The channel is all about the 2nd Amendment, including the laws and history that have shaped the most controversial Amendment of the US Constitution. The goal of this channel is to present a largely unbiased view of this important amendment, focusing on the laws, rulings, and opinions that have shaped the Right to Bear Arms. My name is David and I have been a practicing attorney in Washington State for about 30 years. I love the Constitution - for all its good and bad - and love learning about it.
Constitutional Protections to non-U.S. Citizens
United States v. Verdugo-Urquidez (1990) addressed whether constitutional protections apply to non-U.S. citizens abroad. The Supreme Court ruled that the Fourth Amendment's protections against unreasonable searches and seizures do not extend to a foreign national whose property in Mexico was searched by U.S. agents, as constitutional rights are limited to "the people" with significant U.S. connections.

The MOST Important Second Amendment Cases | Top 5
Просмотров 23314 дней назад
So yeah, trying to put together the most important 2nd Amendment cases would be easy, right? Well I thought so. But it proved to be far more difficult than I had imagined and frankly, I would not blame anyone if my list is not the same as theirs. The first thing I did was review the top 15 second amendment cases - at list what I thought would be the top 15 cases. These included: District of Col...
Founding Fathers who Influenced the 2nd Amendment

The Second Amendment was shaped by James Madison, its primary author, who emphasized the importance of militias for security. George Mason advocated for individual rights and distrusted centralized authority, while Thomas Jefferson supported armed citizens as a defense against tyranny. Together, their ideas combined self-defense, state sovereignty, and liberty, forming a cornerstone of American...
English Influence on America's 2nd Amendment

America's Second Amendment is not totally unique or novel, but was largely shaped by the earlier English Bill of Rights. The American Second Amendment was very strongly influenced by English legal traditions, particularly the 1689 English Bill of Rights, which recognized the right of Protestants to bear arms for self-defense. This reflected fears of tyranny and the need for personal protection....

The interpretation of the Second Amendment of the U.S. Constitution has sparked enduring debate due to its concise yet ambiguous phrasing: “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” Key discussions revolve around whether the amendment protects an individual’s right to own firearms or primari...

The "Bruen" case, formally known as New York State Rifle & Pistol Association v. Bruen, centers on the constitutionality of New York's restrictive concealed carry laws. The Court emphasized that the right to bear arms for s...

Do Gun Buyback Programs Work?

A gun buyback program is a government or community initiative where individuals can voluntarily surrender firearms in exchange for money, gift cards, or other incentives. The aim is to reduce gun violence and the number of guns in circulation. These programs often provide anonymity to encourage participation and target unwanted or illegal firearms for safe disposal. But importantly, do they wor...
Supreme Court Upheld Sawed-off Shotgun Ban

United States v. Miller (1939) examined the scope of the Second Amendment. The Supreme Court ruled that the government could regulate firearms that didn't have a "reasonable relationship" to a "well-regulated militia." Jack Miller's possession of an unregistered sawed-off shotgun was deemed unconstitutional, as such a weapon wasn't typical for militia use, supporting federal regulation. Please ...

