Thanks for you all advice on this. However, it appears the supreme Court has delivered a judgement in case "Essop &Naheem " on pages 10 to 12 the supreme listed 6 test criterias digging deeper in identifying indirect discrimination. I certainly welcome your comments on this in an immigration context. Example the unfair high fees for applications under the PBS regime. Thanks

Thanks for posting this videro. I have a question... For the single-storey rear extension of the semi-detached property, the maximum height is limited to 3m from ground level to the eaves for a flat roof. the question is that if there are some steps right after external of the rear walls so that the living area is about 60cm above the level ground where the steps end, is the 3m height counted from the point where the steps end or from the level of the living area of the house? Unless Ecology starts being taught in schools, lack of interest in the subject will only rise; children no longer play outside. I live on a smallholding littered with PRoW across which folk loudly rush, only interested in their chat or fitness. Unsurprisingly, they unleash their dogs who chase my sheep so, ha ha, elec fencing has been installed. Willful ignorance about Ecology abounds. It should not take 10 mins to find out the name of a bird. The "subjective experience" of PRoW users is wholey untrustworthy & only about securing greater rights. Why do farmers loathe their PRoW? Answer: national eco-ignorance. Give me twitchers over M.A.M.I.L.S any day.

Is it required that you register at your home address at your local city council in the UK to qualify as being a resident of the UK if you are a EU-citizen and want to qualify for pre-settled status in the UK? I hope not because I plan to rent only a room in a shared house and I probably will move houses i.e. rooms quite frequently too.

The problem is that a new local plan test of 'sustainable development' is too theoretical and not specific enough. It can mean whatever the decision maker wants it to mean - as long as it refers to some sort of economic , social or environmental consideration !

I think the Government is aware that overturning recently adopted neighbourhood plans would discourage local communities from preparing them. This is the reason for a lighter touch and the three year housing supply. Credibility.

I am sure that the pandemic has created unprecedented challenges for homeless workers but the challenges for homeless people is paramount. The government urgently need to address the needs of the homeless. Pandemic aside, realistically when you approach a local council and ask for homeless advice they tell you to go to citizens advise or shelter! These organisations are great but are seriously inundated - to get anywhere with housing, people need to know their rights, however If you are on the streets it is impossible to access the internet or even make a phone call. Councils workers are public servants and should be assisting homeless people, but housing officers especially often do more to hinder than help
In response to homeless applications - I personally know a few people who were housed at the beginning of lockdown and were told that they would only be housed for 56 days unless you had an illness or disability - a lot of homeless people suffer with mental health and or addiction problems - if they went out of the given accommodation they were asked to leave! You mention getting legal advise but this really is not viable its much harder than you would think
Hugely interesting discussion. However, focused on urban - city areas. Don’t through the baby out with the bath water as zoning has its own problems. However, there are many areas where planning can be simplified eg with removal of the local validation list, stop having local plans which all have the same but slightly different local policies - when in fact the NPPF guidance will do. Each small changes but will speed up an under resourced system.
Think the guest got an easy time on cross examination on merits or otherwise of zonal planning

Thank you for this interesting discussion. For the Dill case, it is well worth listening to the 39 Essex Street seminar on 29 May chaired by Richard Harwood, lead counsel for the applicant (the full recording is now available at www.39essex.com/webinar-listed-buildings-art-and-heritage-dill-in-the-supreme-court/). That includes interesting background as to why the Supreme Court took a different view to the lower courts, in which the lack of statutory rights of consultation and appeal in the listing process under the 1990 Act emerge as a key factor. It also puts a less dramatic interpretation on Dill, not seeing it as ‘delisting’ every listed statue, telephone box, and lamp-post; it might perhaps affect some items more in the nature of chattels (Historic England may need to tweak some of its advice to accord with Dill). As to Hampshire, this was a High Court case (probably going to appeal) which concerned common land, the Commons Act 2006, and an airfield with no listed buildings, so some caution might be appropriate before applying its obiter points on listed buildings to cases which are about listed buildings. Some caution is also needed with some parts of this Landmark Chambers discussion relating to listed buildings, which can be hard to reconcile with the case law. In particular, it is necessary for attached and ‘curtilage’ structures to have been ancillary to a listed building at the date of listing (as well as in the same ownership) if they are to be covered by its listing (the long run of case law on this includes Debenhams, Watts v SoS, Morris v Wrexham, Egerton v Taunton, and Hampshire, which repeats this point). It is therefore sensible to check these points first, which may well make it unnecessary to agonise about the definition of ‘curtilage’. Parts of the Historic England advice document on ‘curtilage’ referred to are similarly hard to square with the case law. The best published source of information on what’s covered by listing is Martin Goodall, The essential guide to the use of land and buildings (Bath Publishing, 2017, section 2.2), or his planning blog planninglawblog.blogspot.com/2013/03/barns-near-listed-farmhouses.html (eg see the 12 Sept 2015 post which focuses on barns, but the principles apply more generally).
