Governing Markets: What Have We Learned?
Просмотров 592 месяца назад
Economic integration under political stress: at the end of a long conference, it is fitting to revisit the theme in a direct comparative perspective. The EU has pursued a systematic project to allow economic activities to take place across Europe under a single set of rules, whether through harmonizing directives or country-of-origin regulation. The American system does much less to minimize re...

A Case Study in (Failed?) Integration: Financial Services
Просмотров 982 месяца назад
Finance can flow across jurisdictions in multilevel markets much more easily than goods, most services, or labor. Its structure, costs and distribution of gains are more fully organized by law and regulation than perhaps any other part of the economy. The legal and political idiosyncracies of the U.S. and EU have both produced complex mixes-arguably messes-of erratic financial integration. Amer...
Net Zero Benefit? Climate Change Policy
Просмотров 802 месяца назад
Not so long ago, dire assessments of a global climate change crisis sparked ambitious international efforts to reach worldwide agreement on reducing greenhouse gas emissions. Not much has come of those intergovernmental initiatives. Instead, the U.S. and the EU-and, within those federal systems, individual member-states-have undertaken unilateral climate-related policies. They know full well th...
The (Private) Law of Nations

For centuries, “private international law”-“Conflicts Law,” as it is called in the U.S.-served as a principal means of economic integration. The contemporary scene presents a perplexing picture. The EU has embraced the basic principles of private international law-regarding the private choice of law, judicial jurisdiction, and the enforcement of judgments-in various Conventions. The U.S. in con...
Regulating the Digital Economy

More than perhaps any other industry, the providers of digital services produce cross-border integration-and depend on a high level of comity and coordination across and among sovereign jurisdictions. To date, regulatory harmony has been hard to come by. On antitrust policy, data protection, content restrictions, and other issues of central concern to the providers, the EU and the U.S. (and, wi...
Is It All Falling Apart-Or Has the TLF Just Gone Nuts?
Просмотров 732 месяца назад
The centrifugal, parochial tendencies that are the focus of this TLF conference have been accompanied by more hopeful voices. International institutions are by nature far removed from ordinary citizens’ concerns; and by the lights of America’s (though not the EU’s) founders, a far-away “government over governments” will be ineffectual and unresponsive-“imbecilic,” in Alexander Hamilton’s phrase...
Courts, Parliaments, and Administrative Agencies

What institutions, precisely, engineer political and economic integration? In the United States (in the 19th century) and in the European Union, courts played a dominant role, principally by breaking down state-imposed barriers to trade. Courts are not so good, however, at creating harmonizing rules for integrated, border-crossing enterprises. That role fell quite naturally to legislatures and,...
Democracy, Markets, and Constitutions
Просмотров 1572 месяца назад
Economic integration typically involves some constitutionalization of market principles-assigning especially hard-to-alter legal status to commitments to internal openness ( just as democracies enshrine commitments to various rights). The Commerce Clause version of that commitment was a leading reason for creating the U.S. Constitution. The EU’s founding treaties bound member-states to the “fou...
