    I watched all of your videos that were relevant to my medical conditions before I filed for disability. I just received an approval that took only took 5 months and one try. I’m a bit disappointed that I won’t get back pay but I’m not willing to have a favorable decision overturned in an appeal. I’ll take what I got and be happy about it! Thanks for all the good videos!

      Glad you like them. I would also be likely to take the favorable. Never a good idea to appeal and approval.

    • @Richard-nq3rh
      @Richard-nq3rh 6 лет назад +6

      That's great news, But if it only took five months you wouldn't be entitled to back pay. I was approved on my second try after 14 months but they set my on-set date 7 months and that only gave me 1 month back pay so I appeal it and now they say I'm not disabled and cancel my benefits. So I just appeal that and have
      to go before a Judge but it may take 2 years before i see him. and now i have 0.00 income for maybe the next 2 years. I wish i could of taken it back.

      @@Richard-nq3rh My understanding is that from the date judge determines onset of disability you lose the first 5 months of any benefits. As in my case it was 17 months since onset so I received the last 12. I would have been happy at any juncture whether it be 1 month or 18. The objective is to win your case. Too bad they backtracked on you but I have seen many people focus on back benefits and and appealing that may have raised a red flag with ssa. Always quit why you are ahead.

      Yes back pay is good and they will do they're best to get out of paying you you're past benefits but just be happy that you're gonna get a check and that they approved you because you don't wanna argue with a judge that could over turn his decision that's a chance i wouldn't take. The more I've thought about it , trust me it's frustrating because you worked for that money but when you can't work and need an income coming in to pay you're bills i would just be happy to get both but if it came down to it i would just be happy getting an income coming in every month so count youre blessings if you win. Because some income is better than no income at all just remember that especially when you do usable to work.

    I have much respect for this man and his wisdom. I have been watching him for sometime now. I also pulled the list from the video so you can be mindful of the five things
    1 judges prefer people for claimants over the age of 50
    2 judges and disability cases prefer people with a long and consistent work history
    3 judges really prefer claims where your medical problem can be imaged objective documentation
    4 judges prefer cases where there is a definitive diagnosis
    5 judges prefer that you treat with a specialist as opposed to a family doctor

    I want to let you know that after I filed my case, I started watching your videos. I filled in Jan. of this year. I used a lot of untraditional evidence like doctors notes stating how dangerous it was for me to work, letter from employer telling them there wasn't much they could do for me as far as work. I had 4 doctors that did not believe in doing fcr's. I also asked the ssdi adjuster to look at the grid rules because of my age and education. It has taken until today to get that answer. I have not received an approval letter, but when I signed on to the site today, it said how much I would be paid starting next month, and how much back pay I would get. I am assuming this means I was approved. I hope to get the letter from them any time. I just wanted to thank you for your videos and free advice. I am sure it helped my case. I am 56 and it has been a long 10 months. By the way, I hired a law firm that didn't help me at all with advice or even filing. All they did is just pass info to ssdi. I am sure they sill want their cut of the back pay anyway. Keep up the good work and thank you again.

    I was approved at age 34 with hemochromatosis, fibromyalgia, depression, anxiety and vestibular nerve damage in my left ear. I also have all of the lovely side effects that come along with it. Headaches, insomnia, vertigo and balance issues. etc.The judge actually leaned on my fibromyalgia diagnosis for the approval. I don’t know if it helped that my mother had fibromyalgia and an extensive medical history or not. The judge didn’t even mention hemochromatosis in his decision. I was pleasantly shocked. I really expected to be denied based on everything that I’ve read. My testimony was credible and I saw multiple specialists and had numerous amounts of testing consistently for 3 years before my hearing. My specific judge only had a 32% approval rating at the time of my hearing. I believe he was the lowest at the local hearing office. Maybe I fell into some kind of “quota” or something. Either way, it was a god send. I was desperate.

