Hello can I make edits in my personal statement after submission?
Greetings! You can provide additional evidence, including an updated asylum statement, 7-10 days prior to your asylum interview. You can even provide additional evidence after your interview up until a decision is made on your case (although it is recommended that all evidence be submitted prior to the interview). If the asylum case is defensive in nature (i.e. immigration court), then you can provide additional evidence, including an updated statement, up to either 15 or 30 days (depending on the judge) prior to your individual hearing.
Thank you @immicounsel , my interview is in Jan 2025 but I want to make edits in my personal statement like I want add more information. Now my question is how do I submit it . Should I go with the edited statement on my interview or i should submit it online??
@@AwaliMigadde I would send your updated asylum statement to the Asylum Office via FedEx and facsimile, if you have their number. Attorneys can also email documents to the Asylum Office, but it is my understanding that that is not an option available to pro se applicants (individuals who are not represented). Yes, assets such as vehicles (i.e. not the primary car), real estate (i.e. the equity), etc. can be used to meet the financial sponsorship threshold.

No, once an asylum case has been denied by an immigration judge, the respondent has 30 days within which to file a notice of appeal with the BIA.

If yes what proof of assets am i supposed to send with i864? Does he need to fill out i864A as he is the principal immigrant. I’m us citizen
You are welcome! If your husband does not have a valid Employment Authorization Document, then neither his income nor his assets can be used to offset the difference between your income and the required $25,550, which in this case is $30,650 ($10,550 x 3).
@@immicounsel I got you. This question in the i864 form gets me confused: “What is your current individual annual income?” Are they referring to the income listed on line 9 tax return 2023 or the income I’m expecting to get at the end of this year 2024?
@@COGOPSTT The current individual annual income on Form I-864 is the amount of income a sponsor expects to earn in the calendar year the affidavit of support is filed, so at the end of 2024 if you are filing the form this year.

Hello and thanks for the video. USCIS kicked back the I-864 for my immigrant wife with a RFE based on my income. Even though my social security income in considerably above the 125% poverty level it is not reflected as Total Income on the 1040. I don't have a joint sponsor so I need to go the Assets route. Do you think it's possible to get this approved based on a zero 1040 income level and solely using assets (I own my home and have an IRA)?
It is technically/legally possible to get your I-864 approved based solely on your assets. That being said, sometimes USCIS does (erroneously) push back. As such, a joint-sponsor is a good insurance policy.

Are you saying in my case it's best not to go with assets for the full income amount but rather find a joint sponsor OR are you saying go with the assets first and if application gets rejected find a joint sponsor to re-apply with? @@chuckallen9012 Since USCIS has already kicked back the I-864 once, I would err on the side of caution and get a joint-sponsor now.

Hello, I'm the petitioner and sponsor. I started working September of 2023 so I have not worked a full year hence why in my taxes it wont show sufficent income. With what I get paid I would make 24k in a year. Can I use an employee letter to show that I would make this in the future. Its the future that counts right? Not the past
A letter from your employer (indicating your start date, position, hours/week, pay/hour or salary), along with your paystubs for the last 6 months, may prove sufficient. As added insurance, I would consider obtaining a joint-sponsor to help cross the required financial threshold.

My wife is trying to bring her mom to the USA, we don’t work for anyone we own a business well since 2021, 2022 ,2023 he name was on our company however in 2023 we decided to bring a partner into the business and I had to take her name out so now she is a joint on my tax return but with no income. But we have enough assets and enough income on our tax return but it’s only my income so that mean she will be a non employed then use me with i864A with my income and if the income is not enough then we use the assets ? Or should I just be the only sponser and don’t make her fill any 1864 at all ?
Your will need to complete an I-864 no matter what, and she will have to provide her federal tax returns (preferably tax transcripts) as supporting documents. Since she will be showing no income, she can use you, a household member, by way of I-864A. If you show enough income, there should not be any need for inclusion of assets. You may not include the value of your automobile, unless you can show that you have more than one and the primary automobile is not included as an asset.
Hi! Can you please asess us if we are good to go or not. My husband's annual income for 2023 is $25,000 and a total household of 2. And he added 10k for his savings bank account, do we need to get a co-sponsor or no? Thank you in advance atty. ☺️
The 2024 federal poverty guidelines for a household of 2 is $20,440. 125% of $20,440 is $25,550. $25,550 minus $25,000 is $550. $550 times three is $1,650. $10,000 is well above $1,650. Therefore, under the regulations, his income of $25,000 plus $10,000 savings SHOULD be sufficient. That being said, the government can, and often does, push back and demand more convincing evidence of financial sponsorship. Therefore, I would suggest getting a joint sponsor; just to be on the safe side. Good luck! Note: This does not constitute legal advice. This response has been posted for informational purposes only.
My visa category is IR-1. Regarding the affidavit of support, my wife's income was $48,XXX for 2022 and $68,XXX for 2023. She lives in Illinois, and our household includes three family members, plus my wife and me, making a total of five members. Your wife's 2023 income is sufficient for a family of 5 to sponsor you; no joint-sponsor needed.

