Sister was medical power attorney but she went and put herself on the bank acct over draft the bank and some of the bills did not get payed im sure my other sister was the benafery of the bank acct. My mom & I need an attorney, the hospital took us to Orphans Court saying she's incompetent n she supposed to have Dementia, Alzheimers,Bipolar and DID, we've gone thru two hearings and the judge still ruled against me as a Gardian, they've just focused on me and defaming my character ,they put her in a home and she's gone down hill because they don't take proper care of her, I tried telling the judge with me she gets interaction, stimulation, we do crafts, she plays with my parrots , I take excellent care of her. I take her to to socialize at the Senior Citizens center. She & I are all we have, my dad passed away 6 years ago and my sister from covid and it's killing she & I . I go out to see her every weekday. She's not as sick as they say. The Gardian refuses to take care of her needs , she won't even get her yearly exams done. The judge, lawyers all agreed to have her house deed put into my name because I'm disabled and I've lived here all my life and now the Gardian is refusing plus she's accusing me of extreme crimes ,stealing her money, and she's trying to take me to court again, I've already had a mini stroke TIA from all the stress. They will not back off, the Gardian has emailed me 38 x in 5 weeks just arguing with me, being hostile accusatory, argumentative. She just wants my mom to lay in the bed and pass away. She stopped the Physical therapy. I csnt take it anymore. I had Medical Power of Attorney so how did the attorney & judge break it ? I couldn't afford an attorney because I'm on a fixed income. My mother has very little money and lives in an ALH. She brings in $3000 a month. The ALH cost $4000 per month. She keeps giving money to a brother that has never lived below his means. Now she is almost broke. As her durable POA, she won’t let me step in and stop it. I feel like she is being exploited but adult protective services says there is nothing I can do.

My mom has severe dementia. I am her Power of Attorney for health and share Durable power of attorney for finances with my brother. My Dad passed away last year. She resides in a memory care assisted living facility. She has a Family Revocable Trust which states if she is incapacitated, then my brother will serve as trustee for the trust. She owns 2 properties. We would like to sell her 2 properties and place the cash from the sales of 2 properties back into the Family Revocable Trust. This trust pays Mom's bills. Yes revise and keep current power of attorney. It can be changed but do it while you, yourself can.

He also did make me his guardian as well, and that was done by the same attorney

How do you determine capacity if you’re a lawyer and not a doctor? And isn’t it case by case I mean there could be one lawyer that says I think she has capacity then there’s another lawyer that says no she does not have capacity. There’s good days and bad days with dementia and Alzheimer’s. It seems like this is a loophole right here and this is why I personally think it’s best to get a guardianship or even conservatorship if you have somebody with capacity issues because you can’t be sure that you can trust everyone to understand what capacity the person in your care is .

There is point to planning or saving. I know this first hand from parent, elderly friends, and parents of friends. My mom's memory care turn out to be $12000 a month. Unless you expect to be worth many millions in total assets there is no way to pay this kind of pricing. You pay down your assets to what is allowed (rough $12000 for burial) and then the government will have to cover the rest. My parent paid into social security and taxes for a total of 105 years so they are not sponging or abusing the system, especially considering how Congress robbed what benefits Social Security should have paid them,
