    We agree that this Nation provided laws to keep people safe, keep order in society, and protect the rights of individuals. I see that you are giving information about the immigration stuff. Don't worry about it. I will explain to you. When people cross the border--they are breaking the law. I believed it is a Federal Law. They are committing a crime. Past 3 years over 12 ILLEGALS IMMIGRANTS crossed our borders that flooded our cities and towns. It created the Migra crime -migrants that kill US Citizens. They have to pay the consequences of their actions. Trump is only going after the ILLEGALS immigrants that broke the law that all. We call it ' The Great Deportations". Don't listen to the propaganda of the Left, they say anything to scare the public--mainly misinformation.

    aiding and abetting a illegal alien is a crime, thousands of attorneys need prosecuted and dis barred. Federal judges need to be investigated and charged. When Regan granted amnesty he promised what we are seeing could not happen, employers working illegal should be charged,all the illegal money obtained for running a criminal enterprise seized, and used to fund immigration control.

    Hi there!😀 If you are in US can you still file for Adjustment of status if your I130 is processing but not approved yet, Final action date not current but the filing date is current ?

      Thank you for your comment. In general, the I-130 petition does not have to be approved to file the I-485. However, the question of whether you're eligible to file the I-485 is a legal question that we cannot answer here. Please feel free to contact us for a consultation. Good luck!

      Hi, unfortunately I cannot give legal advice on this forum. My guess is that they knew the priority date would be current soon and went ahead and approved it, but I would try to address it. I would start by contacting the immigration attorney who assisted with your filing. Good luck!

    Very good informative video Emily, much appreciated and thank you, I am Sunil and I have one query first time ever applied for H-1B and got selected in my first try 2024, now I am in middle of the processing my next step i.e., H-1B petition process, i have sent all required documents to Attorney who is processing , but she replied that 3 years degree cannot process beacuse which is not equivalent to USA degree standards, but i am holding only 3 years Degree with 18 years of IT experience, so Attorney told me provide previous employer experience letter with mentioning duties to do evaluation for me to equal USA degree standard, now my question is how long will it take the place and going forward is there any challanges for my case?, and how many years of experience I need to show them in general, I have already requested to my previous 2 employers to provide i.e equal to 6 yrs will it be sufficient?or do i need to get it in the same patteren from all the previous employer? and why is it not considered the general experience letter that we already received from the previous employer? Please advise. Thank you

    I have a question regarding the new H1B beneficiary-centric registration process. Let's consider a scenario where a beneficiary has more than one registrant. If the beneficiary is selected, will all the registrants be notified about the selection? Example : Let's say Company A, Company B, and Company C submitted registrations for the beneficiary. According to the new process, if the beneficiary is selected, will all employers be notified? Are all employers eligible to file for the H1B?

      Yes, all companies will be notified, and all companies could file an H-1B petition for that person.

      Hello! It depends on a number of factors, including how quickly a green card will become available. That in turn depends on a number of factors including the daughter's country of birth (I know you said she's a citizen of Canada, but it depends on where she's born, not where she's a citizen), whether the daughter is married or not, etc. The estimate is very fact-specific.     Just married in December. Filed my I-130 & 130A for my spouse in Jan. She just completed her masters and is interviewing for a doctoral program spot. Her I-20 expires in May. I am currently waiting for the 693 paperwork to arrive in the mail and was planning on sending in my 485, 693, and 864 all together in one packet to ship out all together (I think I can do that). My question is how do I get her the ability to work. She is going nuts sitting at home and not able to work.

    Is the H-1B state side only for India and Canada nationals or only for applicants whose vise was issued by mission India or Canada regardless of your nationality in the specified time periods ?

      My understanding is that the pilot program is for individuals whose visa was issued by Mission Canada or India (i.e. not based on nationality).

      Hi Ruthvik, certainly - we'll do another video explaining that aspect of the proposed regulations. Remember of course that these are proposed regulations, and we don't know when they will become effective, or exactly what the final version of the regulations will say. :)

    hello i hope to receive feedback, i got my biometrics done for my I765 march 1, 2023 but until now my EAD is not yet received, We also failed to submit the form I864 but was able to send documents and received response that rfe for I864 has been received July 13, will this delay my EAD processing? how long should i wait for my EAD to be processed. thank you in advance.

      Hello! Sometimes the request for evidence (RFE) for the I-864 will delay the EAD processing. You can try to submit a service request with USCIS starting 60 days after you have submitted the RFE response. However, USCIS may or may not allow you to place the service request then. Best wishes!

      Good evening, we'll be covering the L-1 in an upcoming video. Both the H-1B and L-1 are dual intent, meaning they allow a person to hold that classification and also apply for a green card. For almost every letter of the alphabet, there's a different temporary visa classification, and subcategories within those. However, each classification has a specific purpose, requirements, limitations, etc. We have a chart of the most commonly used temporary visa classifications here: www.sumnerimmigration.com/wp-content/uploads/sites/275/2021/03/SIL-NIV-Chart-2020.pdf.

    I petitioned my parent. The I485 has been approved. The notice states we should be getting the card. But doesn’t say the interview is waived. Should it specify that it’s waived?? Or is it implied that it’s waived? Am I just overthinking lol someone help.

      Hi Ayesha, it depends on a lot of different factors, but you can check current processing times on the USCIS website: egov.uscis.gov/processing-times/. You'll need to search by Form type (I-765 for the EAD). Best wishes!

    How do I know if my interview will be waived? I just look at my USCIS account as of December 1st my I-485 application (through marriage) is been approved. However there’s another update on the website that says “we have ordered a new card”. What card are they referring to? If the interview is waived, do I have another appointment to get my green card?

    Hello Ms Emily, I did not put in Medical examination when I submitted initially. I have since done that but I am hesitant to send it to USCIS. This is because on the “Deficiency Notice” mail I received specifically states - DO NOT MAIL DOCUMENTS AT THIS TIME. Mailing documents before receiving one of the notices referenced above may delay your case. I don’t know what to do. It’s been a long time

      Hi Dennis, I can't give specific legal advice here, but we generally do not mail documents to USCIS unless they specifically ask for it. There are exceptions of course.

      Are you asking how long it will take for the I-485 to be processed? That depends on a number of factors including which USCIS office is processing your case, but checking the USCIS processing time website can be a good starting point.

    I do that , all evidence to avoide RFE as well as interview but nothing happends . after 8 monts since my case is submitted .

      I'm sorry to hear that! USCIS processing times can be quite frustrating for sure. If you have not already, you could try to submit a service request with USCIS. However, USCIS will not accept a service request if the case is within their "standard" processing times, per the information on their website. Good luck!