Can u please help me understand if i qualify to get my spouse here. I have a total of 6 dependents which comes out to about 52,000. Last year i only made 25,000. How do i calculate the 125%. I have assets to off set it.. $145,000 paid house, 47000 in savings. Please help me understand how to calculate if i qualify. And if needed inhave a classic antique car worth about 65,000 if need but hope i can just qualify with my home, savings and income....please respond thx so much. Btw, if i need to use the car to add to the asset how does that work? Do i just submit title and pictures or what?

I have another question? I rather call u but will wait for ur response here to do so. I just received email stating they will contact with an interview date. But in one of the documents that all has been approved states a note at the bottom that my income doesn't meet the requirements and that I will need a sponsor...and then said I need show proof of assets. Or is this protocol? I submitted assets to the nvc as some of the documents that showed I could upload. so are they requesting I submit it again with an explanation I'm using my assets to supplement the income to help them understand Im using assets cause I dont have any sponsor? I'm confused. Also, we filed in 2023 does the poverty guidelines for that year get used or do they now use the 2024 guidelines which has even went up higher from what we spoke about before. Thank you for this very informative video. In order to show assets on the i-864 form do i just show 12 month bank statements and send those in with the form? I dont need to fill out any other forms do I?
A letter from your bank showing your current balance would also be helpful; no other forms need to be completed.

I have queastion to you . I didn't receive my green card because of the postal service stole my green card . I filed for i-90. My question is how long will it take for my new green card to arrive in the mail and uscis will ask me to submit fingerprints and photos? Will Dv1 visa holders (i-551) go to fingerprint and appointment?
Current processing times for Form I-90 are 27 months. We do not handle DV visa matters, thus I cannot provide any insight.

I submitted my written appeal which stated as a member of a political organization and no physical harm but only a warning from authorities issued to me that was what I also told them during my interview. In fact, I was physically harmed several times, it was just I was afraid to tell the truth because authorities threatened me before they let me go right after receiving bribe from my family. If the petitioner (US citizen) doesn’t have any income (due to disability from injury) but the intending immigrants makes over $90k a year from lawful source using valid EAD, of which the employment will continue after the green card is obtained, would it be ok not to have joint sponsor or include assets on I-864? (for household of 2)
In this instance, a joint-sponsor will not be needed.

I am the petitioner. I made about 75k last year. I have a 401k and a Roth IRA. My problem is that i dont have much in my checking or savings. I probably have about 3k for both accounts. Would this be a problem or beings i met the poverty guidelines, it would be ok to still get approved ?😊

Pls i have gone for my interview and was asked to get a joint sponsor, but my wife income for 2022 that was required was $25485 which is above $16000 that was required why do i still need a sponsor?

You could have been asked to provide a joint sponsor for a number of reasons, depending on your household number, the poverty guideline for your household number and the dollar amount that corresponds to 125% of your poverty guideline. I was 5 years old that time and witnessed the pogrom and burning human body and narrowly escape of my father by mob , my reduced to ashes house,, etc through necked eyes . My life never remained the same afterwards, I oftenly wakes up abruptly at night with scream mar dunga kaat dunga even today . This is the state of affairs with me and have been living with this trouma till now . No justice after 39 years meated out to us having lost everything which we had in that pogrom. Now the same synario being building up in India by hindu rastr supporter , as we recently witnessed what happened in manipur, mewaat. This is not a few incidents but couples of untoward incidents that is happening through out India.we once again witnessing the same synario in different way I am scared and apprehensive about my only child future now here in India. I don't want to let my only son subject to all those pain ,agony , loss of future if my apprehension becomes true. I have all the documentation regarding 84 massacre victims like FIR and doctors report of my medical treatment and medication caused by this incident . Name in govt records as victims. This facts telling is to make you understand the my case . Now point is that can I be eligible to seek asylum in canda on the basis of this true happening. Is my case stands chance to get asylum. Only the 12-month average balance in your saving and/or checking account can be included.
hello great video i just wanted to ask something real fast. the sponsors income of 2022 does it only apply to the poverty guidelines of 2022. Like in 2023 the poverty guidelines has gone up but my income for 2022 only barley covers the poverty requirements for 2022. Do they look at the poverty guideline that match the same year as you tax return or do they go by the most recent (2023) poverty guideline.
It is best to answer your question by way of an example: The 2023 Poverty Guidelines would apply to your total income in 2023 (as proven by way of paystubs, assets, etc.), and the 2022 Federal Tax Return would be required (while the 2021 and 2020 Federal Tax Returns would be optional).
