    A novel is a fiction book. As true crime podcasters, I'd expect you to know that. He wrote a non-fiction book about what actually happened. Excellent podcast, otherwise.

    I just saw the documentary on Netflix and I want to thank you, Seemona, for being such an inspiration. You can tell that you're a strong, classy, intelligent woman who held herself together. I'm a survivor of similar things - but this story is absolutely crazy! The maliciousness, vindictive, selfish .... it's shocking! Wish you and your daughter and family a happy future.     In the formation of psychotherapy in Austria, we undergo a very detailed discussion of these cases, where a breach of confidentiality has to be taken. there are lots of case discussions. i.e. if a pedophile is in treatment and says he (or she) wants to harm their kids, we have to ask for specifics. If it is the case that the children are already protected in foster care without visitation rights, or some similar situation is the case where the patient has no access to the kids, we do not intervene. If somebody confesses a murder in psychotherapy that has happened, we do not intervene, it has to be only in case of concrete plans of harming themselves or somebody else in the future. it is not our place to ask for leagal pursuit or punishment. we recently had a case in Austria where a psychotherapist breached the confidentiality becasue a patient repeatetly dreamt o murdering their wife. these dreams were the cause the patient seeked help. the psychotherapist was convicted of confidentiality breach because this is obviouly not right. but it is a very very interesting topic because we sometimes need to talk about murderous fantasies or suicidal ones, these need to be discussed. not all therapists are able to contain their own fears and listen to the patient in order to carefully evaluate whether the risk ist really there or not.

    If it was a man that did this, there would be no nonsense of us entertaining silly ideas of her blacking out, having medical issues etc. This is just our double standard to let women off of their crimes. It's actually fun listening to this podcast - you can hear the desperate attempt to defend this woman at all costs. Victims and their families? Who cares about them. Lets all gather around and try to protect this woman just because.. well.. she's a woman.

      I think her being 17 and the unique factors in the case play a significant role as well. I don't think it's solely because of her being a woman.

      @@SherriRosebud If it was a 17 year old male he would have been tried as an adult or been locked in a cage for at least 20 years - yes simply because he's a male alone.     She didn't have a home. She was the result of a single mother and do what daughters of single moms often do. Go look up the stats on this. People keep saying she was a 'normal' teen. No she was not. Anyhow, I believe she might have had her first manic episode and was in the beginning phase of psychosis.

    One thing that concerns me is he seems to be idealizing the woman he is seeing right now, which makes me wonder if he is still acting impulsively and employing black-and-white thinking in relationships. It seems like he has a history of falling in love, over-idealizing the person and then falling in love and over-idealizing someone new and vacillating between the 2 people. Hopefully, in his new relationship, he can let go of the idealization and replace it with real intimacy.

    Oh interesting! I remember the big netflix special but wasn't aware of these updates. I do recall two other things though not mentioned... one being the police radio chatter about a missing lady and them saying it had to be Avery. Also Brendan's confession not fitting the wounds on her originally until they fed him the info. He was confessing horrible things from a mystery novel that alarmed them and they fed him the correct info. I will need to look this up again now. I may be misremembering.

    Tooth absesses that are left untreated can lead to brain absesses. Those symptoms completely were inline with what her son said, her seeking headache meds and how she acted. Idk why no one has made this connection. Symptoms of severe head pain, nausea, vision changes, confusion. Pain that nothing will take away. And in a confused state with excruciating pain could explain alot. She wouldn't have been able to make rational decisions and could have drank or smoked in one of her many stops. No one thought she looked drunk at any point. That could have been consumed just before the accident too. But not swerving supports she couldn't see well , as did being on the wrong side and doing so many odd things. If anyone has driven in bad fog , you conentrate on the road line and from the posture and way witnesses saw her and if she couldn't see well that may have been her trying to just get home. I think they did the blood saw the alcohol and weed and didn't look for any other reasons. With enough bad bacteria in her body the alcohol (ethanol) could be from a rare condition (Google it cause I can't remember the name of it) that turns bacteria in the gut into ethanol that can seep into the bloodstream. Also Sepsis and stroke can even come from untreated tooth absesses. They are seriously deadly if left untreated. So there is so much that could have happened. I don't think it was looked into enough. They just wanted an open /shut case and lay blame, which I get but still all investigations into her as a person doesnt fit someone who would drink and drive or endanger her kids if she had been in her right mind. IMO

