  • The Supreme Court heard arguments Tuesday in Merrill v. Milligan, a case on a Voting Rights Act dispute involving Alabama's Republican-drawn congressional map. The map was drawn in 2021 for Alabama's seven seats in the U.S. House of Representatives. Currently, only one district is majority-Black, even though Alabama's population is 27% Black.

    Alabama’s arguments rely largely on an interpretation of the 14th Amendment (the “14A”) which has never been adopted; it presumes an interpretation of the 14A that incorporates colorblindness, i.e., a requirement that people be treated symmetrically along racial lines; that idea is not new, it’s been rejected for decades, and it is beyond radical to attempt to rewrite the text and history of the 14A to fit that notion. Justice Jackson pointed this problem out flawlessly and it was SO refreshing to hear such a sound, detailed account of the historical record.

    They are deciding on a landmark case that will determine voting rights that have been in place since 1965. I wish I had my own youtube channel to explore this. Everyone should know what's going on.

      Correct. The ruling on this case and North Carolina could change across the board elections period (for a long period). The Votings Right Act could (will?) be stripped away beneath our feet. Tragic for democracy. Should not happen.

    Hey, At a picnic this past weekend as power was out sitting around talking about thing going on someone said something about the court and I would say 95 percent had no confidence in the Supreme Court and 100% were feeling that Justice Thomas was unprincipled and should be removed from the bench. This picnic was Republicans and Independents. Everyone was just tried of the whole Trump mess and just want it to go away.

      Of course. Just as in my radically-liberal state of New Jersey, the districts are drawn to make sure democrats win. What is so surprising about that? Except that in the eyes of the snowflakes, it's ok for democrats to do it, but not republicans.

    What they're arguing is law. Are we changing it or enforcing it? She's good and so is he.
    The judge has the advantage of interruption. The process is intriguing, especially at this level.

    What I hate more than explicit discrimination is implicit discrimination.
    Voter 1: I won't for anybody black.
    Voter 2: I'm going to vote for a black because I indentify with them...... Really. Vote for candidate with a plan, don't factor in other sht.

      Attorneys who practice in the Supreme Court are regularly interrupted and, in fact, appellate argument allows Judges and Justices to do that any time they want; advocates are supposed to stop speaking when the bench speaks.

      What’s the issue? All the information to make a legal decision is available in the briefs? He isn’t going to just ask and ask and ask for sound bites. He knows the cases, he knows his judicial view and on rare occasion he’ll ask a question or have Alito ask it for him

      Remember, if Moore vs. Harper is ruled on, states can simply ignore who you voted for and send different electors instead. That undermines our vote and our voice. This affects ALL of us.
