    The 10th Amendment also includes powers retained by the People. Reading "or the people" out of it strips the people, from who the power is derived, from the ability to grant limited power to the State as well. This effectively nullifies state constitutions specifically enumerated powers vested to a State governing body, and gives them all power not vested in the Federal government. Don't fall into that trap.

    My niece who is around 40 years old told me she was taught in school that the original amendments were just an afterthought. I was like um no, they were conditional for the majority of the states to join the union, and were put into place as the only way the entire country could continue to exist! I probably worded it badly but wow, what Virginia schools are teaching kids is bs.

    Aside of the interpretation being mostly incorrect, A IV USC is majority applied to "full faith". This is: each State's rulings in legal matters can be shared amongst other states. A conviction for a crime (and details of the case) in one State can be used by another State. This clause is not not used as often anymore since there are Circuit courts now.

    Coming from a Commonwealth nation(Australia,) where the National Government controls external responsibilities as well as making sure no State can impose laws which penalise other States, would I be correct in suggesting that SCOTUS got it wrong with the overturning of Roe v Wade, given that no (US) State can penalise or prevent it's own citizens from accessing services available nationwide?

    The privileges and immunities clause also applies the bill of rights to the states, as it is privileges and immunities of the people of the several states; in spite of the BS ruling of barron v Baltimore.

    It is odd that you would use “legally married” when there was no such thing as a “legal marriage in 1789. At that time, the government was in no way involved in a marriage; certainly it was not the “senior partner” as the courts have said it is today.

    This is crap. Look to Amendments 9 and 10 to see that the Federal government doesn't "give" anything. The Federal government's powers are *delegated* by the States to the Federal government via the Constitution, specified in the 10th Amendment: "...powers not given to the federal government are reserved for the states or the people." From about the half way point in this video, the presentation parrots the academic community's misrepresentation of the Constitution. The US is where its is because the States allowed the Federal government to extend beyond it's delegated powers, first through the Congress' passing legislation granting the Federal government powers not delegated by the Constitution, then via the administrative state interpreting that legislation in a way that extends the agency's power.

    *_Look up "nation" and "country" in BLACK's Law Dictionary._* These United States ARE NOT ONE 'NATION!' They are ONE COUNTRY consisting of *_50 Nation States!_* Before the Civil War, this was understood by just about everyone. After the Civil War, people were still shell-shocked and skittish about *_States' Rights_* even pretending that such a thing no longer exists... resulting in the emasculation of States in 1913 under that *_TRAITOR WOODROW WILSON._* Now, we have 2 "People's Houses," instead of one. 😎♥✝🇺🇸💯

    So the role of the federal govt is to protect the states from invasion. Yet the federal govt has thrown the southern border open and allowed anyone and everyone into the country. Therefore the federal govt is participating in an invasion of the country and has acted unconstitutionally. The federal govt needs to be immediately shut down, all federal officers, (president, senators and representatives) need to be arrested and a new govt formed by the people.

    What's interesting about The United States Constitution is that there is no EXPLICIT protection of bodily autonomy. Which means it's kicked down to the states. I'm not just talking slavery (which was abolished via constitutional amendment) or abortion rights (which now recently isn't). It means the right to do drugs, engage in sex work, or to perform suicide and/or euthanasia is a states issue rather than a federal one. That's why there are small areas in Nevada that have legal sex work and no where else in the country. Or the use of marijuana is state by state. And now abortion is not a nationally protected right anymore. Oh, and the ages of sexual consent is also state by state (gross). The history of America would be completely different if bodily autonomy was part of the Bill of Rights. (But, hey, we got the post office and copyright laws in there.)

    Article IV, Section 1...Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof. You mention marriage with respect to this. "If you're legally married in one state, you're married everywhere." Unfortunately, for a very long time this was not the case. At one time most states had anti-miscegenation laws, that is, it was illegal for a white person to marry a person of another race. Which other races were forbidden varied from one state to another, ranging from just blacks (and with some fraction of ancestry specified) to anyone who had even the smallest bit of any known non-white ancestry (one drop rule), and enforcement varied from fines to imprisonment. It was generally the case that states with anti-miscegenation laws would refuse to recognize mixed race marriages contracted in states that had no anti-miscegenation law, and the Supreme Court HAS NEVER DECIDED THAT THIS WAS A VIOLATION of the Full Faith and Credit Clause. Instead, the Court decided that anti-miscegenation laws were themselves unconstitutional (Loving v. Virginia, in 1967) on the basis of the 14th Amendment's Equal Protection Clause.

    The Welfare clause of the Constitution does not define an addition power of the central government but serves as a limiting qualifier on the explicitly enumerated powers of the central government. This was explained by the author of that clause, James Madison, in the "Federalist Papers.

    Skipped right over the ending clause of the 10th Amendment - the men who wrote the USC put a great deal of emphasis into the final clauses…but we wouldn’t want to discuss that, reminding people of their personal responsibilities in protecting people’s liberties.

      Article 2 sets the requirements for being president. There are very few actual requirements.

    Its important to also consider the Declaration of Independence, as well as the Preamble when looking at any of the parts of the Constitution. Everything starts with The People (who have a set of unalienable rights from their "creator")...then the People, through the Constitution grant certain powers to the federal government (its essentially the same at the state level...its starts with the People)...anything not specifically granted (through it, or the various amendments) is reserved for the States and the People. The first 10 amendments, the Bill of Rights, which were ratified along with the Constitution..place a further set of specific restrictions on the government.
