    Attorney they cause disruption so they can control and most of them are from a certain political party of which they love to stay in court. They do not understand that peace and civility do exist. Just think about the time they spend contributing to mucking up veterans and figuring out ways to demean veterans that if thjs time was spent more productively the VA would truly be rated with 5 stars. The Department of Veterans Affairs honors Memorials which are our fallen heroes. However I have never ever witnessed them honor a veteran who has become a physician or an entrepreneur or an engineer or other professionals. Back in the late nineties in VISN 1, they actually were more veteran centric. I have tried to get through the system during the whole time I have been in VISN 8 with being blocked the whole time. They have controlled it all. The Veterans service organizations such as the DAV have been part of the problem too. VSOs hands are tied. Even a veteran who was diagnosed with cancer the VSO cannot get the VA to assist the veteran because the VA leadership are too focused on themselves. The VA has the wrong priorities.

    I think the VA administration should be run by vets only. Im an Iraq and Afghanistan vet trying to file a claim, and the hoops I have to go through are insane. Getting the help I need is even an hassle. The therapist they employ look at you as a nuisance and even one I had barely spoke English. And even charge me for medication and services I was service connected for, which they say Im not. Hence why i am re filing a claim. I have tried to volunteer and even applied there as an IT administrator. Nothing.

    Everything about VA disability is a scam now! only friends, neighbors and relatives of va employees receive compensation. Myself all my pact act cancer disability claims have been denied. The VA is a scam for civilians to make money off the death and suffering of veterans. I live in Las Cruces New Mexico and no VA rater will ever approve my disability because I am born and raised California. What's the legal at the federal level and all other government municipalities but the federal government will never enforce this.