      Thank goodness you got approved. I also have hemochromtois, which most people don't even have a clue what it is. It got caught by my Oncologist because my platelets were off the chart. I am 60 been denied, I fell two years ago onto a flower pot and broke 3 discs, herniated 2 acutely, got 2 bulging and in pain management taking epidurals , hydrocodone 10s, gabapentin, muscle relaxers and 16 other meds for type 2 diabetes, thyroid, ect all found by the Oncologists!! Was referred to a law firm by attorney Genisberg and awaiting my hearing!! I can bearly move and awaiting back surgery, but has be delayed due I had a heart attack on February 15!! I also suffer from PTSD, but that is the least of my problems, been dealing with it for yrs, but load noises sent me off. So glad you won!! I've watched most videos on RUclips about Social Security disability and I would say you are the most realistic and informative that I have found. With that said this is my case, 1st of all my work history I worked as a kid in HS at McDonald's for 3 years in HS I was in some special education classes to help me with English my English teacher even said in 1986 the year I graduated that I shouldn't pass but since I had already been accepted by the Army she would pass me, I then joined the Army for 6 years and was in the Gulf War in 90/91 I was with the 101st airborne, I got an honorable discharge when I just didn't reenlist, I then was hired by Schneider National as an over the road truck driver I stayed with them for 23 years until my drivers license was taken away due to my disabilities in February of 2015, I had 31 years of work with no interruptions. My disabilities the biggest is seizures (the doctors who have treated me don't know if it's seizures or seizure like activity I've had two separate doctors watch me pass out and go into seizure like activity with loss of bladder control, I have arterial fibrillation high blood pressure fibromyalgia joint pain migraines and vertigo. I have tried and so far failed at getting a diagnosis of Gulf War Illness but that's what I think is wrong with me. I take Valproic Acid for my seizures and migraines. Amlodipine and metoprolol for high blood pressure and afib, and Gemfibrozil for high cholesterol. I filled in February of 2015 was denied filled for the reconsideration appeal Was denied filed for hearing, at hearing everything seemed to be going my way after my hearing my lawyer said she could almost guarantee I won my case, in her words you never know what a judge will do but it looks so good only thing is onset date weather it would be when I 1st applied or when I turned 50. The judge sent me to a neurologist, the neurologist staff said I didn't have an appointment but when I showed them my appointment paperwork from SSDI they said they would work me in, the doctor took all of 3 minutes with me didn't like at any paperwork I had brought with me but said my problems seemed to be Cardiology in nature so recommended I go see a cardiologist, the judge how ever said I didn't need to see one 158 days after my hearing I got my denial letter, in it the judge said I was disabled but I could still be a "Photo Copier Operator" a job that the vocational expert brought up during the hearing but later said I couldn't do because I would miss too many days of work. I appealed but was denied so on my lawyers last advice to me before she dropped me was to reapply so I did reapply a few months ago. Any advice you can give me I still have ongoing appointments with a neurologist and a cardiologist through the VA, anything I should try and get them to put in my records thanks so much I know this was a very long conversation

    • @TheDercomiszar
      @TheDercomiszar 6 лет назад +2

      I should add in my denial letter it almost sounded like the judge really wanted to approve me but thought I was just a little short, the judge went on and on about my 3 minute appointment with the neurologist of course he had no way of knowing it lasted only 3 minutes. In my new claim I put depression as a problem as well but I went into the VA for it but they said I was not clinically depressed. I feel so low just thinking about my case. One question I'm interested in is in your opinion do people have a better shot 2nd time around or do the chance of winning goes down because I waz denied the 1st time?

