No amount of speculation on facts will overturn the verdict. Rather an experienced qc/kc needs to look at the facts & concerns raised since the conviction. Instead of reiterating the Lean/ Scott work to date:- (i) the construction in law of the facts heard by the jury needs to be "deconstructed" in terms of any unheard factual evidence and any unheard facts..to test if any reasonable jury would have found the case against him unproven or innocent if it had been made aware of this. (Ii) re(i), remember that if his defence could have called a witness or produced evidence from the crown production list but did not, then you can only usually only use that witness or evidence if you can explain why the defence would not have bern aware of its significance or else you have to say he was denied a fair trial due to defective defence ( tho this is a high threshold test to meet) (iiii) look at the concerns raised from a "points in law" perspective. Eg did the prosecutor misdirect himself, the court and or jury regarding the relevant DNA facts? Was there wilful misdirection? (Iv) were there procedural decisions taken during the trial which only favoured the crown and not the accused? Ditto, re the investigation. Echr law considers them as part of a single process regarding right to a fair trial. It can also constitute a miscarriage of justice. (V) the concerns about the factual investigation & the trial process needs to be compared to the statute, regulations & guidance applicable at the time for police, prosecution & defense lawyers to see if anyone fell short on these requirements or also to see if these system " safeguards" were open to abuse such that he was denied a fair trial. Eg use the standard of the European convention on human rights & the caselaw if the european court of human tights as the standard for measuring this. Check out breaches of article 6 in criminal cases, also breaches of art5( deprivation of liberty), also art3( inhumane treatment)..check out also the UN declaration on rights of a child. (Vi)5 petitions need to be submitted to the scottish parliament and which if not resulting in rectifying the following grave weaknesses of the Scottish criminal law system, should then be taken to the supreme court for a determination regarding the absence of correction amounting to a breach of echr art6 and an undermining of presumption of innocence and a deprivation of the right of the jury to be master of all of the facts ( because evidence relevant to their decision making was withheld or not made available). These petitions are particularly relevant for convictions with Life changing sentences....Scottish law requires that proportionality e.g. severity of a conviction, is given weight in parliament & court decisions. Petition1- need to reform law on sufficiency of evidence. A) That conviction on solemn matters should not be on decisive reliance on speculative construction of circumstantial evidence. Failure to rectify this risks a tickbox compliance approach with confirmation bias...risking unjust convictions. B) judges must be required to direct jury on unreliability of witness ID evidence regardless of credibility of a witness. C) outlaw the acceptability of directing juries to "cherry-pick" witness id evidence to the extent of ignoring contradictory or inconsistent evidence between eyewitnesses or contrair to facts regarding the accused ( eg the absence of Malikinson having a hairy chest) . Petition2 - right to a fair investigation. There requires to be personal & organisational sanctions for non pursuit of & non-disclosure of exculpatory evidence to the defendant & defence . To this end, petition 1 is also required, to prevent against cheaper investigations where only minimal work - especially forensic testing - is done because the tickbox sufficiency to get a conviction based on speculatiive circumstantial evidence has been met. All of which risks lazy investigation & ease to frame a scapegoat. Many of whom shall be the more vulnerable. Without prejudice to the right to fair & sufficient investigation in all cases, cases with grave conviction implications must be afforded relevant proportionate fair investigation plus full disclosure. Both petitions are required to protect the standing of and public confidence in justice plus policing in Scotland. Empowering the public:- The public also needs basic info regarding how the investigation & conviction processes operate in unique Scotland. Kids need that info.. including as some will become policemen & many will become blogger gossips. Eg, the early isolation of luke & getting him to remove & confiscate his clothing was correct forensic evidence procedure ( though his right to have a support person present was required). His clothing might have trace evidence of the actual killer ( if it wasnt him) on him from things he brushed against etc... Though for his defence to explore that could risk the prosecution saying he did it with that other person as accomplice . That risk can be a reason for defence to avoid raising certain evidence even though it may appear on some level to be useful for the defence. Ie any critique of defence lawyer approach needs to be done carefully and in light of the evidence as available at the time to the defence. This is why trying to quash a conviction on defective defence alone seldom succeeds. Petition 3- need for a proportionate approach to recognising rights found in Cadder. Cadder Right to a solicitor stems from the need for compliance with echr. Thus it is relevant for every conviction since the uk entered echr. The Scotgov decision to only apply it to post-cadder convictions & processes and for reasons of its own convenience is unfair. It could instead be applied to quash convictions where the conviction relied upon construction of evidence featured jury-heard evidence that came from such refused lawyer circumstances. Petition 4 - right to not be discriminated against due to belief in innocence. Ie access to rehabilitation & parole should not require denunciation of claim of innocence. Anything less amounts to psychological torture & is inhumane (breach article 3, echr) and discriminates against those with a genuine such belief ( breach of article14,echr). ALERT. Note also:- The rightwing of the tory party is trying to remove the uk from the echr. That means all your rights to a fair trial & process will become a party political football instead. Indeed all your Rights will be. And government failure to protect you from unfair trial cant be taken to a court. One of the current Tory leader candidates will also not allow his MPs a free vote on it. So undermining the purpose of parliament under UK law - which is to hold any government to account & especially when it's proposals undermine your legal rights as a human being. Lord neuberger who headed up the UK supreme court stated the UK has now in effect an elected dictatorship system. It is the voice of parliament & the accountability of the officials & institutes to a court of law which is your safeguard..using echr as it's standard. The Tory candidate knows this. Most ordinary people do not . iincluding it's own party voters. This goes beyond criminal justice issues..there is a plan to decouple the UK from the international law of a state not to harm or neglect it's own citizens ie it's duty of care as assessed by a neutral party applying that law. Think in terms of doctors not being obliged to act in accordance with the hypocratic oath. A Scottish parliament committee is quietly exploring the same with a deadline for public views before it reports on 28th Oct. (!). Google "king Henry powers" & committee Petition 5 Right to compensation for deprivation of liberty & interference in family life & undermining of dignity. Charging for "accommodation in prison" by lawful Innocents amounts to compensating or rewarding captors in unlawful imprisonment..rewarding scottish law on kidnap. Instead compensation for err or negligence which contributed to the deprivation of liberty & harms should be provided plus recompense to set the person into a broadly equivalent situation had he been able to pursue average opportunities elsewhile available to him. Where state bodies have been found to have framed the person to the exclusion of conducting a proper investigation, additional compensation should be given & said officials charged with perverting the course of justice. So oroviding also a deterrent against mischief, laziness or gossip mongering. Hope all this helps move forward the work to date into a productive set of outcomes.

