    My assets are less than 132k. I'm 65 and not eligible for premium free Medicare or medicaid. I'm disabled but not on ssi because of excess assets. Would a mca be right for me?

    Remember if the kids inherit the house instead of it being gifted, there's probate fees of approx 5 percent on the first $100,000.00 (then ? on the rest) unless she has a revocable trust or a trust that shields it from medicaid qualifications five years in advance to avoid probate and creditor's. There may be inheritence tax if you live in one of the few states that still have that. Be informed to consider.-John's wife

    Thank you for this. Can you give thoughts on this scenario? A house is in an irrevocable trust. The Grantor decides they want to sell that house and buy a condo that is cheaper. They use their own money from personal savings and cd’s from the bank to purchase the condo and the condo now goes into the trust. When they sell their house they moved from, the check from the sell of that house goes back into the trust. Are the Grantors allowed to be reimbursed from the trust since they used their personal money to buy the condo?

    Good Afternoon- my ex-husband passed away and my daughter didn’t receive any of the beneficiary (he remarried but I don’t think she received any beneficiaries it’ll either ).     Can you explain a situation with loss of capacity grantor hasn't passed yet but they're incapacitated so there is now a power of attorney in. How would that work between a power of attorney and a trust if they're not the same person trustee agent but the bank accounts are in the trust in the agent needs to pay bills on your behalf. Can the power of attorney go in and make changes to your trust fund that you didn't intend? How can you prevent that? Do you need to leave one checking account outside of the trust to be able for them to pay the bills?

    In Maryland, from the standpoint of portability, does it make any difference how the assets are titled at the first death? Can the surviving spouse get the deceased spouse's unused exclusion (DSUE) even if all of the family assets were titled in the name of the surviving spouse?
