Sure! Picture this: A bar owner, Birtha, runs a nightclub in the city. She hires Steve, the bartender to serve drinks etc. One night, a patron, John becomes visibly intoxicated after being served multiple drinks by Steve. Despite John's intoxication, Steve continues to serve him alcohol. Eventually, John decides to leave the bar and drive home. Unfortunately, John causes a serious car accident, injuring another driver, Brittney. Legal Effects: Brittney sues Steve for the injuries caused by the accident. She also decides to sue Birtha, the club owner, on the grounds of vicarious liability. Brittney's argument is that Birtha, as the employer, is responsible for the actions of her employee, Steve, who served John while he was visibly intoxicated. The basis for this claim includes: Duties of Care: Bars/ Clubs etc and their employees have a duty of care to their patrons and the public. Serving alcohol to a visibly intoxicated person is a breach of this duty. AND FOR OUR U.S FRIENDS LIKE YOU (State Dram Shop Laws:) This is where many if not all of the United States have dram shop laws that hold bars and their owners liable for serving alcohol to visibly intoxicated individuals who then cause harm to others. Employee Actions: Steve's actions were within the scope of his employment. He was serving drinks as part of his job, and thus, his actions can be attributed to Birtha.
