I need help with my money my son left me he passed in October os 2017 left everything to me and it’s only been 6 years and my money is gone there are a lot of things not adding up my taxes have been taken every year because of the investment of the trust now the irs is after me again saying I owe them more money after I paid them everything I owed them in 2021 it’s a big mess plus on my tax letters it’s says something about money not reported in south Carolina at the same bank name my money was in please help me I have no one to help me with this they think just because I’m from ohio I’m a dumb hillbilly I maybe a hillbilly but I’m not dumb please help I know this bank has been stealing my sons and my money

I am looking for a Lawyer in Florida, I moved to CSR three years ago, after the passing of my husband, because I found it to be a safe and welcoming environment. Unfortunately, recent experiences with certain members of the staff have made me feel uncomfortable and uncertain about my decision to stay here. If you are on a deed with a sibling, then you own property with your sibling. But, property is interesting in that you could put your share of the property into your own Trust.

Typically not, but if she were to pass after you, then it would depend on where she lived and whether she had an estate plan or not on whether he would get anything.

We came to hear you; we are not here to fight background music to hear you. The background music quickly becomes extremely annoying, distracting, and intrusive. Many folks have hearing difficulties, thus while concentrating on your dialog we must also concentrate on tuning out the music; it is very frustrating. Your background music ruins an otherwise exceptionally good and important presentation.

Thanks for the information. In regards to naming a daughter or son as beneficiary of the house via the Lady Bird Deed and the son or daughter gets divorced, wouldn't the house still go to daughter or son since their named as beneficiary and not their spouse?
Well, I suppose it's the difference between divorced and getting divorced. Many divorces take years to conclude, especially if there are children involved.

Thank you, John. Very interesting video. Harris’s proposal is a bit shocking.
This does not apply to me but I believe Ms.Harris’s plan is not a fair plan. The Govt does not spend our tax dollars wisely but wants to continue taking from the taxpayer.
I believe 2 basic things about government: Keep is small and create policy that encourages businesses to grow. Businesses represent 80%-85% of GDP, so allowing businesses to grow is MUCH more effective in growing the USA economy then increasing government size/spending. This means the policy to reduce the estate tax exemption is WRONG; therefore Harris is a bad choice in voting.

Thanks for the video. Great information. Question: If a couple has a Living Trust, then when the first spouse passes, what is required to be filed at the courthouse?
Typically, nothing. Sometimes, you'll need to file the Pour-Over Will with the Courthouse, just for safe-keeping, but the Will doesn't have to be probated if the Trust was properly funded. Good question.
Shouldn’t the real estate be transferred via warranty deed instead of a quit claim deed? That way any title insurance that is in place will effectively pass to the trust, correct?
That's a good question, but generally no. Most title insurance policies extend coverage to transfers to revocable trusts, but, even if they don't, you can add the Trust as an additional insured under the existing policy. Good question.

Thanks for bringing to light the importance of a Living Trust. Question: If a married couple only has a Will and not a Trust, if one spouse dies does the Will still need to be probated even thought everything was titled in both spouses’ name? Appreciate your videos as they are extremely helpful.
After setting up a revocable living trust in Florida, Is it recorded or amended at the court house ? Since my beneficiary will be my Two adult kids. Upon my passing how do they proceed ? I thought a Will was the answer but after listening to you I know better. Where in Fla are you located ?
Joint bank accounts have always had problems - but are sometimes needed. Case 1) My parents no longer could open a bank account because my dad figured if he had checks in the checkbook that meant that there was money to cover the checks. My mom had cosigned as a guraranture on the account. Thus, neither could open a bank account without paying back lots of money. Yet they needed a bank account to get SS checks and to pay routine bills. I, as the son who took over the financials, opened a bank account in my name and designated my mother as an Agent on the Account. We got her checks printed in her name. SS accepted that as legit for depositing the SS every month. Mom was good and verified with me when she needed to write checks for the rent, utilities, etc (she was responsible with the money). I raised additional $$$ from my other brothers and sisters to assist in some things beyond their income - which I either provided directly (such as $300/month in Taxi Coupons from a local taxi company once I took the car away from my dad) or added to the checking account as needed. I was able to close that checking account 2 months after my mom's death with all bills paid as dad had preceded her. Case 2) My marriage: We opened a joint checking account for joint household and vacation expenses. We each have our own personal checking and savings accounts which are not joint, and our incomes go into our personal accounts. We both fund the joint account every month for to pay the joint bills. In this case she was a foreign national legally in the USA when we married, and needed to show joint accounts for immigration paperwork (joint checking, joint utility bills, etc - as evidence that we were in fact married so this joint checking account was needed for that purpose by itself, and were again supplied later when she got her US Citizenship). However, it has proven to be an exceptionally good way for us to handle joint household and other expenses. If one cleans out the account no more than 1 months money is lost, and our personal accounts are not touched. We are both very happy on how this works.