    I have commented on this because the situation is involving the veteran and the clearance. You may have cases where they pulled clearance because of alcohol. Back in the day they were more stringent than they are today. I did not witness this. Alcohol is not what got my clearance revoked. My clearance was revoked because I couldn’t respond. If no response what are they supposed to do? They can claim alcohol all day but the situation was not about alcohol. If a military member and I am referring to myself is impaired cognitively and speech impaired and psychotic with taking Haldol, what part of this specifies alcohol? Baker acted into a state mental hospital in Bangor Maine, thjs is total loss. Now here are the events that led up to this. Back up I re-enlisted on Diego Garcia in Spring 1994. Prior to I was located in Scotland. That base was closed many years ago. Navy physician prescribed anti depressant for PMS. And I know from experience that an anti depressants compromises skills and these psych meds do. In Scotland applied for the medical Enlisted commissioning program twice and was recommended. Transferred to Diego Garcia after a 3 and 1 / 2 year tour in Scotland. So while on Deigo Garcia I had submitted SCORE conversion package to the Hospital Corpsman rating because the CT rating was locked particularly for women. Women at that time were not authorized for combat duty. So it was two tours overseas to one tour state side. So I had been recommended for MECP, recommended for SCORE conversion, and Special Programs to work as a Navy Drug and Alcohol counselor. Well in order to attend the school the navy active duty member could not be on any prescribed medication period. So the Physician took me off the anti depressant. When a person is taken off any medication they are to be tapered off. Well the Navy did not go that. There was not enough time in between the time I was taken off and the time I was supposed to be present in the school. The school located at NDACS Miramar San Diego, California. Well I was already compromised going into the school. The school had procedures and tactics that are abusive to the psyche if the person does not have the coping skills to withstand the tactics that are used. Well in the school I experienced great difficulty in thought processing to speak. No thinking connected to my speaking. I experienced extreme pressure inside my head with fluid movement sensations occurring inside my head while still enrolled in the school. I experienced hallucinations, delusions, and physical pain inside the head. Physicians say that there is not physical pain inside the head so what is it when people experience a rawness when the stimulus enters into the brain when spoken too and the light enters the eyes causes the person to not be able to tolerate it. I constantly felt my head to see if my brain was moving. I could not communicate. I could not understand. I could not function. I experienced extreme paranoia. I experienced visual hallucinations. The rawness is not emotional pain. The rawness is physical pain from trauma. Cerebral spinal fluid leakage is the fluid movement sensations moving inside the head. I experienced confusion from the heightened feeling level. The confusion was with gender. This was a delusion. The Navy physician spoke about a Limited Duty Medical Board at Balboa Hospital but the physician did not follow through with. The director unenrolled me from the school because I could not function. So I sat for days and days experiencing extreme intense pressure inside my head that contributed to me continuing to have to sigh and sigh to release. So how is this have to do with anything related to alcohol? There was not any usage of alcohol in that school. The bottom line is why would I throw my efforts and work away after I had applied for the medical Enlisted commissioning program. Why would I have threw away the potential SCORE Conversion? Why would I have thrown away Special programs? I would not have. So the Navy continued to overseas screen me to send me to isolated duty when I had already been out of the country for almost 6 years. I was not performing daily living skills. I was staying in the same clothes. I was extremely compromised but yet they cut me orders Fit for Full Duty. The regular navy is who contributed to the dismantling. The navy had other options but they chose the very one that they should not have. Now on the Scotland command they had a CACC. I had just stopped by and the counselor asked about homosexual incidents? Her comments left me baffled. I did not understand at all. Just like they alleged drug usage. There was not any drug usage and there were not any homosexual incidents. A physician on the Scotland command had suggested that I not apply for the medical Enlisted commissioning program because she could see what was happening. The Navy physician was a Black American Lady. She had experienced the same herself. Discrimination towards a woman. Now at the previous command the division officer had encouraged me to apply for the medical Enlisted commissioning program. Why the switch? Anyway back to the time at the school. The navy detached me from the command compromised. I contacted a Civilian Retired Master Chief who ran a facility in Ft. Walton Beach. He and others had been following me. He recognized and understood what had happened. They had opened me up without any closure. I was psychotic during this time with experiencing the extreme pressure inside my head that led me to drink alcohol. The Master Chief recognized where the navy had acted unethical in their delivery. So what am I supposed to do? I had no control over the decisions made by the Navy. I can’t see about myself. I was not eating and I was staying in the same clothes. Cognitive impaired and speech impaired and delusional. Anyway he coordinated with healthcare professionals in Maine for me to be followed up on. Back in the day the Navy had a command in Winter Harbor Maine. Well I was told to go to Ellsworth center by the retired master Chief. They had initially were just arranging an appointment to be evaluated but when they viewed me face to face the mental health team contacted the psychiatrist initially but then it turned into a group of psychiatrists at the state mental hospital who were screening me. I had been transported to the state hospital from the center in Ellsworth, Maine. I was baker acted in December in freezing cold temperatures in Bangor Maine. I had to be put under the jurisdiction of the state hospital because the military did not have resources in that area. When I have mentioned this to people in the recent years, they were baffled at being in the state hospital. Well that is what happened. So I was held in the middle of winter in a state hospital against my will. So I ask what actually contributed to all the adversity? Why and why? How in the world can an active duty member just be almost destroyed with the drop of a pin? For what? Why? What was the purpose? I am none of their claims. And I was none of their claims. The situation was contributed to by medical malpractice by the USN. Even a couple years before the submission of the medical application for the commissioning program the navy needed an officer physical. The navy in Scotland sent me to Lakenheath for eye exam. The Air Force Eye Physician provided incorrect information to the Navy. 20 plus years later if the eye was a problem back then it would for sure be a problem today. As per 3 eye physicians in recent years they have mentioned the Navy made a mountain out of a molehill. So much garbage going on. But back to Maine I was held in the state hospital and they prescribed meds. They prescribed Haldol. I say lord help in today. And then the medication debacle started and continued for years to come. In Maine the Navy picked me up from the hospital and I was being prepared for transfer to Newport Rhode Island to the navy hospital there. So I was driven to Rhode Island from Maine because I was not allowed to drive. So I was being held out of rate in Maine for small tasks in the mess hall. I could not even count the money. So they had already debriefed me from the secure area of the CT community. The leadership in where they initiate the removal of the clearance had already begun the adjudication process for removal of clearance. My clearance was removed before I was transferred to Newport Hospital. I was not able to appeal because I could not function. My clearance was revoked because I could not respond and I was compromised. The situation had nothing to do with a DUI or drug usage or financial. I had never lied on a SF86 about anything. So in January- February I was transferred to Newport Hospital. The medical board had already been initiated from the state hospital baker act. It had been worked up when I was being driven by the navy to the hospital gradually. So they prepared the medical board and I was temporary duty to the Newport hospital until I was transferred to the TDRL. The medical board was finalized by the fall and I had also had a hearing at Bethesda. The Navy could have submitted a limited duty medical board for limited duty at the navy hospital to try to work with me. They could have because I had the obligated time on the books; but, they didn’t. They proceeded to retire m via transfer from active duty to TDRL with eventually to PDRL. All of their alleges are all non truths. I was none of their labels. No drugs, no alcohol, no homosexual anything, no gender anything. They misdiagnosed eyes either intentionally or unintentionally. They revoked security clearance because I was not able to respond. The Clinton administration was downsizing too. So thjs is their forced actions upon me. So when the VA wants to take away the clearance after the fact of the veteran you are representing is a technicality. Anyway….what a mess when it could have been prevented!