Yes - and there is a huge difference between non US citizens legally in the US and those in the US illegally.
Subject to the jurisdiction means who they're legally governed by and represented. Do they have to follow our laws? Yes. But they're not US constituents. Melania has nothing to do with illegals giving birth trying to be "anchored" by that baby. Trump is a citizen. That's all that is required. IE Obama
No criminals get protection from our constitution because they aren't united states of America citizens 8f your not born here legally hour not getting any constitution or constitutionally protected rights 😤 because you D.A. s are not are fucking "NOT"!!! LEGAL LAW ABIDING CITIZENS OF THE UNITED STATES OF AMERICA YOYR CRIMINALS AT LARGE INVADING OUR COUNTRY ILLEGALLY AND DOON WE'LL GIVE YOU DEFINITION DEMONCRATIC PARTY OF THIEVES AND LIARS AND TREASONOUS TRAITORS HOLD YOU 8DNT REALLY THE FACTS AND TRUTHS 💯 THEY ARE TREASONOUS TRAITORS ACTIONS AGAINST ALL UNITED STATES OF AMERICA CITIZENS AND THATS PUNISHABLE BY DEATH IF INDICTED AND PROSECUTED YOU GET HUNG 😂❤ FACTS AND THE TRUTH DON'T LIE POLITICIANS AND POLICE DO
U.S. Constitution ONLY refers to the USA president/VP as he, him, his, and that would cascade down for others. No caveats given otherwise. Even after women were given right to vote, it continues to refer to P/VP as he, him, his
What happens when we get a female president?
@@TheSecondAm Pick and choose from the constitution?
Foriegn Nationals are not the people, the people are American citizens,14th amendment section 1 states who a citizen is who the people are. Foriegn Nationals are not protected under the constitution of the united states of America whatsoever period.
What about the right to a jury trial, the right for a speedy trial or the right to representation? These rights are advised to everyone - citizen or non-citizen - in courts every day?
@TheSecondAm legally the constitution of the united states of America supreme law of the land applies to natural born and naturalized American citizens only, they are the people. Foriegn Nationals are not the people they are not American citizens, they are foriegn Nationals subjects of a foreign country/government.
@TheSecondAm they are illegally applied to foriegn nationals by corrupt Traitors.
ILLEGAL ALIENS DON'T have rights under the Constitution!
I get the intent. Was the intent to permanently remove a person's 2nd ammendment rights over a single minor lapse in judgment? I caught a misdemeanor dv over 10 years ago and took the recommendation of an attorney to plea no contest to a misdemeanor. No jail, 1 year probation, and some fines and fees. Nobody was threatened, and the full extent of injuries were a temporary reddened patch of skin on the other person's arms where i pushed past them while they were blocking me from leaving in a doorway. I didn't want to stick around and continue getting screamed at, and all i could think about was leaving. As i was getting into my car after making it through the doorway, cops boxed me in and said i should have called them instead of forcing past the person preventing me from leaving. Yep. Ill be a 2nd class citizen for life now. Im not a huge gun nut or anything, its just the principle of being punished for life over what amounts to a simple assault.
subject to the jurisdiction there of is also language against illegals/non citizens
Is it? Don’t non-citizens (but otherwise legal residents) have rights? Two of Trump’s wives were not citizens when they married him. Did they not have constitutional rights when they married him? Just wondering.
Illigals don't fall under the majority of the constitution. The only rights they have are the rights that protect criminals from being over punished. Illigals don't have the right to bare arms do to the fact they are here illegally which makes them criminals and inviolation of federal law . They don't have the right to protest ,they again aren't here legally so protesting not to be deported is again inviolation of federal law. As we see where they have been protesting . No citizen or any illigal is allowed to block roadways and commerce for means for emergency personnel to travel .that in itself is inviolation of congressional law to protect both the people and the protester.
Sounds pretty accurate
Crazy vague. Really you have no idea what you can be charged with. Our laws are getting unintelligible.
Great comment. And yes, the laws are clear as mud.
That old law enforcement saying that it’s better to be judged by twelve than carried by six comes to mind.
“Firearms are prohibited in all buildings, including visitor centers.” Bruh, NOBODY is checking inside a visitor center, I guarantee it, lol
Yup. There is no real enforcement at all.
Bear spray will not work on animals with rabies.
Text. History. Tradition.
There are no applicable laws in any state or park.
Sadly inconsistent rules and regulations. Bad laws making criminals out of the innocent and ignorant. 🤔🤪
