@@bobdabldr323 This event happened in November of 2021. Since we began our coverage in December of 2021, we check google every day and have checked PACER many times. If you have proof that a lawsuit was actually filed, we'd love to share it.
Most times they don't get personally sued due to qualified immunity... so the guy they arrested pays taxes, then they cause his and every other taxes to pay for it.

If you get pulled over for speeding then sometimes cops do give leeway, by letting you go with a warning without a ticket. They don't have to do that.

What people do not understand is the officer already explained why they was there. Cause of break in's and he was there in after hours which could seem suspicious and yes the officers have a right to check cause if something got broken into AGAIN cause they let these people stay there and they did something you guys would yell kick and scream they didn't do their jobs. @@kenkneram4819Wrong. The fifth amendment doesn't apply to a Terry stop for reasonable suspicion. He is on private property, after hours, after problems with burglaries. They have a right to stop him as he is trespassing at least. Supreme Court case law states that providing I'd does not violate the 4th or 5th amendments. You must I'd yourself or you will be arrested. Hiibel v. Sixth Judicial District Court of Nevada.
@@KismetandKarmano the 5th amendment always applies. They just don't have to inform you of your rights, until the arrest. You don't have to answer any questions, it's not obstruction you are not required to be an active participant in their investigation. You might be required to stay put, but the suspicion that he's casing the joint goes out the window when he explained I'm eating dinner.

It was likely an arrest for "failure to identify", which is a legitimate crime according to the law, but it is a vague as "resisting arrest" when it comes to application, so it is drastically overused as a reason to add additional charges, or arrest someone in the first place.

Yeah. Stopping and checking is totally fine. It's part of their job. Maybe he broke down. Maybe he's injured or impaired. Maybe he's casing the place. But it's pretty damn damn obvious he just pulled in to eat. The only reasonable responses at that point would be something along the lines of, "Enjoy your meal. Have a good night." to "This business has requested that people not sit in their parking lot at night. If you could please move on to another.".

What’s crazy is that I don’t think they got sued. It took them months to drop the charges and there are zero updates anywhere online about a lawsuit. I suspect this guy didn’t even want to bother with this crap anymore and just dropped it.
A lot of times in these cases, lawyers will tell a guy that a lawsuit is a waste of money because the cops will get qualified immunity. And they are right. In many of these corrupt towns, judges always side with the cops and lawsuits are a waste of time and money.

I literally buy food and pull into a vacant lot to eat all the time…to avoid having to deal with my dogs bugging me at home while eating, to get a little more sunlight during the day, and to just decompress and eat a meal in peace. Why do cops have to agitate people?

I have always found it ridiculous that cops can blatantly lie to citizens, but it is ILLEGAL for citizens to lie to them. I am not supporting lying to cops, but, come on, it should be an even playing field!

@@outtadarkness1970 90% of the time a cop *is* lying to you, I was taught this by my aunt who was a captain of the sheriff's office. Never say more than short answers, their goal is to get you talking and incriminate yourself. On average the normal person breaks the law around 8 to 10 times a day unintentionally and all it takes is someone running their mouth to give cops more than enough to get you detained and their "foot in the door" and once in it's up to their discretion

Cops that deny people's civil rights should pay the lawsuit, not the town, county or the state.
He filed a law suit, it was tossed out. He was also charged with trespassing, because he was parked in private property, that had hours clearly marked at all entrances, and he was there well after hours. He got the largest fine the judge could give, plus all costs including the cost of the police time, because he requested the supervisor. Dude was straight up guilty of trespass. He's there in his own video.

I had sort of the same thing happen to me. I was working 2nd shift and got off around 10:30pm. I decided to stop off at the nearest Jack In The Box to grab some dinner. I pulled into the parking lot next door which was a grocery store. The store wasn't open. I started to eat my meal and I look up in my rearview mirror and see a cop pulling up behind me. He knocked on my window and he asked what I was up to. I told him I got off work and stopped yo grab some dinner. He said okay and was just making sure everything was alright. Never asked me for my id or anything. These cops arw ridiculous

I used to ride my bike to work on 2nd shift and got stopped because it was "suspicious" that I was riding a bike wearing a backpack at midnight
I live in my van. This happens all the time. People call the cops for "suspicious activity" all the time.
I never show ID when asked. I stay on public roads and open lots. I have a full time job and stay in basically the same area. All the cops know who I am now. They stop by to say hi, do welfare checks and bring me food or supplements. I don't need them but it makes them feel good. It's been a year and a half now. All they know is my first name.
The county parks rangers are all pretty good friendly chaps. There are 2 who failed to get into the cop force. They threaten to tow my van, impound my animals and arrest me for failure to ID. In my case I find it to my advantage to stay friendly to the cops. It's worked out well so far.
One of the rangers has gotten so many complaints he was fired. The other nazi is still on the loose.😢

Since he wasn't committing a crime, and he wasn't trespassed from the property, they arrested him for a non crime.

I never have had problems with a cop cuz I answer their questions respectfully and not be confrontational.

My thought is always what makes them think I would be one of the burglars. They would never have a reason. So it goes back to they have no reason to even investigate.

Sometimes I wonder if they would prefer harassing an innocent person because they knew innocent person is harmless, tends to not have "weapons" than chasing an criminal person with possibly weapon that could end one of their lives. What a spineless, cowardly group of cops are.
To be honest, I think they're just hungry for money they collect from jailing civilians more than jailing criminals. Heck, they prefer to end homeless civilian's life, or indirectly causing elderly civilian's death or abusing young civilians due to their bigot reasons. All just for money and power.
