    If your the special needs disabled son on SSI.You cannot get help if you have no savings.I live on $906.00 a month.Oklahoma City fails us.

    Am staying with a man who is married .He has got 3 kids with the first woman and built her somewhere , he built me some and hv got four kids with him .lf he dies now am l safe with my kids where we are? are we entitled to any thing of his?

    I am a trustee in our Living Trust. (We live in Michigan) My lawyer just created a Certificate of Trust for me because I need to remove my husband with dementia stage 4 who can no longer manage or handle any money. (He had made over $25,000 worth in financial mistakes already.) I have been trying to get him off of our Living Trust using this Certificate of Trust created by my lawyer. My credit union refused to do this because his; 1) Pension and his 2) Social Security checks come into the Credit Union with his name on them (his assets.) They tell me that if they did what I requested the checks would bounce right back to the place that sends them (electronically.) This has been a very frustrating situation for me. I also have Financial Power of Attorney and Medical Power of Attorney. They did "flag" the account in the event he comes into the credit union to remove money but that is all they will do. My husband is used to transferring money from our accounts using his computer....so our money is still not sufficiently protected. My lawyer has tried everything but the Credit Union resists. Can you comment? Thank you.

    Doesn't a RLT become irrevocable at the death of the grantor? Or am i confused?

      Thank you for your comment, Kelly! Yes, a Revocable Living Trust becomes irrevocable upon the death of the grantor (if single) or both grantors (if married).

    Thank you. Can a power of attorney apply for an identification card? My brother is schizophrenic and he never leaves home. I cannot get him into a DMV to save my life. He has not had a state ID or any ID for 14 years.

      Thank you for your message, Matthew! Depending upon whether your brother had a drivers license in the past, you may be able to apply for a state ID card online. If not, I'd urge you to reach out to your local DMV customer service center directly. They can be very helpful in these types of unique situations.

    Why is the ABA and Business Practices allowing criminals to use DIY legal documents to practice law without a license to steal our homes and put vulnerable seniors and special needs children on the street? And why are they not recognizing Fiduciary Security Legals forgery proof Permission Ledger Crime Interdiction Administrations. And not recommending Notary Index Crime Enforcement Regulatory Nickel and Dime alternative to DIY Quarter Litigation? Are they asleep at the wheel?

    Do I need to get an EIN number for the bank or credit union to have savings or any other type of financial assets transferred using this Transfer By Affidavit? I have a couple of small refund checks that need to be put into an estate account for my mother who passed away last year.

    I’m wondering about the reporting requirements to social security and the correct way to do that so that Medicaid is not terminated . in my case, the beneficiary of my life insurance is over 60 on Medicaid and the benefit will be large and must be used over their remaining years .

    What you need to do is spend it on your house. You can easily spend down that money on home repairs, new roof, painting it, and whatever else needs done inside and out. Get a new carpet! You can buy all brand new appliances and get all the warranties you can buy. Get a prepaid lavish funeral. Get the best of everything. ANd be sure to spend it on estate planning attorneys in your state. With all of that a substantial inheritance will be gone in no time.

    His suggested options, but you must do these all within one month of receiving your inheritance, and it must only be for your benefit alone: 1. Spend all the inheritance on yourself. DO NOT GIVE AWAY any portion of it or you will be penalized and removed from Medicaid. 2. Buy a prepaid funeral for yourself. 3. Spend it on your vacations. 4. Get rid of your old car and replace it with a new one. You are allowed only one car while on Medicaid. My extra suggestions: A. Pay off your mortgage if you have one. B. 🤔, I know you are allowed to own only one house while receiving Medicaid. Now I'm wondering if buying a replacement car scenario could apply to buying a replacement home. But you must also sell your old house before or at the same time you purchase the replacement home all in the one month spending window. Plus you would have to use all the proceeds from the sale of your old house to roll over into the purchase of the new house. That way you don't have the same excess money issue like you have from the inheritance. Does anyone know if this works to save your Medicaid status? 5. Get a Wispac Trust or something like it. Check your state. It's if you are disabled with special needs. Check the requirements if you have to have special needs or does any disability qualify. I wasn't clear on this from the video. All I got was it pools money to pay for things not covered by Medicaid. 6. In his Description box he also suggests remodelling your personal home or building an addition.

      Medicaid will automatically drop you when they see your bank accounts are over the annual limit. Yes, they do look into our assets.

    Is that maximum limit $2K per month or year? What about social security earnings, retirement pensions or Inheritance proceeds? Are they included in that $2K?

    So a trustee and a beneficiary are not the same.. The deed is a trust .. The government local county state and federal are all on Dun and Bradstreet as a for profit corporation. So these corporations need to pay taxes .. but they are exempt?????

      Medicaid has asset limits, not disability limits. You can continue Medicaid only if you meet those limits. One house and one car are allowable, with no limits on value. However, you cannot have combined assets in banks, credit unions, etc that are over the low maximum limit of about $8K. Anything more than that and you will lose your Medicaid eligibility. With regards to Medicare, you qualify for that automatically when you turn 65 no matter how much you earn or inherit.

    My Mother was receiving Medicaid, and at age 100 received a substantial inheritance. She is living in long-term Assisted Living and has now been taken off Medicaid. The inheritance was just now received and placed in the Existing (since 2004) Irrevocable Family Trust for her use. She will not likely use it all prior to her death and will Not need to apply for Medicaid again. However, MY QUESTION: Upon Her Death, (likely within 5 years) will the remaining money in the Trust Account be subject to the Medicaid Economic Recovery Program? And while no longer on Medicaid, and likely never again, is she still restricted as to how she spends the money or to whom she gifts.... in other words, Does the MEDICAID RECOVERY (MERP) also have a look-back period to recover the funds that may have been gifted, or can they only go after the remaining funds in the Irrevocable Trust Account.

    I know i probably would need to hire you but maybe you could help me with something. My dad filed a transfer on death deed 6 -7 months before his passing He had been discussing it for a couple years .I had been staying with him for 3 years . So we made an appointment with the lawyer and got the todd but dads death certificate had on it dementia for 10 years though my dad was in full facility in his day to day living he drove made his own suppers called friends and had visitors dressed himself took showers by himself. I tried talking to the doctor and he refuses I'm just wondering what i can do to keep this out of probate

    This is true for public trusts... A private trust just needs a trust declaration.

    The rules for medicaid vary from state to state because this coverage is managed on a state level. You can protect some of your assets by putting them in a trust if you do it at least 5 years before you apply for medicaid. You can't protect an IRA because they can't be put into a trust. You also can't protect any income you may have. Today in Arkansas a nursing home stay costs $260.00 per day.

    My mom has lived with me for the past 5 years. I pay for everything she needs. She has paid my property taxes for the past two years. Is she going to be penalized for that if she goes into a nursing home?

    So... a certification of trust is a very quick summary of what's in the trust that most 'people' you're dealing with that involves your trust? Is this just so they can make you hire the attorney on your end to say it's OK in their professional legal opinion whatever you're trying to do is allowed in the trust, instead of them having a lawyer determine it?

      This is correct for statutory trusts. However a private trust can have an attorney as its trust protector however the same information is not needed and does not need to be disclosed. The reason for the disclosure of items in the trust and a statutory trust is to give a judge an ability to liquidate the estates trust assets if it is revocable
