    This video is highly appreciated. I have gone pro se many times in court, and my weakest area is on Rules of Evidence, and the repartee of objections to testimony and evidence in a trial setting.
    I might add, that hearsay (even second and third level) is completely permitted in NYS child protection family court proceedings. Permitting it there shows the total melee of wishy-washyness that results from permitting hearsay. You never quite know how to present or defend against a case.

    Then how come any police complaint filed isnt considered heresay and can be immediatley investigated without evidence?

    Why is it that a witness cannot retell things he said in the past to another part? Why is this considered hearsay?

    A patient complaining of chest pains is not hearsay, that is the doctor reporting what he had first hand knowledge of, for example he was in fact part of the conversation, that would be like someone on a telephone call being a witness was hearsay. And it would fit a regularly kept record as they document that for all patients. He isn't attesting to the fact that the patient did or did not have chest pains, he is attesting to the fact that he heard the patient utter those words. then the jury could be presented with the measurements and tests that were performed or other data to attempt to either support or impeach that claim.

    Any lawyer worth their salt should not use hearsay as their defense and will most likely be scolded in court by the judge. A lawyer should base their arguments on truth.

      86% of arrests are from someone talking to the cops and letting something slip, outright admission, or saying something that gives enough evidence to further the investigation.
      This can also fuck over completely innocent people.
      A police officer being the witness can also say " oh well he said this" the defednant can say thats not true, the police officer statement is useable but the defendant saying is a lie is not.