    Attorney you made the comment when I had listened earlier about how the military did not take his clearance during the fifteen years. Here is why. He was serving on active duty. In my opinion the two words active duty mean exactly how they are spelled. Active duty does not mean total loss or loss. Military active duty is the opposite of the VA which = loss. This is why. The VA only functions in the BLACK. This is it. This is why the medical intentional errors and the over medicated and the denials. This is why they are going after the veteran’s clearance. This has nothing to do with DUI allegations. There are plenty of people who are working in high up leadership positions who have engaged in worse behavior than the alcohol. How about medical marijuana? How are the companies and the government in favor of medical marijuana with having legalized it in some states? Some companies allow employees to use medical marijuana while working full time and they allow the employees to remain in the revolving door of the EAP program. What is the difference? One makes money and the other doesn’t. Anyway I shifted off the topic. Good luck! You will succeed on this case in my opinion. There are other reasons too. They do not deny clearances because of alcohol. They don’t. It depends on if the military member is a loss in the way of a total loss of health. Alcohol does not equal total loss. There would have to be an underlying other reason. I mean a reason to where the veteran was not coming back around anytime soon.

    Attorney You can win this easily for the veteran to keep his Clearance. Although it depends on his injuries too. If they approved his rating before they decided to take go after his clearance then this is a technicality. And you probably already know the VA laws. The VA is misperceived by the public. The Department of Veterans Affairs is not about benefits. Benefits means in addition too. When veterans wind up in the VA initially there is not an addition too. The Department of Veterans Affairs is compensation for loss or losses however they may come that are service connected or combat related service connected. Now they approved this veteran’s rating before they decided to go after his clearance. This is a screw up by the VA but it depends on what the injuries are. Attorney this issue not only affects this veteran but the veteran community overall. I believe this issue should make its way to the Supreme Court. Here is why. For example: why does a veteran have to be in the state of being of death due you part to be compensated for loss? Take a look at the 38CFR. When a veteran is enrolled in the GI Bill per se or chapter 31 VR&E, the veteran is responsible for successfully completing their programs. Of course this is why the veterans are there. But what if external barriers are induced intentionally to prevent the veterans from succeeding? And the barriers were not their own barriers? Well before the VA will pay for the academic classes the Veterans have to receive “F” grades. Attorney do you realize how devastating this is particularly if the optics were not actually the true performance of the veterans. The veterans would be thrown out of the universities period. Plus they this would make it difficult for them to get jobs. The VA is a total loss agency. The VA is not about positive outcomes. Now in the middle to late nineties the VA was more success oriented and veteran centric than today. I mean the VA truly used to invest in the veterans. And I am referring to VISN 1. I mean true success stories. If you look at people who have had successful surgeries in relation to prosthetics, they might could resume careers. People who have been diagnosed with cancer well the cancer could go into remission. They too might could resume careers. Even some people who have had histories similar to the people in the state hospitals who became actual successes from the hole they were in initially. One person who had this similar path was Rosanne Barr. Veterans are treated as second class citizens. There needs to be a better way to compensate for loss that gives the hand up than to just keep the veteran compromised. Some veterans are compromised so initially that they are not retrainable and cannot work initially when they are placed into the VA. However what happens during the veterans progress that will facilitate forward improvement from that point on depends on a number of factors. However the veterans who are initially established with total loss are kept in this position. This is unconstitutional and against civil rights and against the ADA and against human rights. However the whole western health care system is a total loss system. It is not just the VA. Insurance Companies malfeasance deliverables that have been directed by the government against the people. Attorney here is the difference between the military and the VA with how different actions are being taken against the veteran. The military does not pay regular military salaries for poor quality. Although the military might cause the poor quality via combat or non combat injuries or adverse deliverables that will leave the military member not remaining in the quality position. Therefore the military member will have to be retired. However if the VA blocks the veterans from moving forward this will keep the veterans at the initial decisions that were made when the veterans were in that loss state of being. The VA in today just pays compensation for loss not return to health and recovery and investment in veterans lives. The VA modality is not pro life. This needs to change.

