His brother didn't commit the murder but he was there when it happened. So he went to prison under rule of joint enterprise. Its a bit of a tough law, he shouldn't be spending 18 years for it.. but he isn't 100% innocent because he knew what was going to happen and didn't stop it. Also in one of the lines dave says "put their shanks in my brothers bag, How's that fair?" Which is referring to the fact he was caught with the murder weapons in his possession. The reason dave said it was a setup was because in court the witnesses said that daves brother hid the weapons.. although dave and his brother stick to the fact that they were put in his bag without his knowledge.
The wale guy you hear dave talking about is the person who snicthed on everyone to avoid jail time, I believe he's now in witness protection.
