Under Section 107 of the Copyright Act of 1976, allowances have been made for individual instances of what is called "fair use" of copyrighted material. In such a framework, the statute permits the limited use of copyrighted material without obtaining authorization from the copyright holder. Fair use is a doctrine balancing the rights of the copyright holder against public interest in the dissemination of information, allowing for the use of copyrighted material in otherwise infringing ways under certain conditions as specified by law. It would, therefore, look at criteria such as the purpose and character of the use, whether it is transformative and non-commercial in nature, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use on the potential market for or value of the work.
In general, a non-profit, educational, or private use stands a better chance of being regarded as fair use than a commercial enterprise. This is because the law recognizes that such uses are less likely to harm the economic interests of the copyright owner and more likely to promote knowledge and learning. For example, quoting brief excerpts of a work for purposes of analysis or critique in an educational setting often falls under fair use.
On the other hand, it must be noted that the case of fair use, nevertheless, does not present an absolute exemption. It is a legal defense that is judged on a case-by-case approach. It means that with such guidelines in mind, users have to know these things so that their use of copyrighted materials is accorded within legal parameters, respecting the rights of the creators.