    I've been watching your videos you explained things by far better than my lawyer. I am 55 yr old had so many surgeries worked for 35 years and my last operation was L5s1 still have back pain and on the top of it I developed severe anxiety and depression have no thyroid and no hermons is pushing my body down hill. My court is in April after my surgery and during my case i went back to work but after 6 months i got laid off because of my lack of work in IT world. My lawyer stating I have a chance of winning this case by 90% not sure anymore take care of my health or worry about how to live. The system should at least respect those who worked and not able anymore my case is going on almost two years

    I too watched many of your videos before my hearing. I had an attorney. I received notice that I was approved for SSDI as of today and your videos helped me to know what not to do/what to do! It was a two year process here in Houston, Texas. I am 60 years old with a severe cellulitis infection of the left lower leg with MRSA, which means it isn't likely to heal anytime soon. I was a legal secretary for most of my career. I had two surgeries in 2019. Judge sent me to a post hearing CE and the internist there said I had a severe impairment and could not work, but filled out the form wrong, so the judge scheduled another CE in January 2020, but when he received the records for my second surgery in Aug. 2019, he approved my case as of today and cancelled the next CE, thank God! Your videos were instrumental in my winning my case. Surgery is obviously one important thing that the judges look for. If you're bad enough to need surgery, that indicates your condition is pretty severe. I only saw internists and vascular surgeons, as I don't even have a family doctor. I think that did make a huge difference. You're SO right, Mr. Ginsberg. Seeing specialist doctors is one of the keys to winning disability, although it's very expensive. I had to get on Harris County healthcare program and that saved my life. Otherwise, I couldn't have afforded specialists and surgery. Hopefully anyone watching will be able to qualify for their county healthcare. It's not the best, but it allowed me to afford surgery, etc. Thank you SO much for your videos!

    It was 3 years before my case went to a judge but when it did he didn't even require a hearing. He awarded me my disability and went on to say in my approval letter that my case should not have needed to come to him as it was clear I was disabled. He also went on in making some very reprimanding remarks to the ones who had been denying my disability. What is remarkable is I was able to go back to work physically. I had surgery and was successful in helping me stay active. The problem and why I was disabled was because I became a liability to anyone who would hire me because of my spinal injuries and the implants to my spine. Because of my back I was no longer employable. Something I feel gets overlooked far too much in these disability cases. A client might be able to work but no longer a person that can be employed due to risk of liabilities.

    Videos are informative. My meeting is tomorrow with a judge that only has 34 percent approval rating. Personally I don't think I should even be having one. Should all be workers comp. I'm 55 with 21 years with the same company. Eight years with its contractor before that. All injuries documented and on file with employer. I'm a lineman. They're holding my job even after two years of being sent home for being too injured, and my supervisor has since been let go. The union is worthless.
    Yes I do have a WC attorney. He says we're battling three major corporations with attornies at their beck and call. My SSDI attorney is through Prudential who I have personal dissability ins. through. Who by matter of fact have deemed me disabled and unemployable and why they're paying to get me on SSDI to lessen their burden of payment.
    Never can have too much insurance. Especailly when you have a dangerous job. Or any job. Don't count on others.
    Don't believe the democrats. Nothing in life is free. Someone has to pay and it's usually the hard working already over taxed person.

Now I'm worried about their case reviews. My condition is much worse than when I first got approved. I'm 5' 11" 125-130lbs, have a severe stricture, had several nerve blocks done recently and spend half my days in the bathroom. So, I am 55 and have had L4-L5 S1 fusion and c4-7 fusion surgery and been a librarian for 28 years at same library. I’ve been paying into SS for 39 years, as all my jobs have been in libraries. New herniations C3 and L5 bulging and stenosis L4 nerve damage from hot to the touch head/ ear down left arm. Out on STD because numbness of right leg which gives out sometimes so I fall. Recent shots in neck did not help, hip from bursitis, shoulders from tendinitis and trigger finger both hands. Oh, and PTSD, all documented over 10 years. Do I have a chance? Ortho said no surgery because discs are spread, all new MRIs from this year showing damage along with narrative of MRI and testimonial from partner at work . What if I’m not candidate for another surgery? Last day worked May 25. Will apply with that as disability date even though must wait until 55 in August to apply. The stress of waiting and wondering is causing more panic attacks all documented with psych for 3 years. So scared I won’t meet the bar even though all my research leads me to think I could qualify.. This is way too long and doesn’t even discuss my limitations, which are many.