Thanks for clarifying the difference between Power of Attorney and Advanced Health Care Directives. If one already has a will and appointed Power of Attorney, does the appointed person having the POA/Health Care decision-making authority have to first prove that the person (whom is possibly in need of someone to make decisions for him/her) is incompetent? If you pay off the mortgage, would a revocable trust protect the property deed from deed theft which is happening more frequently in Georgia?
That's a good question, but nothing can really help you from someone falsifying a deed and filing it at the Courthouse. Fortunately, deed theft isn't as prevalent as people might think.

It is not an issue as long as you're transferring into a Revocable Living Trust where you are the beneficiary.

Great information. If one wants to sell their home that is presently in a Revocable Living Trust, should the home first be taken out of the trust and put back into the personal name before selling? If so, what is the process of getting the home out of the Trust name? Thanks
Technically, No. However, there are lenders that will not finance the purchase of home if it is in or has ever been in a trust of any kind despite state statutes saying it is OK. I recently ran into this issue on a construction loan. The first lender initially preapproved us but when they found out the land, we owned was in a revocable trust they would not touch it even if we did take it out of the trust. The second lender did give us final approval, but it was conditional to have the land taken out of the trust. This was from the purchasing end and was a huge headache to deal with right out the gate. From a seller's standpoint if your house is in a revocable trust, you could effectively limit your potential buyers. Thís is the Delima I am currently facing when our new home is complete, and we go to sell our current home, I know one major local lender that will not finance it, the one that denied us. I believe the issue the lenders have is that when the property is in the trust and now there are additional beneficiaries listed beyond the trustees that these beneficiaries could have a claim on the property in the event of foreclosures, even though the law says otherwise.
No, you can sell the home right out of the Revocable Living Trust without transferring it to your individual name first.
@@thefarrelllawfirm Provided the Buyer's lender will finance the property being sold from the Trust. There are lenders that will not. This was my experience last year while applying for Construction to Perm Mortgage to build a home on my own land. The first lender (which we had been members for over 20 years) gave preapproval, but pulled the plug once they found out the land deed was in our revocable trust. I advised this lender of the state statutes concerning revocable trusts as well as offered to take it out of the trust. I could and would easily take it out of the trust and they would not budge. After lengthy correspondence with the lender and my lawyer the lender’s final response was; "our policy is that we DO NOT allow life estates or ladybird deeds. I do know that these are separate entities when it comes to how they are handled, however, our policy does not allow either of these. We don’t allow exceptions, nor do we allow any lending to occur if it has changed, i.e., if you took it out of the life estate/ladybird." This was cut and pasted from my final correspondence with this lender. We were able to find another lender, got approved and are awaiting county approval of the building permit. However, we still had to take the land out of the Trust. This whole trust SNAFU caused use to lose four months in getting this project going. Even though the laws dictate what you can and cannot do with a Trust. They do not dictate what a lender will and will not do to pay for it.
