    This is a direct result of the complete mess of a remediation process due to the government not making it clear that ALL leaseholders should NOT be paying for it. They made it so complex an unfair that it has taken years to get here - just starting the remediation for many buildings, and others not even started yet. If they made the real culprits pay it would all be done by now.

    Leasehold... where you pay the price of freehold and the landlord and pick and choose when they're a land lord. Need fixing? you pay. But you pay ground rent and service charge too

      No. The owner is the freeholder. The freeholder must pay. Service charge is just maintenance. A leaseholder is just renting a place.

    How do they measure the cut of point? Is it the cladding only or from ground up to cladding? I’m getting mine removed now by my council which is Woking borough council but no one is telling me if I’m liable for remediation or not. They won’t answer our calls, our emails and are just dodging the questions. How can I find out if I’m covered under the government funding or not? During the removal they also damaged the window frames too and we found out that the windows were not fixed or supported correctly either. One minute they remove the beams that are supporting the building and windows and then they decided to put them back on again

      There is no change......The all point of all of this was to remove the unfairness ground rent! This has not gone through, so Freeholders can still take advantage of people who spent over 300k to own NOTHING! That's a fucking shame

    Leasehold is not an unfare system it has just been abused by investment funds. The kind that Tory members love to have as donars to be honest. The ground rent and service charge and renewal fees have all been abuse to maximise land freeholders profits. English Land Law is a cornerstone of Englush land ownership by the elites since 1066. I think you wil find that only detached houses will be free from leasehold estate status. Residential flats will never be and farmland will never be, there will always be leasehold including for commercial property.

    Does the bbc have a legal department. That was the worst definition of a leasehold land/ownership vs freehold land/ownership I have ever heard. The freeholder owns the land. Land includes anything attached to the land by its own weight ( with some exceptions) and this extends down to the bottom of the Earth ( with some exception in statute and common law) and up to the heavens ( with some obvious exceptions such as allowing for airspace). So the house or flat etc is owned by the freeholder not just the land the house or flat is built on. 😕

    Hi Caroline, I’m assuming you’re referring to Latitude 52? I am a Leaseholder there too although I live in London. I am a qualifying Leaseholder as it’s the only property I own but I (as all the other qualifying Leaseholders in the building which is most) are also caught by the Lawyers “interpretation” of our relevant buildings status because as you say, the Freeholder (via a Ltd Company) also personally owns a number of apartments too. Very sorry to hear how this has affected your health and retirement. It is all so wrong. The Building Safety Act is designed to protect Leaseholders not wealthy multi-millionaire property owners. A group of us Leaseholders are taking collective action via a Tier 1 Tribunal. Also, our MP Luke Pollard has been quite helpful. I’ve had direct communication with his office and some of the other Leaseholders met with him personally earlier this week.     I thought I was a qualifying leaseholder. Capped at £nil 0. To now find out our freeholder owns flats in our building so is a leaseholder. Which we are told now that because of this the qualifying leaseholder is not protected. The costs are passed onto us. So this loop hole has allowed the freeholder to pass the costs onto the innocent leaseholder.

    I tried last year. A leasehold is a long-term prepared rental. It isn't yours no matter how much they say it is. There are Draconian codicil over what you are responsible for, and you can't even secure your property against the owners. The property I looked into they even had codicils about what type of paint you used to paint the property. Every responsibility was yours, with none of the authority or choice. Ask anything they don't answer. The solicitors that drafted the document refused to explain it qualify anything. I put pages of written questions in for clarification, they simply refused to answer, in fact they dropped the whole thing and refused to communicate after that. You have much greater freedom and rights as a renter than a leaseholder enforcible under the law. Luckily I am freehold and it seem staying that way. As a leaseholder you're just a source of income for the owner.

    Would be great to get rid of the whole leasehold thing across the UK, rather than someone, investment company or other type of company (including individuals) buying up empty plots of land and then leaving it empty for years on end with nothing but a to let &or for lease sign on it. Only for the person or company involved to get a constant income stream from it on a monthly basis or once every century if housing were to be built on the land.
