Nothing about tax is exciting. The govt takes funds to pay its bloated overpaid employee base. Look at the absolute misery and hopelessness in the small towns in SA. Dogs how. It's business in SA that provide the solutions to every problem. And the tax authority is not exactly pro business. The more ta you save as a businessperson the better for sa. Sa gets less tax.... better for the country ad a whole. So spare us the sanctimony. Talk of passing knowledge to youngsters.... well the authorities will patently insist that those be non white. We're not exactly loved as white men. So.... I for one don't love them right back. God bless the small businesses in SA. That's the last bastion of integrity.

What if you work remotely for UK company, and they already deduct PAYE at source in UK, but becuase you remotely work from SA soil, do you get a 'credit' for tax already paid in UK under the double tax agreement?
The tax withheld in the UK was done so incorrectly, so no credit available. Please ask for a refund from HMRC - I suggest you appoint a consultant to assist. If you need any assistance, you are more than welcome to contact us.

What is the normal balance on the director loan acc on the bank sheet if the director is owing
FTC is one of SARS's mechanisms to avoid double taxation. Where the client has paid tax to a foreign jurisdiction a portion of the tax paid can be claimed back as a FTC under section 6quat. Hi - I'm filing an ITR12 as an expat for the first time. I've only earned about R 600K in the tax year, so I easily qualify for the section 10(1)(o)(ii) exemption. In Section 6, what amount do I enter in the box "Foreign Tax Credit on income received for foreign employment services not reflected on an IRP5/ITR...". I don't have any other assets, investments or dividends, only a salary. So I'm not sure if a 'tax credit' even applied in this case. Do I just put zero? Thanks

Was employed for 5 months with previous employer, PAYE & UIf was deducted from my salary but when I check with SARS the employer never made any payment & it doesn't show if I was ever employed by that company. Pls assist on what to do

The taxpayer needs to receive an IRP5 certificate, so if we talking about the 2024 tax year, s/he should receive it sometime in June as tax season opens in July. If s/he does not receive the IRP5 a complaint can be filed with SARS but generally, SARS makes it the employee's problem. I have advised taxpayers to file a complaint with the CCMA, citing that the employee is not fulfilling their obligations toward the employee in the employer/ employee relationship. The obligation is to withhold PAYE and pay it over to SARS. The consequence of the dereliction of this obligation causes the employee to be guilty of a criminal offence in not being able to fulfil their obligations. Also if the PAYE was withheld they can lay a charge of fraud at the police as the employer withheld PAYE, leaving the employee with the impression that they would pay the over to SARS on their behalf. The employer did not do this but presented the employee with a payslip confirming that it was withheld and paid over to SARS, which is fraud. Thank you so much for this clip. I whilst believe most affey in Taxation after 20 years doing same, had a multimillionaire client query the heck out of my additional R300 charged in ensuring that treating the Foreign Tax Credit, related income and calculation of S6quate rebate correctly. Needless to say that recovered not even a fraction of the time and resources expended, yet with the introduction of SARS auto-assessments, are not only losing those basic clients, who we find after the fact have had issues with auto-assessment, yet the multi millionaires with income and deductions from every source world-wise are no longer willing to pay for expertise and excellent and personalised service. So SARS are succeeding in putting valuable Tax Practitioners out of practice, as well as the Large automated online tax services where a client is essentially a number. Just terrifies me that AI have essentially taken over what I believe is one of the one complex tax systems in the world, leaving the committed, dedicated experts without income. If you have no objection, I would like to show client your comprehensive clip as whilst I charged him R300 more due to new sources of foreign income and tax credits I was not aware of based on the last 9 years submissions, it is concerning that the value and the expertise are not taken into account. Except WHEN the robots ultimately make mistakes and it costs 3 or 4 times more to fix than submitting accurately in the same time - and let's not even mention the penalties SARS happily rake in in these instances. SARS declined my request for reassessment due to 40 lapsed period. What should I do?
The first option is to request an extension from SARS and then hopefully SARS will decline with an option to do a NOO. Alternatively, if there is a readily, apparent undisputed error they can do an S93 or alternatively an S98 asking SARS to cancel the assessment.

In South Africa, you are liable to pay income tax if you earn more than: > R95 750 and you are younger than 65 years. > If you are 65 or older but younger than 75 years old, the tax threshold (i.e. the amount above which income tax becomes payable) is R148 217. > For taxpayers aged 75 years and older, this threshold is R165 689. There are two methods used to convert the foreign income to Rands to determine if it meets the threshold. > The spot rate; or > The average exchange rate for the relevant year of assessment.
