    Hi I’m out of status right now with 84 days of restoration period left. My work permit was expired in may and I applied for extension and now I got rejection for extension of my wp extension. My employer has applied for LMIA it’s in from already 4 months, my question is what should I do now should I apply for visitor visa or I should wait. If I am applying visitor visa now when I will get my lmia approved I have to do the flagpole to change my status from visitor to worker. Please suggest what are the possibilities.

      @@RupinderBrar__ I really wish there is a definitive answer to that Rupinder. But depends a lot on the case, history, circumstances and whether or not you are applying for a study/work permit along with the trp or not. Unlike a standard visitor/work permit, there is no standard approach to applying for a TRP, your situation, background etc depends on how the case is prepared and hence the chances depend on that.

      Education is not a back door, but rather Canadian credentials combined with Canadian work experience can significantly enhance an individual’s chances for immigration. However, it’s crucial that these are complemented by foreign education credentials, foreign work experience in a skilled occupation, and an above-average language score. Post-COVID, due to global lockdowns, Canada expedited pathways to permanent residency for workers already in the country and recent graduates from Canadian colleges. This created a false sense of hope and led to a misconception that PR is easily attainable. To stimulate the economy, Canada also admitted a record number of international students. As an education and immigration professional, I’ve observed that refusal rates were at an all-time low over the past two years, resulting in a large influx of highly educated individuals hoping that studying in Canada, followed by a work permit, would seamlessly lead to PR. While many applicants state they are bona fide students who intend to leave Canada after studies, the reality is that a majority aim to secure PR. Not enough foresight was applied by many, and now, with this large cohort of students present, competition for available PR slots has intensified, prompting recent policy changes. I anticipate further changes in CRS scoring within the Express Entry system, possibly considering factors such as salary, occupation, and educational field, alongside where individuals are working or studying. Country-wise caps on various programs might also be introduced. Granted that Canadian education does bolster points and improve PR prospects, but using it solely as a means to obtain PR without focusing on educational and career opportunities could and is already leading to adverse outcomes for many individuals. I’ve long advocated that those considering studying in Canada should thoroughly understand the immigration system and assess where they stand upon completing their education here. Unfortunately, many only look as far as obtaining a study permit approval, and by the time reality sets in, it’s often too late. The chickens are indeed coming home to roost now and many are still not prepared. I mean well for everyone but the fact is, given the available pool of candidates in Canada on Study and Work Permits, not to mention abroad too, the probability to gain PR has definitely come down dramatically and one has to carefully plan their next steps and not look for shortcuts or it’s a really bad spiral down.

      You’re absolutely right. No one is guaranteed PR, not even a PGWP. Applicants bear the responsibility to stay ahead of immigration requirements by honing their skills, securing employment, improving language proficiency, and advancing their education credentials. For too long, the dream has been oversimplified as a two-year study, followed by a three-year work permit or PNP pathway, leading many to rely on unrealistic expectations sold by agents. The reality is that higher education, like a technology diploma or bachelor’s degree post Grade XII, offers significantly more PR points. I’ve always emphasized this to my clients. Some heeded this advice, while others didn’t. Now, we’re seeing the consequences unfold. That’s exactly what I discussed in the video

    I’m eligible for OINP employer job offer international graduate stream right now. I will complete one year Canadian work experience in July 24 and become eligible for express entry. Can I apply for both. Or wait for six months as OINP draws are unpredictable, time consuming and rarely general for all categories.

      You can (rather should) apply for both. Both are EOI based systems now, so yes, there's no guarantee when a draw may come, but it's recommended to be in the pool when the draw happens, not to mention that OINP is a Provincial program following which you would have to apply for PR to the Federal Govt, whereas if luck were to favor you in Express Entry...

      Hello, although historically, 473 has been a very good CRS score, but given how much the situation has changed (post-Covid), I would probably imagine unless there are occupation-specific draws (and your occupation is in-demand) or we see an unprecedented large round of invitation, the score is bound to remain higher at this time. As of June 20, 2022, there were 20,172 applicants in the EE pool with a crs score north of 480 (not to mention an additional 16,969 candidates between 471-480). However, law of averages is bound to catch up and the score would settle down a bit (hopefully), but a lot depends on the size and nature of each round of invitation. Tips: Arranged employment is worth 50-200 points. Try creating your profile on Canada’s job bank, approach employers on LinkedIn, Indeed, etc. I am assuming through your CRS, you have already topped CLB9, however if there’s room for improvement, try CLB 10 in all 4 skills, that should bump up your score slightly too.

      Hi. I am not sure I understand the question, but if your brother has a PR card but no other ID proof in Canada, that’s absolutely fine, you can claim those additional 15 points. I hope this answers, my apologies if I misunderstood the question.

      Hello Waiyan, yes, between 2017 and 2019, IRCC conducted 2 FST specific draws each year; while post-covid, there was only 1 FST draw in 2020, and none in 2021 or 2022 (so far). However, any draws where it says "No Program specified" invites candidates from FSW, CEC and FST categories as well, and since IRCC is set to resume draws for all categories from July 06, no specific emphasis on FSW/FST/CEC was given but a general overview.

