, seatbelts, crosswalks etc we all knew to walk in and stay away from the door and only walk out once the doors we fully open. The mom wasn’t paying attention to her kids and allowed the daughter to be touching the door that moves!! It’s the moms fault 100%!!

    This is the Tide Pod generation. In the 70's or 80's the worst thing anybody did was shove a cheerio up their nose as a child. We weren't out here eating laundry detergent!

      Sign’s won’t work because kids that age most likely can’t read that well. Maybe parents will pay more attention. I always had my kids stand at the back of an elevator. You don’t know what may be going on outside the elevator.

    The escalator in the Fairfield California mall, near the Macy's store is evil and my best friend, and I'll tell you why.
    It was a calm summer day around 3pm on a Saturday, and the mall was packed with shoppers. My nastyass mother in-law was there shopping, she was wearing a loose fitting house dress that went all the way down to her big fat ankles. Well, she went down that escalator and when it hit the bottom it grabbed her dress and ripped it off her body like it was Hulk Hogan's tshirt.
    There she was ...buck ass naked at the bottom of the escalator in a packed mall.
    I love that escalator!

    My dad… taught us at a very young age….. to not put limbs or long hair…. Near mechanically operating machinery… because you could lose a limb or be scalped.

    This child had two adults with her…. Who failed to inform her to stand back from moving apparatuses. 🤦🏻‍♀️

    Her hand didn't get "sucked" in. That dumb kid leaned her hand on the door while it was opening. Parent should've taught their kid never to lean on a door, regardless if it slides or swings.

    Elevators have been around forever and all of a sudden a kids arm gets “sucked” into an elevator door and it’s the companies fault? 😂😂😂 that mom is trying to take the blame off of her negligent behavior of not watching her kid but chit chatting with her gal pal; get real woman…it’s your fault. 😂😂😂

      @@devonjones102 Yeah, it probably only happened because her arm is so small. Or maybe there was some other reason that caused that particular elevator to have a slightly bigger gap. I have no idea what the tolerances are on something like an elevator.

    frankly I blame mom.. there may not have been a sign in this one or a device to detect if someone is by the door (a few of the buildings I have gone in if you are too close to the door the elevator does not start you have to move away from the door) but adults have been in elevators enough to know we do not play near the doors. It is dangerous.

    God this society sucks... it's not their problem you couldn't watch your MULTIPLE kids. I'm in my early 30s and I grew up getting hurt all the time. It teaches you what to do and not to do. The whole stove is hot thing is a great example. When these kids grow up it's going to be a terrifying world of everything is everyone else's fault... and it basically already is.

    It was negligence on the mother's part. TEND TO YOUR CHILDREN! Teach them to STAND AWAY from things like elevator doors! The same way you teach them to stay away from things like your oven door when you're baking something. I've always taught children to stand back AWAY from elevator doors, elevators are not playgrounds, teach your kids that fact! Now you won't have to teach your little girl that, she learned the hard way because her mother failed to teach her. THANK GOODNESS she wasn't hurt much worse like losing her entire arm. When on an elevator I've always made kids stand against one of the walls of the elevator away from the door due to the fact that elevators are machines, and ALL machines malfunction at some point, so there's no way I'd allow kids to be by an elevator door that may malfunction and open up while the elevator is cruising up or down.

      There will always be ACCIDENTS but you can’t blame others when your child does something wrong. The mom should have had the kids standing at the back of the elevator with her. When you allow a 16 yo behind the wheel of a car and they wreck while speeding, is it the car manufacturers fault? If a child stuffs their mouth full of bagel and gets strangled is it the bagel makers fault? It is the responsibility of the parent to teach their child right from wrong. Parenting is difficult but we must do everything we can to protect our children. Verbal discipline and warnings are essential.

    Safety interlock failure. Sensors should have "seen" the girl's hand. Somebody's going to pay. That said, parent shares responsibility for lack of supervision too.

      The sensor is on the leading edge of the door. It was never going to see her arm and would never see your arm in a similar situation. I deal with elevators as it is a small portion of my job.

    It’s the elevator, not the girl or the mom’s fault. The news station I saw this on investigated the elevator and the gap size where her hand was stuck was not to code. It was much larger than it was supposed to be.
