    Another issue I have with law school and lsats is appeals courts. These people get it wrong all the time. Then it gets to the next higher court. Until it gets to the Supreme Court. So it means there's a lot of well paid lawyers out there who get it wrong. Shouldn't they find a other line of work ? Same with judges. ?

    But I'd get this wrong. It's biodegradable. It's natural it literally her on a tree. The wrapper scores poorly on all of those factors. I would get everything wrong ! I'd have to think no like a lawyer? Seems counterintuitive since they don't seem to dig too deep.

    A doctor would think that a jogger shouldn't eat a banana while running and risk dehydration.. this was a lawyer thinking like a doctor 😉

    I know im not a lawyer or anything im just a 13 year old thinking a bout my future but what i was actually thinking that the police shouldn't give a ticket to the jogger because the banana and the rapper can easily throw it in the trash if the police officer officers tell the go pick is up but the coffee who would wipe it it's liquid..... can please someone answer me and correct me it im wrong

      Clearly you didn't watch the video. Anyone could deduce to the conclusion that quickly. As he says at the end, the point of the video was to describe the steps a lawyer would take to solving a more complex problem. By doing this, professors can break down a lawyer's thinking process into more understandable parts. He acknowledges that anyone could solve that in a short amount of time.

    But there was no fine for coffee, because you can spill coffee not on purpose, thus it's not littering we're talking about it's an accident, whereas when you throw away a candy bar cover or banana peel it's bc you're lazy enough to go find a trash can.. thus you have to pay a fine, that's how I would've explained it..

      werdo Atlaw But I think your also overcompilcating this a bit because the situation only depicts 3 items on which the committer could be liable of committing LITTERING and nothing else... at least for the case. There are no forms of "assault" intended in case someone unfortunately happens to slip by the banana. It only asks whether if the jogger can be issued for a littering offense. I also agree that the banana is biodegradable and that the jogger should not be issued a fine, WHY? Let's say you happen to pick up a grown flower from your garden and took it with you. Then you decided that it is useless and then threw it on the ground. You can't tell me that I'm littering because that flower literally came from the ground. Who knows, maybe it could have landed or created a minute hole on the ground and uproot it's branches and grow into a new flower.

    I contest that conclusion that they police officer should ticket the jogger, because the banana is biodegradable, and (assuming) that it doesn't violate the purpose behind the no littering sign.

      You're going to deep in it, keep it as simple and plain as possible. The jogger dropped the banana peel in a public place according to the story. This means the jogger is responsible for the banana peel no matter what, because he unlawfully disposed of it. If somebody was to slip on his trash 5 minutes later, he would very easily be considered as a suspect for the crime.

      That is true. But the Banana peel will probably be eaten by a squirrel or something. The wrapper, not so much. And slipping on a banana peel isn't as easy as they make it seem in the cartoons. I'd say you have a better chance slipping on the dew on the grass.
