Dear Sir, An unregistered agreement was made between the seller and buyer with a reputed agent as witnesses. Advance amount was also paid and added in the agreement (unregistered). Within few days,the buyer is unhappy with the property and wants to quit. That is ,he is not willing to buy and is seeking for refund of the advance amount. But the seller is refusing to pay back refund amount ,citing the reason that he has spent the money in improving the(his) property. Does the buyer has legal rights to claim the refund? Isn't illegal for the seller to with-hold the advance money from buyer even after buyer expresess his disinterest and wants the money back ? Thanks in advance.
