Why is Incapacity Planning so Important
Understanding incapacity and what it means for you does not have to be a thing of mystery. Planning for the distribution of your estate assets is certainly one important aspect of your comprehensive estate plan; however, it should not be the sole focus of your estate plan. On the contrary, a well-thought-out estate plan should include a variety of additional inter-related components, including an incapacity plan. The uncomfortable reality is that incapacity can strike anyone at any time. www.stiverslawfirm.com

No! I did that took the title the death certificate and registration. The DMV told me. Because the deceased had a daughter. That she is untitled to the auto. Even though she lives clear across the country. She has to register it in her name. Then sign the title to me and mail it back to me. So I can register it in my name. So your wrong!

It's best if you are a sole owner on a vehicle title to designate a beneficiary of title in advance of your death. Super simple..download and complete the form, have it notarized and staplev to your title. This makes it easy for your beneficiary to transfer the title/ownership of your vehicle when you pass.

In New York you need to show proof of insurance coverage before you can transfer the vehicle to a legatee's name. So before you go to the DMV, call the insurance carrier. They will make the switch effective the day you go, otherwise you need to carry both policies parallel until the registration has been effectively transferred. Also, the transfer works if the vehicle is worth $25,000 or less. If it's worth more, the process gets more complicated.

The issue I have is this, dad passed away and no will to be found. He is survived by his spouse and myself, his only blood son. Two other half brothers are now coming to visit mom much more often now. They are wining and dining her, getting her to an attorney where I’m left totally out of the loop. They are extremely greedy individuals, they have a past to prove it, turned mom against me. I reside across the road from some of the 82 acre estate. In SC, if dad passed and no will is found I’m entitled to half,my mother also half. They want to hurry up the probate process so they can build a home on the land. I’m wanting the process to take as long as possible. I have a home on six acres that butts up to the 82 acres. My home is in my name, I thank God daily that my dad and me got it out of his name 5 years ago after I paid it off. So how can I inform a lawyer that I’m in no hurry because the end result will be a forced sale I’m sure of it. I will never agree to sell this farm that once was Granpa’s, then dad inherited some. Im already the black sheep now so I couldn’t care less about feelings any more. I simply want to drag this procedure out until Jesus comes back. Can you tell me how to drag it out so I don’t have to worry about the farm selling? Thank you.

Can UTMAs be used to receive direct deposits from let's say Social Security? Reason I ask. When I start drawing SS, my child will be 11. Therefore, my child can start drawing SS as well. 50% of my FRA. After 8 years that could be a substantial amount. However, the account the money is held in has very specific IRS/SS rules (if you don't want to pay the IRS back any unspent monies) The child's account can't be a joint account with me. They need to be listed as the owner and I as custodian. Ok, UTMA seems to be the one. However, can UTMAs be used to receive direct deposits? If not, I guess a normal joint account could be opened for the child, then we just transfer each month that SS direct deposit. Hope this makes sense. From what I am watching/reading, I can't see anywhere that the UTMA can receive direct deposits. They only seem to be accounts where people can just transfer money into. Is that about right? Thanks