I have been interested in this case for many years and always look for things to listen to regarding it, are there anything that gives the opinion of the deceased families claims that Luke Mitchell is guilty? everything I have listened to is all based upon the 'Luke is Innocent' opinion however I always like to hear both sides of the story prior to making an opinion on anything. any recommendations greatly received thanks

The Government’s strategy document points out that we have over 300,000 heroin and crack addicts in this Country. Two-thirds of problematic heroin consumers are suffering from childhood trauma - sexual or physical abuse or neglect. The rest are suffering mental health problems or adult trauma. They are self-medicating with heroin to cope with their profound emotional pain. Heroin kills more people than any other illicit drug. At the same time heroin generates £5.1bn for drug dealing criminals. This is the largest section of the drugs market and the County Lines activity is focused entirely upon heroin and crack cocaine. Heroin and crack cocaine together are linked to half of all theft, burglary and robbery. This is a direct result of vulnerable consumers being exploited by criminals. If prescribed clean drugs then all the criminality driven by the need to find money every day would disappear. 2. We have clear evidence in support of policies which radically reduce heroin addiction and yet the strategy makes no mention of such policies. (Drug Wars by Neil Woods and Uchtenhagen research papers). The Government acknowledges that we have seen “disinvestment in adult treatment with an even greater reduction in funding for young people’s specialist substance misuse services” over the past ten years. The strategy aims to reverse those cuts and we welcome that commitment. However, even before the destruction of drug services, this Country had an appalling record of heroin addiction. The strategy, as it stands, will do little to improve that record. 3. How, then should the Government proceed? We need to look to our own history to find the answer. In contrast to the US and its puritanical, judgemental policy, the UK regarded addiction as a medical condition. Anyone who developed a heroin or cocaine habit would go to the doctor and receive a prescription for the drug in question. In numerical terms, the UK had no drug problem. From the 1920s to the 1960s our heroin consumers were numbered in hundreds. At the same time, the US with its judicial and punitive approach measured theirs in hundreds of thousands. The simple lesson is that if Government gives organised crime control of these commodities, they will ruthlessly market them and exploit the vulnerable to maximise their profits. This is what happened in the US in the 1920s and in the UK in the 1970s following the introduction of the Misuse of Drugs Act 1971, which had followed the UN Single Convention on Drugs of 1961, driven by the US. 4. When Britain gave up our medical system for responding to heroin addiction, under US pressure, this Country had 1,046 heroin consumers and the numbers were falling. Twenty years later we had hundreds of thousands. Since then Organised Crime has become more violent and more ruthless in their drug dealing. Now they have children at the shop front of the heroin market. This is a direct response to the police success in catching adult front line drug dealers. Police are good at this level of activity. 5. There was a brief revival of the British System in the Wirral and Widnes between 1982 and 1995. Dr John Marks used the still legal British prescribing system to protect problematic drug users in his clinics. As a result the dealers went away. Crime dropped 93% compared with other policing areas nearby. None of his patients died. His sex worker patients were rescued from exploitation. Interestingly, Marks and Spencer gave Dr Marks’ clinic £1000 with thanks for stopping the shoplifting! 6. Publicity about Dr Marks reached the US and the American Ambassador was outraged. Dr. Marks clinic was shut down and he emigrated to New Zealand. Deaths of heroin addicts returned to the Wirral. 7. The lesson from this history is, surely, that the first step in a heroin policy is to accept that heroin addiction is a medical problem and that patients should be prescribed safe heroin, thus protecting the patients and closing down the criminals’ trade. But, of course, more should be done.

If anyone can't believe someone of that age is capable of that type of crime. Two 12 year olds were found guilty of murder in Wolverhampton recently. The victim was 19 years old, they used a machete, stabbed in the back and came through his chest. Just saying.
