    I work 12.5 hour nights three nights a week. They force us to be on call three times each month. So on my days off, they are NOT. my day off, I have to rest in waiting until 9PM. We are NOT paid for it at all, unless you’re called in, you get your wage for hours worked. It’s so corrupt, psychopathic.

    Howdy Allen... My name is Cole Bearden, and I have been fighting my Injury Claim since 4-18-2022. I'm living in my vehicle across from the Lima OH BWC/IC Hearing Office. Unfortunately sir my Injury was handled incorrectly after I notified my Foreman my Back was hurting between my shoulder blades. Was in so much pain I booked my own appointment at the VA on 12-9-2021 bc I was in the USN after High School and the pain I was feeling after I put my Safety Harness on was unbearable. Not too long after that Doctor's Appt I sent text messages to my current Foreman and Superintendent notifying them of a series Safety concern. Initially I was told Good Job by Foreman. Few hours later was told to put phone away and no more taking pictures. To the following day not even 24 hours later I was called into the office and Fired on the spot and was escorted offsite. Never been written up or anything before my Termination on 1-29-2022. Once I found out I had coverage and what Workers Compensation was via by the Unemployment Benefits Lady that was helping me. I'd of never filed my FROI on 4-18-2022. I've proven all of this and more to the BWC/IC. My first attorneys severely dropped the ball. So badly they didn't know where I got Injured because it took me approximately 7 months later to find out they moved my Injury Location from the Middle-Upper Thoracic Region to Lower Back Lumber Region. This has been hell I've got 2 buldged disks and a pinched nerve between T5-T6 as shown on MRI amd EMG. I don't Deserve this coordinated effort to overlook the obvious Facts in my Claim.... I'm protesting to this day outside the Hearing Office because this isn't lawful anymore. The Cancel Culture has got to go. Yawl are hurting Cops and the Working Class of Ohio. The Bad Faith and turning a blind eye to Employer Fraud then MCOs Cherry Picking non-related outdated injuries to give Insurance Companies an advantage and of course never notifying the Injured Worker to let them know any/or all changes in your Claim 22-131930.... ain't right!

    So we live in a world where you can make salary, have a mandatory 24/7 168hr a week job, and you could be exempt from OT and they don't have to allow breaks to eat? Seems like this is running more on good faith than any intelligent legislation.

      That's what contractors expect from their delivery drivers. for 180-200$ a day they expect you to work more than 8 hours a day. Canada is become a hellhole for employees but good for employers.

    I am a dental hygienist (have worked as a hygienist for 18 years and 29 years total in the dental industry). I can tell you first hand there are many, many dentists who intentionally misclassify temporary workers to avoid their 7.5% share of FICA taxes. Then, working as a FT employee, I have had them change time cards in the computer to avoid paying over time. The problem is they think since they own the company they don’t really have to obey department of labor laws or tax laws. Then they’ll come to work and brag to all the patients about their lake homes and expensive vacations. Most of them are crooks when it comes to their employees. They have intentionally kept hygienists at part time for decades to keep from paying them any kind of PTO, health insurance or sick leave. They also rarely give raises, but their prices definitely keep up with inflation.

Each case is different, but a dental practice would be very hard-pressed to appropriately and legally defend labeling a hygienist an independent contractor.       @@tittleperlmuter Thanks for your reply. Now that I know what the laws are, I am never I’m going to let that happen again. But it took a long time for us to figure out as a group (us new hygienists fresh out of school) what was happening to us. I believe the dentists were counting on it. But now going forward, I don’t think many dentists are trying that hard to get away with it like before. The cat is out of the bag. I also spoke up about the altering of the time cards as violation of DOL laws, and that hasn’t happened again, but I keep a close watch on my time card.

    You obviously haven't heard of FLSA laws... Firefighters earn 1.5 time for anything over 53 hrs a week. As we work 56 hrs a week, 3 hrs are automatically at the 1.5 rate. I retired 12 yrs ago and our department did away with comp-time some 30 yrs prior. Also, FF's assigned to a 40 hr week special assignments are then compensated at 1.4 time, to make up the 16 hr short fall. Besides my normal schedule of 240 hrs per month... it was routine to work an additional 72-96 hrs a month in OT (1.5 rate) in coverage or emergency call backs. The little dirty secret of the Fire Service.... paying OT is cheaper than hiring for vacant positions.

