    If you choose not to have a deposit as a landlord is that ok? Also if the tenancy agreement doesn't mention a deposit is that also fine? If you need to serve a section 21?

    Excellent video. I fully recommend the factual advice. There’s lots of experts that state not to ventilate when “damp” outside which is not founded on science as its total moisture content of the air that matters and in winter this is 2 to 3 times drier in the UK than summer air. Everything is relative!

    This is a word of warnings about universal credit because I was told to claim cares allowance for my son i was successful to get they take the amount you receive of your universal.credit that is wrong my money from universal credits has dropped down to 25 a week this is out rages I am so angry how can you live on that you just cant if you ask them to pay your rent straight to the land lord its stops your payments going into the bank you end up having to chase your payment this govement need to stop mean testing the worse of and start mean testing the rich in my opion they should i am absolutely furious

    Three years the landlords brought the same “ so called Gas Engineer in “ our 17 year old daughter battling cancer was rushed to hospital with carbon monoxide poisoning but the landlords keep saying they acted in good faith

      @@NatLandlordsAssoc Because Landlords, particularly those who are trying to supplement their pension are forcing the cost of housing up. Landlords, are not particularly clever or risk averse people. Therefore instead of investing in socially productive investments such as pretty much any publicly traded company, creating their own business (Contrary to popular LL belief having 1 or 2 houses is certainly not a business), they buy up houses and lease them out to those whom they have priced out of the market. The mainstream media and politicians don't help with their endless housing shortage mantra either, the reality is there is no shortage of housing it is just in the wrong hands. I for one am very glad to see things like S24 being brought in, and whilst i am certainly no labour supporter, a short stint of them in power would certainly wipe out most of the PRS which will be beneficial to everyone, apart from the landlords of course. Perhaps they will finally be forced to invest in actual productive enterprises like the entrepreneurs they generally claim to be, but certainly are not. As a caveat to this, i have exactly zero problems with completely unleveraged and wealthy landlords, because they are generally a minority and certainly wouldn't have distorted the market anything like the introduction of ASTs and BTL has over the last 20-30 years

      Hi Tom, thanks for sharing your thoughts. Have you seen our previous videos and papers, the Hustle for Homes and The Renting Business? The former discusses the competition for housing and the causes of the housing shortage, while the latter outlines the ‘hidden’ costs that landlords face and includes the views of PricedOut. Both of these are available on our website at landlords.org.uk/news-campaigns/campaigns. However, to your point of investing in socially productive investments, the private rented sector is currently propping up social housing by providing homes to those who would be better off in social housing but are unable to access it because there are too few houses available. Landlords also contribute approximately £3.84bn in income and corporation tax, enough to fund 760,000 hip replacement surgeries. If the PRS were to be significantly reduced, that would remove housing options for those who value the flexibility the PRS affords, as well as for those who aren’t ready, able, or don't want to buy.

      @@NatLandlordsAssoc I am currently watching your video, firstly, Landlords do not tend to buy larger properties, the vast bulk of properties purchased by Landlords are 1 and 2 bedroom homes as that is where the market is largest. Secondly, you state that the cost of housing has gone up but wages haven't, so what exactly do you think has driven that housing cost up then? Well, i can tell you now that it is lending going into BTL mortgages which have been based on yield (and ridiculous yields at that too circa ~2% hoping purely on cap growth which is the literal definition of a speculative investment as a house does not produce money) NOT what the average person in that area can afford. This in turns forces pricing up, and as housing is priced on the margins this in turn lifts the whole market. I mean, if you want proof of this you can see it round Dorset, particularly the smaller towns and places like Bournemouth where there is now 2,000 houses for sale within 3 miles of the town centre, almost all of these are chain-less therefore likely ex BTL properties. With no LL to buy them up the prices are being reduced daily and have a long way to go down yet. Fortunately this will sting LL badly. If the LL demographic is reduced to 1-2% of the total housing market the cost of housing will be cheap enough that the 99% of those that currently live in rented accommodation would likely be able to afford said housing. and with that number of rental properties there is certainly enough to support those that want to rent indefinitely, which i assure you is a very small number. (Remember that houses, contrary to belief, do not disappear when they are sold, therefore, 1 house sold = 1 less renter and it tends to be the higher earners that leave the rental pool therefore this drives rents down) As to how much tax LL pay, that's just being taken from peoples rent, which in turn is taken from people who actually work for their money. IF LL ceased to exist tomorrow, and the housing market reset properly i suspect the tax take from owner occupiers through decoration, furniture etc etc would far exceed that 3.8billion figure. And i suspect the government sees this too. Even if they don't house owners vote tory, renters vote labour. it's only a matter of time till S21 is gone and LL get alot more taxation thrown at them, they are a tiny voting block, and the vast majority of the public think they are leaches on society, and to be fair, they're not wrong

      Hi Tom, please could you direct me to the source of the statistics you cite? They differ from any we’ve seen. There are a number of factors driving up the cost of housing in all tenures, such as first-time buyers’ inability to access finance or provide a deposit, and many issues which contribute to this, including wage levels and tighter lending criteria following the 2008 Global Financial Crisis. We discuss this and the other factors in full in the Hustle for Homes paper. We also explore the issues around the cost of renting in our discussion paper, The Renting Business. As you will see, one of the recommendations we make in that paper is that the Government should encourage more housebuilding across all tenures. Successive governments have failed to meet our housebuilding needs, which has compounded the high cost of housing as demand continues rising.

