HOA finally responds to my cease-trespass request.... by trespassing again

This is really simple **** just stay off people's property when they ask, otherwise yes you'll end up on my YT channel for the world to see 🤷‍♂️ Asking someone to stop trespassing repeatedly over 4+ years does not make a Karen, but going around YT throwing shade for no reason absolutely does 🙃

HOA board member trespassed and placed an illegal sign. I don't want trouble with the city so I remove the first sign.     U didn't come off aggressive or bad. U went to notify in a polite manner the issues with the dam signs. I'm sure there is more to it than what's on the video. U went to inform ur neighbor. Wrong thing u did was not walk away once u said ur peace. Cuz then they would have had to do there actual homework to see what u said was true. Next time throw the signs away. It's on ur dam property n u do with it what u will. They will get the hint any sign put on ur property gets thrown away so don't bother.

    After reading a more detailed account of the situation I can understand your standing up to protect what is yours. Just want to throw out there from an outsiders perspective you come off as aggressive and as a meddler. I’m not saying you for sure are. It it appears that way. It reflects poorly on you the way you spoke to those people in the first video and it’s reflected in contrast by her response and tone with you. The husband was posturing for sure though. I can see both sides but one things I’ve learned as an angry man myself is the angrier I get the less valid my point becomes no matter the facts. Your efforts would go over twice as smooth and be more effective if you said all the same words with a calm and friendly cadence and based every move you made out of a respectful place. From what I can see this is likely what they are doing. They are doing things without any regard to you but when it comes to person to person interaction that woman spoke calmly, apologized and spoke to you with a respectful tone. It was likely all BS but she followed the rules of societal engagement and right out the gate it made you appear to be the one at fault because you were excited and aggressive. These are all of course just opinions from an angry and excitable guy myself so I want you to know that the reason I even wrote this up was with positive intentions. Merely just a guy wanting another guy to succeed in his efforts. Fight the good fight brother!

      He did have a bit assertiveness in his voice, but I wouldn’t call it aggressive. I don’t believe she handled herself well in the first video either. After she is informed that she can’t put a sign there and he gave plenty of legal examples why, she immediately challenged it, but paused after she realizes it’s his property. Then she tries to argue from a position of power by saying she’s a HOA board member, and deflects responsibility by claiming she asked someone else and they said it was fine. After she had interrupted him, she then demands that she not be interrupted. She made the mistake, but tries to dictate how the property owner should handle it, by saying he should have come to her. If it’s his property, he gets to decide how to handle it. He’s right….she shouldn’t lecture him at all.

      Seems more indifference and ego; the management company is on auto pilot and the board members are taking it personal even though they didn't respond to my initial requests or address my concerns for years. And IDK what the landscaper's deal is; I get the impression he's buddies with the HOA pres. but I could be wrong. My interaction with the other HOA person about the sign really rubbed me the wrong way so letting the weeds grow was me saying 'if you're so confident this is your property, then come take care of it' but they never did. I would have been way more receptive to these guys coming and knocking on my door or emailing me back but instead they chose to walk through my back yard unannounced as a power play, and I'm not trying to feel like that in my own home.

      @@brodie7838 Did you put up no trespass signage? Yeah anyway if you are in a management structure, its more about conforming imo, I think these orgs just want to have no disturbance or changes other than things they resolve. Its not really about you or what you want, its about what the board resolves to implement and you get turned into a problem person. If you know your rights its about having structures to act to protect your rights. Complaining is just seen as nagging and insurrection.

      ​@@brodie7838 the big thing to keep in mind is that some organizations will have an upkeep requirement that can extend into property standards enforcement like municipal bylaws so if you fail to do something then there is a color of right for them to act to maintain that thing. It could be lawn care, or it could be some other resolution. Unless you know the limits of that color of right you may actually find inspection or other considerations for entry may not be absent of a color of right, simply because you may not know the bound of the corporate bylaws of the organization. I would look at the policies and see if there is any lawful authority extended to your property by their constititon or bylaws as you may be suprised your land ownership may in fact have a bunch of unknown color of right associated with it, entry onto the oproperty for official acts may be one of them, and that entry may not be via the area you want but rather what is most expedient of convient for the authority.. but you must first establish the limits of color of right then you can attempt to remove those easements you may not have even been aware of.

      Sure! So about 4 or so years ago the HOA hired a new landscaper, who handles all HOA land throughout the neighborhood. From the get-go I had issues with them parking right in front of the driveway, walking and driving equipment across my front lawn, through the back lawn to get to their property, etc. I asked the HOA each time that they stop. Then two summers ago I came outside and there were like 10 dudes just walking around the lawn doing whatever! Turns out their landscaper was trimming the HOA's hedges from my side of the fence. They trampled our sunflower garden, broke a fence, and left a mess everywhere. My next letter to the HOA threatened legal action and suddenly they were interested in talking. I didn't agree that they needed access to my side of the fence but did agree they and the landscaper could come over as long as they asked permission first each time. The landscaper failed to follow through the next time, so we went back to step 1. I then asked them to also sign a liability waiver (recommended by insurance and lawyer), and never heard back from them or the HOA. This summer rolls around and one of the board members put a moving sale sign in a different part of my yard because it's on the corner by the road. I didn't know she was HOA, not that it mattered, and removed the sign so she had her husband put up another one further into my yard with a note that she's on the HOA board and I'm not allowed to remove it. I remove it anyways (lol) and email the board again telling them to stay off the property. They respond saying it's their property, then go radio silent and won't respond to me at all, even requesting to attend board meetings to discuss this. So I stopped mowing "their" property to see if they'd come take care of it, but nope. And then the HOA president showed up with the landscaper in tow as seen in this video. I wish I had kept recording for the rest of the conversation, woulda been a better video. Oh and they've been sending me letters saying they're going to fine me if I don't "let" them trim the hedges that are on their side of the fence, and telling me I have to mediate all disputes without an attorney (lol x2).

      Wow. That's a lot and a mess my friend! So sorry they are being so ugly about everything. So i assume from your response that you aren't actually part of this neighborhood, nor their HOA? Is your property just on the other side of the boundary then? Interesting how they refuse to verify the exact property lines when they are so sure it's "their" property. Interesting they won't mow "their" property either lol! So very sorry you had so much damage to your yard. Sounds like you're doing the right thing! Great idea to video document all interactions too btw.

      @@shaileechristensen8543 I'm in the neighborhood and part of the the membership and stuff, they just have an easement for their monument sign and have hedges and a fence that are on 'their' side even though technically it's all part of my property. Prior to the landscape company changing, they never had to come over here and they did their thing and I did mine.

In any case what would you do if someone in your neighborhood suddenly claimed half your property was theirs and told you you're not allowed to use your own lawn? Or threatened to fine you because someone else's bushes were unkempt? That's what the HOA is doing to me.