      Thanks for that clarification! This video was just intended to cover the basic issue of whether police and firefighters are entitled to (or entirely exempt from) overtime. To your point, as I mentioned in the video, public agencies employing police or firefighters aren't mandated to follow the workweek-by-workweek rules that guide private-sector employees. This video didn't cover when and how overtime pay works after that - and your note gets into a more complicated aspect of this analysis. Federal law does permit the public agency to exempt an employee from overtime until they've reached a certain number of hours in whatever pay period is adopted (days in the pay period x 7.57 for firefighters; days in the pay period x 6.11 for police officers). So, since you were a firefighter and your department apparently adopted a 7-day work period, you were allowed to be exempted from OT until you reached 53 hours in that 7-day period. As the video also does not cover, there are also many special rules applicable to firefighters and police officers about how much comp time off may be used in lieu of wages for overtime, what constitutes your "tour of duty," whether sleep time is considered working hours, and similar issues.

      Thanks for commenting, Stuart. That's an interesting question, and like a lot of things in the legal world, the answer is that it depends! It can turn on the laws of the state where you work versus the state where your company is headquartered, it can turn on whether there is any local office in your state of residence versus pure remote work, it can turn on whether your employee handbook or any paperwork signed with the company work speaks to "choice of law" issues for employment disputes.     Hey bud, thanks for the video! My employer gave me a 1099 and I am clearly a salary employee. Even have proof in email that they have put us all on 1099 to "save on their taxes to grow the company". I don't believe I should have to pay all of this back when I have no expenses to claim.. e.g. haven't bought any tools, insurance, materials ect. It's seems very sketchy on their part. They're a new LLC. I am aware of the 8919 form but I am wondering if you can tell me; do I have to send 8919 in before I file, and how do I receive the form. Any help is greatly appreciated!

      Yes. Part of your income taxes go to fund Social Security, Medicare, and unemployment. Companies are required to split 50-50 with their employee's income taxes for Social Security, Medicare, and unemployment. However, if you are classified and paid as an independent contractor instead of an employee, you pay "self-employment taxes," which are essentially equivalent to the share of Social Security, Medicare, and unemployment that the company would have to bear if you were an employee.

      Yes take it from someone that has 3 kids only makes little over 40k and does not get a refund now. If your 1099 and cannot claim a bunch of write offs or deductions you are 1000% fkd. You get Taxed horribly and to many companies are ok with that.... along with congress... they know but they wont change the policy bc its mostly construction industry where workers are hurt by this and most ppl in c9nstruction have certain political leanings they do not like.... litteraly i was good on my taxes till about 2 years ago then idk what changed in the policy but it fkd us completely.... i mean bad really really bad. Not only do i have to pay for medicaid and ss all myself but i also havent been paid any overtime for the 1000s of overtime hrs ive had in just past 3-4 years.. i mean minimal 10 hrs a week, more like 15 prbly. Then i must also pay own workers comp coverage or risk it and just provide a waiver which is what i have to do bc i cannot afford the coverage.... its fkd up... financial Death by a thousand cuts.

    Hey! Your law firm should really look into women who have suffered copper toxicity (poisoning) from the device for failure to warn. I was one and almost lost my life in 2017. I’m in a copper iud toxicity Facebook group with over 3,000 women

    So what does this mean for employees that are still under the threshold amount and still not making over time or there only paying half time for over time.

      Sabriena Shattles Thanks for the question! If employees are under the threshold, they have to be paid overtime. If they're over the threshold amount and their job doesn't meet certain criteria, they still have to be paid overtime. For salaried employees, overtime premium pay of half the regular rate of pay for overtime hours (that's paid above the salary) can be the correct rate in certain circumstances.     Is it legal to work for a company that amazon contracts to deliver packages for commission only?? I just made 600 for working 55 hours. I’ve worked for another contractor that paid 14/hr = overtime guaranteed. This company claims “$140” a day. For the same 10-12 hr shift delivering packages. No overtime. Same job. Is this legal?

    The problem with Nursing homes, being understaffed is.....STNA'S are very under paid! That's why America, is experiencing a shortage of Nursing Assistants. Why become a STNA for 12 bucks an hour and work yourself to death? It's a physical and mental debilitating job. They deal with very combative Residents/Patients, getting kicked, punched, spit on.....and you have to take it! Nothing you can do about it! Dealing with rude nasty Nurses, that treat you like trash! Also having to get mandated, to work double shifts because of call offs every day. Why put yourself through that HELL, for crap wages!?! When you can flip hamburgers for 11 bucks an hour and not have the physical and mental torcher, of being mistreated by nursing staff and residents/patients. Nursing homes, need to wake up and realise, that STNA'S...are the backbone of their facility! Without them, they have nothing. They deserve respect and respectful wages. They are hard working people! Unfortunately...it's a thankless job!

    I've been looking into web sites that help people find artists to commission art work. From what I can gather from personal experience that there is a good chance they don't pay minimum wage to artist for commissioned work. Is there some type of requirement that these web sites should acknowledge showing that they are honoring minimum wage for their workers. sites like artcorgi.com and artistsnclients.com. The latter site i know an artist who does 20 hours of work for $35 bucks, though I lives in Thailand.
