Under 122(2) and 73 are same

Sir, in Sec 130, the minimum amount of Fine+Penalty is 100% of tax involved, so if the penalty u/s 122 is 100% of Tax anyways, so ideally the minimum amount of fine is 0 in Sec 130. Is this understanding correct?