    Attorney after paying attention to your successes, you are actually a ProLife and ProRight, and ProSuccess law professional. This issue about the veterans’ clearance is not about necessarily alcohol. “This is a ProLife issue.” Here is how: To enter the VA the veterans are compromised in some way or many ways. The VA does not stop with just being marginally compromised their modality is full control of the veterans. The VA is not ProLife and is not pro-health and is not pro recovery. The VA stays funded by keeping veterans compromised which is not in line with the US Constitution. Veterans have rights and this veteran should not lose his security clearance. The VA is asserting more overreach to totally destabilize the veteran. Attorney this is an important issue. In order to improve the VA the modality needs to be reversed into the Pro-Life direction. What does this mean? The veteran not losing his clearance with providing him the hand up not stripping him down. There is a rabbit hole into how this veteran is being treated. Please fight for this veteran too keep his clearance. I have more to say about this issue because it applies to the whole healthcare delivery not just the VA. I will continue but you probably already know this information that is happening in society.

    I have one last comment. You are correct about not representing oneself. However it is hard to find attorneys who know VA law and military law. Most attorneys out here only just do appeals for veterans if they have been denied. A result of this just makes it one sided.

    It is going to cost them more money in the long run if they take away his clearance and have to provide him with training in another field than if they allow him keep his clearance and let him work if he can.

    Has nothing to with the DUI. The VA is a government workman’s compensation agency. Now if he is injured or whatever is going on he will not be able to work and it depends on the severity. However it is not even about this. It is about money. If he has a hundred percent then he is not able to work in the same job he did in the military. So the way they look at it him having his clearance signifies he can do the job in the military. However when a military member is discharged from the military the military member is debriefed. Actually if he is out of the military that clearance would no longer be applicable anyway unless he is able to work. The situation with my clearance had nothing to do with the VA. The revocation of my clearance happened long before the medical board was signed and finalized and happened before I had the hearing at Bethesda Hospital trying to stay in. My clearance was revoked at the command before I was transferred to the Navy Hospital. At the command I was being treated by civilian hospital and civilian doctors because there was not federal military care nearby. So my clearance was revoked before anything else was even decided which left me totally without and with the state of being that the situation that happened left me in. So without the clearance the veteran is not employable in the same job he did in the military. It is strange that the clearance is being removed after all the other has been approved. Everything was collapsed in my situation before it ever reached the VA. I believe they need to change the laws surrounding this situation. I was without clearance but I was too sick anyway so they could not retrain me either at that time. And for a veteran to be unemployable with how the laws are written they have to have lost many jobs. But what about the veteran who cannot get a job to hold a job to lose a job well the veteran is unemployable for that screenshot of time. You never know what will happen. The VA cannot predict anything even though they try to control everything so they can leverage their outcome. If the veteran doesn’t have a clearance maybe they can retrain him in something else. Depends on his health actually. However if he cannot be retrained and he cannot work then I guess the other is SSA. Like I have mentioned it strange how the clearance is the last thing they are looking at. My situation surely was not like this. I believe though some of their laws maybe need to be updated or amended. Finally though what they are going on is the VA js a government workman’s compensation agency for the military. So if he keeps the clearance from the way they look at it is he would need to go back in the military and he can’t. So why can’t he use his clearance out here? Companies need employees with those type clearances. It is strange how they seem to be getting in his way of holding employment. I see the double standard here. I do not mean to bring this up but I will. Former Senator John McCain was 100% PNT and the VA never bothered him and he never went to the VA.

    No does not apply to me Situation happened many years ago and Commander Naval Security Activity SSO yes probably Ft. Meade or Laurel Maryland. Revoked but was to injured at that time to appeal But all that stuff affects today particularly when it was not the truth

    There are thousands if not hundreds of thousands of Veterans who were coerced into receiving the Moderna COVID Vaccine by the VA, then suffered some kind of adverse reaction afterwards. All claims filed by Veterans under US Code 38 Section 1151 should be reevaluated. Additionally, corresponding VAERS reports should be filed with HHS for each Veteran who was adversely affected by this vaccine.

    I was in the war in Israel when it started when I was on tour with my college. My background check has taken two weeks to clear, which is worrisome as I have never committed a crime or have been charged with anything. Any advice? I have been trying to get a job at a hospital.