Worry more about the two legged animals.
True
We’re from the government and we’re here to help. 😂
🤣
Which is worse, and why? 1) Unjust (False) DUI arrests that strip non-violent citizens of their gun rights and their right to home protection! 2) Paying income taxes when the IRS code doesn't define income! 3) Returning to common law and abolishing the UCC statutory revenue code!
Great comments!
don't ask..don't tell
take but don't use is the rule everywhere. I totaly support gun rights. There is no reason to use your gun in a NP. This is very misleading. people have shot animals in the Park claiming self defense and have had no repercussions or charges when it was found to be legitimate. People take advantage and lie to get to kill a bear or something is the problem. most commenters do not know what they are talking about here.
We were a people who had to be able to fight Indians at a moment's notice, so we were already well armed. When the British tried seizing our weapons so that we would be defenseless against their rule, well guess what happened when we won. The founders realized that even their new government might become tyrannical, and the people would need to be able to fight it in that case. It's as simple as that. The 2nd amendment has NOTHING to do with hunting, or sport shooting, but EVERYTHING to do with being able to go toe to toe against the government if it oversteps it's boundaries. It's why there should be zero boundaries on what types of weapons Americans can own, from fully automatic to grenades and artillery pieces and tanks.
English Influence on America's 2nd Amendment Yes a Bill of Rights is not new but the greatest influence on the creation of the 2nd Amendment was April 19, 1775 government gun confiscation so that it never happens again.
always carry bear spray in .45.
Unfortunately, firearm ownership in the UK is a privilege, not a right.
Yup. Similar to Canada, Australia etc.
Who let that happen to your countries
@tklube308 The English Constitution is not a single document like the US Constitution. It's a collection of rights, privileges, laws and traditions that have accumulated over the centuries. The US Constitution is a list of things that the federal government can and cannot do. The English Constitution is not.
We need a militia that works well , in language of the time Well Regulated .( not government controlled like it means now ). Therefore the PEOPLE have the right to bear arms , not the national guard ! Unless you think only National Guard members are the only one Protected by the 4th amendment from unreasonable searches and seizures .
Last time I talked w a ranger they said its ok to shoot as long as you are 150 yards squared from any trail, waterway or building and target needs to be on a backdrop. Im in CO and i often hear people practice in White River natl forest. I have a free open range thankfully so I only take my rifle when camping and my ccw for normal hiking. I dunno other states but CO is an open carry place
Thanks for the comment - really helpful.
You can carry them but only use them in cases where your life or someone else's is in danger, the burden of proof would be on you to prove that you had no other choice to use the firearm to stop an imminent threat to life or limb and if you really are threatened then it is worth using a firearm even if you get into legal trouble because of it which is unlikely if you really were in danger. We do have a right to life which includes a right to protect human life, if you were prosecuted for discharging a weapon inside park property but you could prove that it was a reasonable and necessary measure to take to protect human life it might be a long court battle but you would likely win.
Agreed!
👍👏🇺🇲
Thank you very much.
If Congress can make no law, what makes bureaucrats think they can? And why would state or local laws matter? You're not in the state, does federal government pay state & local property taxes?
People seems to forget that constitution is just a piece of paper written by men. When someone gives you a right that someone can strip that right away. Everything has the right to defend it's life wether be an animal or any person no matter it's status, or circumstances. Defend your self that is the keyword 😊
Perfect answer.
See the powers of Congress description of a "militia". The 2nd Amendment does not specifically say firearms it sayd arms.
WHO WAS THE MILITIA: EVERY individual with *HIS OWN PERSONAL PRIVATE ARM ''''''OWNED BY THAT INDIVIDUAL.''''*
Shall not be infringed
No interpretation, Read it the way it was written.
When you’re attacked at a national park by a two legged or four legged creature, remember to tell them that you’re armed, but you’re not allowed to shoot😂.
Dang , I was hoping to be 2nd view and 2nd comment for this 2nd wording vid on the 2nd Amm Channel. The 1st is for talkers🗣✒️, not Plinkers!
Never forget, Park Rangers are warped people who wanted to be real cops for all the wrong reasons, and they view you as the enemy.