    I was very disappointed to see that the old form, where we were able to complete form online and generate PDF's were removed in the first instance. The term GDPR was used as a reason for this. Whilst the storage of personal information falls under this category the production process to generate PDF's with personal data can still be provided using a secure service. The fillable PDFs are tedious and have limited scope when adding additional clauses. Please look to tackling this issue.

    Also did I correctly hear the executive from Urban say that in a scenario where a tenant didn't give consent for their details to be passed on, it could result in the roof not being fixed?! And the guy from the NLA didn't contradict it?!

    I have to agree, this is totally misleading. Consent is not the basis on which landlords should hold their tenants' data. As Jake quite rightly says, it would be a nonsense, as tenants could then withdraw their consent halfway through a tenancy. The video should be withdrawn. In fairness, the Q&A below this video on Urban's site does seem to better understand the situation and has some useful info. But this video is plain wrong.

    I rarely comment on webinars but this webinar was terribly incorrect & chronically misleading, one of the worst. There are 6 legal basis to rely upon when processing personal data not just consent! As a landlord you would not rely upon consent to holding your tenants data or before they sign a contract, consent must be freely given so that it can be freely taken away, if a tenant then withdraws their consent to pay the landlord what then?? Consent to pass details onto a plumber in an emergency? What?? NO...it’s necessary for contract or even a legal obligation!! There is a ton of other stuff which needs to be done to make you compliant which wasn’t even mentioned, & what is ICO membership? You are giving incorrect advice which will make landlords uncompliant not compliant, creating unnecessary work, which will confuse tenants & businesses. Please get correct advice before it’s too late!! We would advise removing this webinar asap as it is very misleading, legally inaccurate and very wrong.

    Please please do not listen to the advise in this webinar, it is substantially wrong on many levels and will cause you a whole heap of problems. Consent is NOT the legal basis for processing a tenants personal data for the purpose of the tenancy, you don't need the consent of the tenant to pass details to a plumber to carry out necessary repairs, the ICO is NOT a membership organisation for which you pay a fee to become a member, there is a current legal obligation for controllers to notify the ICO of their processing activities and pay a fee, this WILL NO LONGER be a requirement under the GDPR but instead you may (depending on circumstances) have to pay a fee under a different new law (not the GDPR), you do NOT need to notify all data breaches to the ICO, to just name a few one of the many wrongs in the webinar. I am a practising data protection lawyer who works closely with large national and international corporations including a very large chain of estate agents.

    This was good. If it covered more detail, it would be too long and not watched. All familiar staff at a general level, but the devil is in the detail. And in turning general knowledge into specific *action*, to look after our tenants.

    Last year I wrote a blog on the importance of social media when referencing tenants privatelandlorddirectory.com/2013/09/google-and-social-media-helping-landlords/ In light of the recent European Court ruling allowing individuals to remove results relating to them from search engines ,the so called ' right to be forgotten' From now on remember to use Google .com rather than Google. .co. uk just in case your potential tenants have decided to erase their past, this way you will still get a full un edited version of the results.

    We were told by previous landlords the day after our tenants moved in that we had the tenants from hell who you never pay us any rent. If had their contact details on the LandRegistry listing for the property we could have contacted them when referencing. We used solicitors that one of previous landlords had used. Had to keep calm, remain polite and accept it would take us over 12 months to get them out. Had luckily asked them to sign letters giving us authority to contact the housing authority should they claim benefits and upset them by getting housing benefit paid directly to us. It kept starting and stopping. They were eventually prosecuted for gaining a tenancy using forged evidence. 13 months to get them out and a month to redecorate. New tenants had to deal with their mail and numerous bailiffs.

    Also what landlords need to realise is that its far better dealing direct with your tenants ,tenants actively seek out private lets to save hundreds of pounds in agency fees .over 50% of the tenancies within the UK are private lets ,and although the advice above is well also use the two G's Gut feeling and Google you can find a lot about a prospective tenant this way as you can through social media such as Facebook. Remember tenants are looking for private landlords ,private landlord is the most searched for term on Google within this sector .landlords can advertise free on the only dedicated property site in the UK privatelandlorddirectory.com

    First time buyers support the Capital Gains Tax increase. Remember it was property speculators who helped create this economic mess, its only right they should pay some of the costs. Remember it is these speculators that have priced local people out of their homes in the country side, on the coast with second homes. They are killing communties.

    @NatLandlordsAssoc Of course I'm suggesting that because a landlord buys a flat that action deprives someone else of owning it. How could it be otherwise? Many landlords make a loss on their rental in the hope that their asset will gain. You seem to argue that this isn't the case - it is you who is deluded. My point remains: we shall see who is right when the HPC begins. And this CGT raise will help it along. Now enough, I run a real business that contributes to the economy and I must crack on.

    I look forward to 'landlords' who have built their empires on the most shaky of foundations (ie: making a loss from the rent but hope the houses will raise in price) losing enormous amounts of money as hundreds of like-minded parasites off load their houses in a mass fire sale. You have contributed nothing to the UK economy and have leeched off it for far too long.

    It's right and proper that you should pay capital gains tax at 50% (I genuinely hope Cameron goes to this level), as I - along with millions of others in Britain - strongly believe that buy-to-let landlords have caused the enormous spike in house price inflation that has priced millions of people out of home ownership and subjected them to renting.
