Absolutely DO NOT admit the debt is yours or agree to any payment as this will restart the statute of limitations. If you choose to talk to a debt collector, require the debt collector to produce the purchase agreement & signed credit card agreement as proof of ownership b4 you will discuss the debt. Do not accept an affidavit or bill of sale. It's the debt collector's job to prove ownership, which most debt collectors will not do.

I filed a response to their motion for summary judgment. I kinda like law but i think it stupid to make all these phrases be in Latin. Where i stated that there were factual disputes and then argued the plaintiffs standing, differing amounts requested from they original summons and complaint to the most current request in summary judgment motion ( off by 600 bucks) , that the FDCPA & State law prohibits attorneys fees, interest, collection costs if not mention in the agreement to the principal balance [ there is none on this old medical debt] , and then i question their standing as i never injured or harmed this company. Stated State and article iii section 2 clause 1 for the requirements of standing for an injured party. This is a memorandum correct?

Hi, your videos have been super helpful! I have a question now: how soon do creditors such as best egg sell the debt to the 3rd party, once the account is charged off (120 days)? And if I start a 6month settlement payment plan on or before that charged off date, will they still report the charged off information to credit bureaus? I lm hoping to make the settlement payment before it’s charged off, but what they offer is higher than I can afford.
