      If you get pulled over for speeding then sometimes cops do give leeway, by letting you go with a warning without a ticket. They don't have to do that.
      So it's okay to give them Id , even though you don't have to do that.
      We should be aware that we could get a ticket and they should be aware that we don't have to give them Id.

      ​@@kenkneram4819Wrong. The fifth amendment doesn't apply to a Terry stop for reasonable suspicion. He is on private property, after hours, after problems with burglaries. They have a right to stop him as he is trespassing at least. Supreme Court case law states that providing I'd does not violate the 4th or 5th amendments. You must I'd yourself or you will be arrested. Hiibel v. Sixth Judicial District Court of Nevada.

You don't have to answer any questions, it's not obstruction you are not required to be an active participant in their investigation. You might be required to stay put, but the suspicion that he's casing the joint goes out the window when he explained I'm eating dinner.

      It was likely an arrest for "failure to identify", which is a legitimate crime according to the law, but it is a vague as "resisting arrest" when it comes to application, so it is drastically overused as a reason to add additional charges, or arrest someone in the first place.

    You arrested him? For being uncooperative? At an empty parking lot? Eating food? And the supervisor said they were now conducting an investigation? Which requires reasonable articulate suspicion that a crime has or will be committed? These cops failed law school. This is why retraining forces are definitely needed.

      It's worse than failing law school, most cops spend zero hours in law school. I have a GED and I could be on the streets of my town with a gun and badge in six months. No joke, I asked the Chief how long from starting the process to being on the street, he said maybe 6 months.

      What’s crazy is that I don’t think they got sued. It took them months to drop the charges and there are zero updates anywhere online about a lawsuit. I suspect this guy didn’t even want to bother with this crap anymore and just dropped it.
      A lot of times in these cases, lawyers will tell a guy that a lawsuit is a waste of money because the cops will get qualified immunity. And they are right. In many of these corrupt towns, judges always side with the cops and lawsuits are a waste of time and money.

Never say more than short answers, their goal is to get you talking and incriminate yourself. On average the normal person breaks the law around 8 to 10 times a day unintentionally and all it takes is someone running their mouth to give cops more than enough to get you detained and their "foot in the door" and once in it's up to their discretion

      He filed a law suit, it was tossed out. He was also charged with trespassing, because he was parked in private property, that had hours clearly marked at all entrances, and he was there well after hours. He got the largest fine the judge could give, plus all costs including the cost of the police time, because he requested the supervisor. Dude was straight up guilty of trespass. He's there in his own video.

    I had sort of the same thing happen to me. I was working 2nd shift and got off around 10:30pm. I decided to stop off at the nearest Jack In The Box to grab some dinner. I pulled into the parking lot next door which was a grocery store. The store wasn't open. I started to eat my meal and I look up in my rearview mirror and see a cop pulling up behind me. He knocked on my window and he asked what I was up to. I told him I got off work and stopped yo grab some dinner. He said okay and was just making sure everything was alright. Never asked me for my id or anything. These cops arw ridiculous

      I live in my van. This happens all the time. People call the cops for "suspicious activity" all the time.
      I never show ID when asked. I stay on public roads and open lots. I have a full time job and stay in basically the same area. All the cops know who I am now. They stop by to say hi, do welfare checks and bring me food or supplements. I don't need them but it makes them feel good. It's been a year and a half now. All they know is my first name.
      The county parks rangers are all pretty good friendly chaps. There are 2 who failed to get into the cop force. They threaten to tow my van, impound my animals and arrest me for failure to ID. In my case I find it to my advantage to stay friendly to the cops. It's worked out well so far.
      One of the rangers has gotten so many complaints he was fired. The other nazi is still on the loose.😢

      No...because he was disrespectful and uncooperative...and appeared suspicious. Does that make sense? This guy was being stupid and provoked the whole thing...not the cops.
      I never have had problems with a cop cuz I answer their questions respectfully and not be confrontational.
      That's why criminals get away with murder...cops then must just walk away even when they see suspicious behavior?...people are just stupid!!

      You never have to answer Questions. 5th Amendment.
      You Never have provide ID or Papers. 4th Amendment.
      They Could not Articulate A Crime was Broken & Committed or about to committed. Police broke the Law again.

      Sometimes I wonder if they would prefer harassing an innocent person because they knew innocent person is harmless, tends to not have "weapons" than chasing an criminal person with possibly weapon that could end one of their lives. What a spineless, cowardly group of cops are.
      To be honest, I think they're just hungry for money they collect from jailing civilians more than jailing criminals. Heck, they prefer to end homeless civilian's life, or indirectly causing elderly civilian's death or abusing young civilians due to their bigot reasons. All just for money and power.