    Can you PLEASE ADDRESS the feasibility of getting SSDI for a 100% Permanent & Total VA disabled veterans like me (retired, 21 years) who, at 49, is at a point where my numerous maladies have beaten me down to a point to where I can’t work regularly? I have years of increasing medical surgeries and other medical procedures over time (at least 15-20 years of solid medical records and treatment)… I also read that 100% P&T vets get expedited review when applying for benefits. Do you think the expedited process is a benefit for these type of vets?

    Mr Ginsberg, I know you`re a very busy man but I have an important question that I hasn`t been addressed in these videos as far as I can tell. What if someone age 53 suffered from an undiagnosed mental illness for decades before a diagnosis and has little work history because their family helped them and took care of them? The diagnosis is schizoaffective disorder, anxiety disorder and social isolation and they`re being treated for serious neck problems with hydrocodone and two other drugs including a mild muscle relaxer. The doctor treating the mental illness is recommending inpatient hospitalization in the coming days. Thank you for your great videos and valuable information!

      If you have no other way to get there, you have no choice but if the judge asks, explain why you had to drive and be prepared to answer questions about how often and how far you drive on a regular basis.

    Hi, love watching your videos, very informative, I have a question: I have 7 degrees of vision left in my left eye and 9 in my right eye, I have a condition that slowly leads to blindness, I am applying for disability benefits, I have an appointment for a consultative exam, would like to know what that is and what should I expect? Thanks so much for such helpful videos!

    • @ssdattorney
      @ssdattorney  6 лет назад +4

      A consultative exam is a review by a doctor on SSA's panel of doctors to determine the severity of your impairment. The consultative doc is not going to offer treatment but he/she will or should offer some opinion about your medical condition and how it might impact you trying to work. If your problem is with your vision the CE should be with an opthamologist.

    What to do for learning disability cases? I know I would not necessarily want to see _their doctor_ but one who specializes in it more. I very seriously do not for even a second believe that the doctor the SSA sends me to would be able to determine it simply asking me a few questions. I don't believe that there is a way to get MRIs or other images that can prove this either. I have been in special classes even at the start of kindergarten. That may even be the time that some teacher noticed that I needed special classes. I still don't know the details of the disability or disabilities. I struggled in regular classes, I get confused *very easily* and subsequently frustrated. About what do do for those kind of cases, is it best to go to a psychologist or a psychiatrist and get their opinion? Of course get it in writing and have them add it to your medical records and send a copy to the SSA. Or at least alert the SSA that you have seen that doctor.
    I wonder though, when they send you the letter in the mail telling you they want you to see their doctor, can you simply go to a psychologist or do you have to ask them? These learning disabilities are much more serious than some people may realize and the worst thing is you can not tell that someone has them simply by looking at them or speaking with them. I may be due to get one of those letters in the mail in the next year or two. They send them out every 3 to 7 years or so. The way I see it 3 or any sooner is just punishing someone for being disabled and that is just mean!!

    I had a: local attorney who didn't do anything for me . I went around gathering all the medical records he has on me and I wasn't really able to do it .
    I got a call from a firm up north that said they would take the case . They said they wouldn't be willing to fly a lawyer in from Boston to Kentucky if they weren't sure of themselves . At 47 and with a herniated disc , several bulging discs , spinal stenosis and nerve impingement I like what they are saying . They'll go back and regather records and all I have to do is show up for the hearing , which BTW they are moving back a few more months to have time to prepare

I have had years now of loss of time and blackouts since my brain surgery. That was back in 2009. My ex wife wants visitation under supervision because of it. Will a judge look favorable towards this or will he or she look at it as pseudoscience?

Do I have a good chance at winning my SSDI case?

    • @ssdattorney
      @ssdattorney  6 лет назад +1

      The chiro records will do you no good as SSA considers chiropractic as "alternative medicine." The MRI and CT reports along with your history will help. It would be even stronger if you had a treating doctor fill out a functional capacity evaluation or write a narrative report setting out your limitations on sitting, standing, walking, lifting, carrying; and a discussion about how pain impacts attention/concentration, production and pace, and reliability (i.e. needing to take unscheduled breaks or missing 2 or more days of work per month).