This is really a very good RUclips channel. There should be LOTS more subscribers. Considering that there are millions of subscribers to some of the big GunTuber channels, this channel offers excellent content that those viewers would find useful, seems to me.
I am so sorry that I didn't see your comment earlier. Thank you so much for the lovely comments and the time you spent posting it. Obviously I am just starting out here and we'll see how it goes, but I really appreciate your words. Thank you.
I just don't go where I can't carry i don't think local laws work in national parks just there buildings and even if you kill one in self defense im sure you're going to be treated like a mass murderer so i don't get out of the car in national parks i like back road and places i never knew existed
This is stupid shit. I have a gun in a national park but can't take it into a facility? I guess I'll give it to the kid playing outside and he can hold it for me.
The right to bear arms is unlimited and the Lautenberg Amendment is unconstitutional.
US v. Miller was a joke. It was a default judgement. No one was there to argue against the NFA.
The federal government is irresponsible with drug cartels in National Parks and crime is increasing dramatically. So representatives are doing a substandard job protecting citizens visiting National Parks. Again failure for the republic.
I’m NEVER Gonna use my firearm! It ruins your day, possibly even your life. BUT! I do want to survive. About twenty five years ago my wife and I were hiking a trail in a not so distant park in PA. Beautiful!!!! Within a month we heard news of an attack by a deranged man who killed the husband and you can imagine the rest. I never not take my two friends now.
George Mason, was the man responsible for the BILL OF RIGHTS. He refused to sign the Constitution until a BILL OF RIGHTS was included. Why is this relevant to the 2A? George Mason was educated in Classical Latin. The phrase "to keep and bear" is the English translation of the irregular Latin verb, Fero Ferre Tuli Latum. Also, the phrase "Well Regulated" is a watchmaker's and gunsmith's definition of an accurate clock and a functioning firearm. Back in the prehistoric old days, firearms used black powder and there were no standards of what size bullets were and how much powder was required to propel the bullet. Therefore a complicated process called "regulating" was used to find the proper charge of powder to propel with sufficient velocity and accuracy a bullet from a specific firearm. Today we perform the same function of "regulating" by sighting in our firearms for a defined range. Therefore, "A well-regulated Militia" has firearms that function properly and are sighted in for a defined range. Yes, it is true that a "well-regulated militia" has a book of regulations to govern its function. But a "well-regulated militia" is useless without "well-regulated" firearms. Also, there are many specific instances in both the Old Testament and New Testament that command that we defend our lives and families with deadly force should the need arise. The guard asleep in the Watch Tower was executed. And in Lucke 22:36 Jesus says, "If you have a purse buy a sword. If you do not have a purse but you have a cloak, sell the cloak and buy a sword". And in the Garden of Gethsemane, Simon Peter took out his sword and cut off the guard's ear. Judas Iscariot was a member of the Sicarii (assassins, they carried a short and curved knife, Sicari) and since Judas was a skilled fighter and was armed, he carried the money the Disciples had.
“I hold that a little rebellion now and then is a good thing, and as necessary in the political world as storms in the physical. Unsuccessful rebellions indeed generally establish the encroachments on the rights of the people which have produced them. An observation of this truth should render honest republican governors so mild in their punishment of rebellions, as not to discourage them too much. It is a medicine necessary for the sound health of government.” - Thomas Jefferson in a letter to James Madison, Jan 30, 1787.
As I understand this guy, he is NOT properly looking at Madison, and there is no cited evidence of the 'balancing test" between rights and public safety. This balancing test has also been rejected by the SCOTUS. “Let a regular army, fully equal to the resources of the country, be formed . . . of twenty-five or thirty thousand men. To these would be opposed a militia amounting to near a half a million citizens with arms in their hands.”-James Madison, Federalist Paper No. 46
That last quote you give has the opposite meaning of what the "pundits" say. The right of the people, according to Madison, had been infringed.
Depends on the who the pundit is…
Turns out, it didn't deter tyranny at all. Ask the South.
Not our ancestors’ fault. That war was a testament to the abject cowardice of Yankees’ ancestors for not hauling Lincoln to the gallows for his crimes against THEM.
