    What happens is nobody shows up for the meetings. The board then votes in their favorites. A never ending cycle.

    HOA’s have broad and sweeping power in our communities here in Kentucky, but when it comes to traffic enforcement, traffic safety, and enforcing rules and regulations outside the scope of our yard home and yard they’re virtually powerless.. $1200 a year for HOA fees and still pay full taxes without benefits of the municipality outside our gate.     Law-enforcement has no jurisdiction in a gated HOA community (at least in Kentucky) unless it’s criminal nor can it enforce policies, rules or regulations of the HOA Community or trespass a homeowner even if invited (called) by another homeowner.

    I need your help with a couple of issues that are prevalent in our board meetings. I’ve been told that only board members can speak during the board meeting; that only board members can make a motion; anytime a homeowner wants to present an agenda item, under new business, our current board President closes the board meeting and only then can a homeowner speak. Needless to say I believe this way of handling the meetings is counterproductive. After a ‘report’ is given (treasurer, landscape, architecture) isn’t it proper for the president to ask if there are any questions. At that time a homeowner may ask a question related to that report. Is this the proper way to handle Reports? Which I believe expedites the meeting. Yes? No? Is it true that only board members can can made a motion? I asked to be put on the agenda under New Business because I wanted to make a motion before the board and homeowners present to be discussed. However, when it came time for New Business, the meeting was closed before I could speak , and of course I was told only board members can make motions. No ‘discussion was allowed on what I presented to the board. Did the board function correctly in this case? I’ve never been in a meeting where no one could make motions or be allowed to talk during a business meeting. How detailed should the minutes of the meeting be? The minutes from the above meeting did not accurately reflect the two items I presented; and, the one motion that was made and seconded by board members was not reflected in the minutes at all. Any clarification and direction you can provide is greatly appreciated.

      QuantumBunk, they do not want the home. They want the home owner to fulfill his/her obligation to the community. Things fall apart if assessments are not paid. If the home owner does not want to pay the fee they should not have agreed to do so when they bought their home. They are free the sell their home and move somewhere that doesn't require an assessment, but they can not refuse to pay the assessment. It is a simple concept.

    How can a resident find out which owners are delinquent on their dues. My HOA will not name them publicly.

    I am looking for the laws. Texas. Put down on hoas. I live in an hoa. Were they passed a bylaw that says the can come on to my property anytime they want to. And they have not put out a news letter in 7 years. I dont know what to do

      william shearer Read the Declaration. Rules cannot be in conflict with the CC and R's. Generally, you will have the right to some notice before entry except in the case of emergency.

      @@joniboulware1436 they can also not be in conflict with local laws, and I know in some states it is not lawful for someone to come into another's property without proper notice given