    After going through the process and i get my Destitute work permit, Do i remain eligible for the PGWP after my studies, since you said that it’s usually valid till the end of your study time. And does it affect my PR eligibility in future.

      Hi Fiona. Applying for a Destitute Student Work Permit should not have any impact on your eligibility for a PGWP or PR since IRPR provisions this. As long as you successfully complete your education program, maintaining full-time status in your academics (some exceptions may apply) and apply for a PGWP within 180 days of graduating, while maintaining status in Canada, you should be good.

      @@fai8t The processing time may vary, however almost 12 months since processing is something worth investigating. Have you tried applying for GCMS notes to see where the application is at?

    Hi there Thanks for sharing the information. It was really helpful. I have one simple query and that is, is there any age restriction? We see in an express entry or other pnp that they provide points for age. So is there any points system for age in Ph.D. Graduate Stream too? The reason I am asking is that I am already 35 and I planning to do my Ph.D. in Canada; so I am guessing by the time I finish I will be 38 or something. Can I apply then or will my age will be a barrier. Please let me

    Hi, I have done two years post graduate certificate from a Canadian college and I have done my Bachelors London UK. Am I eligible for international graduate stream.

      Hi Ali, if you were present in Canada at the time of application (and when the application is finally processed), maintained valid status or were eligible to restore your status, you would have been eligible to apply under this stream. However, please note that the International Graduate stream (for English speaking candidates) was filled in only about 25 hours. HOWEVER, you may still be eligible to apply if you are able to demonstrate proficiency in French language (NCLC 4).

      Depending on your current situation in terms of age, (Foreign and Canadian) work experience, language proficiency, current province of residence, there could be various options. My advise would be Express Entry if you qualify under one of the eligible programs. There has never been a trend for lower scores in the history of Express Entry, provided you qualify under the Canadian Experience Class. Based on your graduation and 1 yr PG Certificate in Canada, provided you have completed 1 year work experience in NOC skill level 0/A/B in Canada, you should have a good chance to make it through.

    Thanks for posting the very useful video. For a foreign worker, the official language ability does not apply. Does it mean IELTS or other language tests are not mandatory for the foreign worker already working in Canada? Official language ability (Not applied to Foreign Worker or In-Demand Skills streams.) CLB 9 or higher - 10 points CLB 8 - 6 points CLB 7 - 4 points CLB 6 or lower - 0 points

The employment must meet the definition of work under subsection 73(2) of the Regulations;”

      I know that I am taking about interest of express. People who are graduated from ontrio university dont need job offer but you say we need. It is for foreign worker. Yes. We do need have job not job offer for applying TR to PR. ( 40000 International student)

      @@loveanimals4211 That’s correct only for OINP’s Master’s (graduates) stream. However, at this time the OINP’s EOI system is only accepting applications under Employer Job Offer: International Graduate Stream and Employer Job Offer: Foreign Worker Stream. Both the streams need the job offer.       @@loveanimals4211 Exactly. The idea behind the video is to explain the new EOI system and the programs it covers as on the date of launch. And both the programs do require a job offer as on the time of this comment. We have not spoken about the Masters or Ph.D stream. We regret if there was any confusion. Hope this helps.

    Hi, I have a query, I hope you’ll answer that. I don’t have surname in my name and for my EE profile, I only filled my name ’Mandeep Kaur’ in the last name and left the given name option blank so now while registering for EOI I can see there’re two columns full name and last name.. should I write my full name ‘Mandeep Kaur’ in both the options as both are mandatory to fill? I know it can be a basic ques but I don’t want to make any mistake so wanted to clear that. TIA 😊

      You can choose to either write "Not Applicable" in the last name, or enter your Given Name in both fields. Hope this helps.

      Hi, you may be eligible to apply under the International Graduate stream if you have completed an eligible study program from an eligible institute 2017 onwards AND if the quota for 40,000 applications is not reached by the time you have your IELTS. Please bear in mind, that French speaking applicants (with a language level of NCLC 5) can continue to submit the application till November 2021 since this stream does not have any limit on the number of applications received. Alternatively, if you are an international graduate and if you have acquired at least 1 year of full-time or equivalent in part-time experience even while on your study permit, you may use that to apply under the Essential Worker stream as well.     I read that subsection 73(2) regulation says, "(2) Despite the definition work in section 2, for the purposes of this Division, work means an activity for which wages are paid or commission is earned." what you are saying about 30 hours work is subsection 73(1). could you please clarify me?

      Hi Vidya. Subsection 73(2) of the regulations includes all work for which wages/salary/commission were earned. Therefore, under the new Temporary Public Policy outlining Essential and Healthcare Workers, any work experience (INCLUDING WHAT IS GAINED WHILE ON A STUDY PERMIT) is eligible towards meeting the eligibility criteria of 1560 hrs or 1 year of full time (or equivalent in part-time) as long as the applicant was authorized to work, and the salary was received for it.       @@vskstorage7431 Are you an international graduate or an international student? Under the international graduate stream, you can only apply after you have graduated. However, if you have completed the required part-time experience in one of the essential occupations, you can apply under the Essential Worker stream.
