The Rise of Corporatocracy and the Decline of Practical Reason
Просмотров 2184 месяца назад
In the era of meritocracy, political frameworks envisioned individuals engaging with practical reason for collective ends. However, today's landscape is dominated by the enterprise firm, where practical reason is reduced to a managerial skill, focusing on technical aspects and "core values" dictated by top management, reflecting their ideologies. Management coordinates ends for the corporation,...
The Enduring Influence of Legal Positivism
Просмотров 261Год назад
Legal Positivism is the prevailing legal theory in modern times. So much so that in many law schools it validates abandoning legal theory entirely. In this video, we consider the key tenets of legal positivism, its historical development to better understand its implications for the study of law, legal practice and the intellectual culture, more broadly.

Examining Jacques Derrida's philosophy deconstruction and its methodology. Note that grounded in the pursuit of truth, the deconstructive method may be a useful tool in identifying those wrongs which a specific system fails to capture at one time or another. However, proponents of this methodology often adopt it wholesale including its ontology or lack thereof. Constance Lee and Jonathan Crowe,...

    one more comment. ... these ideas are presented a very clear and calm way and your brief clarifications or examples bring out thier application or usage in the world in a helpful way. I worked with these ideas ( in family therapy) in the late 1980s trying to help families to get 'unstuck' and encouraging them to experiment with different ways of relating.....as is so often the case theory sounds better than the practical application appears ....and your ending remarks about human fallibility remaiin the main thing that most of the humans I know continue to struggle with.

    Thank you again. I think what I find help full about hearing many of these complicated ideas discussed in relation to the law is coming around to looking at them in relation to the 'real world' where some of some of the coolest or most beautiful ideas look reveal differences in their practical applications

    As a person who often listens to podcasts like this while carving or sawing in my workshop I can say from direct lived experience that this talk is much more exciting than chewing on sawdust. Just having words like right, duties, privilege, immunity, disability and their relationships in the same talk is pretty exciting for me

    Hi again. You responded to my last comment ( which was a nice surprise) and mentioned that comments help you guage directions for future podcasts. I'd mentioned liking your angle on Plato and CS Lewis.... I'd like broaden that a bit. ... I found your discussion about the idea of meritocracy as something worth considering in more depth and not throwing the baby out with the bath water and relating these ideas to moral agency as well as self- evident human values very enlightening. I'm guessing your talks are aimed a particular group of people but for many people trying to get their head around things in the world they can be really helpful. I'd never heard the term 'practical reasoning' before but when the internet saw me suggesting that 'truth can't be found by science and reason alone, it sent me to your podcast.

      Thanks for sharing that information about your reasons and how you found the channel. I did start out teaching legal theory but have developed in-depth podcasts that are designed not to be exclusive to law students and more accessible for people like yourself who wish to expand their knowledge to make sense of the world and to scratch that occasional philosophical itch (so to speak). I'll keep all your feedback in mind in producing podcasts in future!

    Hi Dr Lee, I just viewed this talk on RUclips "BILL C-63 - Everything You Need to Know | Bruce Pardy & Konstantin Kisin | EP 442" and was wondering if the quote at the beginning had relevance to your lecture on Positivism. The quote "instead of the Rule of Law we have Rule by Law" seems to be directed towards a sources style managerialism that is divorced from the underlying Natural Law. I might be way off base here but nether the less would be interesting to hear your take on the discussion.

      another very value podcast for me...touching on ideas Ive been thinking and readiing about for a long time. I kind of hope that the link between law and the real world makes it more accessible to more people. Im sure you'd be aware that many of the things you discuss would be seen as 'right wing' nowadays (less so in my youth) and I hope that doesnt limit your exposure to young people and postgraduate law students. I also hope that the links between natural law and European culture and religion don't get in the way of people seeing its value in the world, secular or religious.

      @@johngouthro2325 @johngouthro2325 Thank you for all your thoughtful comments. Varied experiences definitely inform us in an instructive way regarding the truth value of the beliefs we hold. My insights tend to rely on "common sense" drawn from common human experiences. Sadly what's considered to be "right wing" these days is almost everything that doesn't fit a radical tradition. It's my belief that it's critical for our law students to be given every opportunity to choose what they believe from all the available literature. It is also an act of intellectual modesty to examine the writings of those authors who have preceded us. After all, we are just links in a long chain of history affected by a common humanity - universally fallible but also constantly striving for truth.

      Thanks for your reply. I very much agree with your comments about common sense and intellectual modesty and I do hope that our law students are being given opportunity to choose what they believe from the available literature. ..... As a side issue, I've had a long standing interest in physics, biology, evolution and complexity theory and advances in these areas add more support to your ideas about 'natural law' 'objective values' and that ' we are just links in a long chain of history affected by a common humanity- universally fallible but striving for truth

    I think your definition of the word "deconstruction" is really a definition of the word "analysis" applied to communications. That is what "deconstruction" is taken to mean in normal speech. But it is not what the word means in the work of Derrida. The Oxford dictionary definition is pretty good: "Deconstruction is a method of critical analysis of philosophical and literary language which emphasizes the internal workings of language and conceptual systems, the relational quality of meaning, and the assumptions implicit in forms of expression." The Wikipedia definition of "analysis" is good too, and you can see the difference: "Analysis is the process of breaking a complex topic or substance into smaller parts in order to gain a better understanding of it. "

    • @DrConstanceYLee
      @DrConstanceYLee 2 года назад

      I definitely agree with that difference. Derrida's philosophical account of 'deconstruction' differs from the dictionary meaning (you kindly listed a few great ones). His theory begins as a linguistic one but then extends to ethical and legal spheres. Philosophies of language theorise the nature of language to form judgements about the users of language and the world, more broadly. The video examines Derrida's philosophical theory of "deconstruction" and how it has impacted contemporary social, political and legal cultures.
