That's the difference I originally explained...yes, anyone could claim they're just swimming or starting their own boat for a ride if no recording of her intentional act & her specific comments about what she was actually doing. If NO recording or NO "uninvolved witnesses" it's all hearsay and no probable cause for crime/citations.

As long as they are complying with the laws of the water are not impeding traffic or tied up to a dock they can fish there. no one owns the water.
