I believe you are incorrect about the new regime not applying to existing HRBs. Refer to the following link that clarifies this. www.legislation.gov.uk/uksi/2023/909/part/2/chapter/2/made If you can provide legislation backing your statement that’d be appreciated.
17:35: so if I am converting a hospital ward into basic offices in a HRB then the new regime doesn’t apply?

Can't seem to find the building (higher-risk buildings) (england) regulations 2022 draft Dave refers to - would it be possible to post a link?
Can the target cost be adjusted mid project? e.g. it is discovered that items were incorrectly priced in the tender stage, can both parties agree to adjust the target cost to the updated and more realistic target?
in my opinion, the answer is "no" for your example. if the contractor has incorrectly priced at the tender stage, then the contractor is responsible for their own error or mistake and the target cost cannot be adjusted.
If a PA contractor fails to finish & refuses to provide a final account for months should he be paid ?