    This shows how Corrupt the police department and judiciary can be. I can't imagine the trauma she went through. I hope Jerry never comes out of prison

    I don't think we will ever know what motivated Diane Schuler that day to have caused this terrible crash. Was she harboring secrets that she never shared with anyone? And as far as anyone blaming Warren and Jackie Hance, they are not to blame for what Diane did. They trusted Diane and felt that their girls would be safe with her. Why she was drinking that day we will never know, why she was smoking marijuana that day we will never know. Was she in pain from her tooth and tried to medicate herself with alcohol and didn't realize how much alcohol she was consuming until it was too late, and then combined with the effect of the marijuana? One can barely imagine the pain this has caused for so many families.😢

    I was a functioning alcoholic for years. The amount of alcohol i could consume and still walk around as if normal was pretty crazy. Almost nobody knew. So thankful for my sobriety now. I feel this woman was an alcoholic.

    The synergystic effect destroyed my last marriage. I had come home from running errands in the evening to find my pot-loving husband consuming a large mixed drink, which normally he NEVER did. He began yelling at me with unrepeatable language in a fury that had to be fueled by his being thoroughly stoned before he started drinking, which would have been typical for that time of day. He slid off of the loveseat where he was sitting; I called the local squad to get his 400 lb ass off the floor--to THEM he was decent. Wasn't going to live with the risk of that kind of behavior; headed West to go back to the home town. Divorce pending to protect my interest in our modest house.

    Diane Downs did not blame a black male carjacker as you stated. She blamed the attack on a bushy haired white male. You can find the sketches that were made of Down’s description. Ann Rule also discussed this in her book, “Small Sacrifices”. Both Downs and Smith share similarities, but blaming their crimes on a black man is not. Good discussion and hope you don’t mind a correction.

    She may have said Tellis instead of Quinton (as Quinton is harder so say) So. therefore if she tried to say Tellis, but could not say the T- it would have been ELLIS, which sounds like ERIC.

    It is wrong to point out that law enforcer department is the one accountable for the conviction of the innocent. The victim has identified and testified that the man was her offender ? that is the basis of the conviction. This is solemn matter and one must know what one is doing and the consequence for all ahead. The sole victim is the one who spent many years in jail.

    Nypd are incredibly dangerous with their tunnel vision. When they suspect they have made a mistake they do everything to conceal it. Seems to be more important to be right than just.

      Why should anyone HAVE to check people's credentials in this context?? What an ugly world if we had to do a background check on anyone we dated or were friends with?? I understand in specific contexts like work. Of course, she should have trusted him; as only unhealthy nasty malicious vindictive people would behave in such a disgusting way and she's obviously a nice person who would never have even thought of such awful behaviour.

    Now I’m compelled to watch your analysis … as much or more than the documentary. You’re great at this. Did you see “Black fish” won all sorts of awards as the same kind of impact. About killer whales but also about murder. If you haven’t seen that, please watch it and maybe you’ll do a thing on it. And there’s one more that’s really good. It’s called “into the abyss” about a double murder in Texas. Excellent. Chilling. That same older director who did “Grizzly Man”. Another powerful documentary. After these we all need one e of Christopher Guest’s mockumenaries “a mighty wind” or “waiting for Guffman” or “best in Show”. His first was “Spinal Tap”. His latest “Mascotts”. They’re all hilarious they make me laugh out loud and after these very serious very powerful documentaries it’s a good feeling oh yeah the one I love is “for your consideration.” You’re great.       And not only this, she DENIES she did it until this day. It was clear the hosts of this podcast are not impartial and was giving her favor simply for the fact she is a female. If it was a male who did all this, the tone would have been MUCH different. Also, we know what goes in women prisons. She took lives, let her stay in prison like any male would have gotten for doing the same thing.
