Do I have to copy all the forms I filled out? If so, can I just do so with the copier on the printer I have or do I have to get to copied elsewhere?
Hi, and I'm so sorry for the late response! It's recommended that you make two copies of your filled-out petition (on normal paper using your printer should be totally fine) if you're filing in-person at your local courthouse; the clerk will take one copy of the petition as the "original" copy, and then return a stamped copy to you (as proof that you've filed). If you'd like to file by mail, you should check your local court's website or call your local clerk's offices to check how many copies of your forms they want you to include in your envelope. Generally, they want two copies and a return envelope (so they can, again, return a stamped copy to you), but this might vary based on what county you live in.
Is there a special procedure if you are no longer residing in the US, but still have citizenship? Is it possible to hand in these forms remotely? Great video by the way!
Hi! We're glad that we could help! Unfortunately, because name/gender change petitions have to be filed in the superior court in the US county that you have /current/ residence in, I'm not sure if you'd be able to go through this procedure or file these court forms if you're not currently living in the US. I might reach out to the US Consulate where you live or to a local transgender legal aid clinic in the state in which you were born to ask if there's any way for you to get your hands on a judge's decree if you're hoping to update your US passport. The guidance in this video is very California-resident focused, haha. If you have more questions or would like to provide more details about your situation so that we can be more helpful to you, please reach out to us at ngcw@ebclc.org. I'd be happy to field more of your questions via email!
Which document do I attach my Declaration paper to from my Clinician affirming my care? I originaly had thought I needed NC-210 for this process. What's the difference between NC-300 and NC-200? Can you also explain the process of filing these documents? Should I try e-Filing these if it's difficult for me to take time off of work to go in person to the courthouse? I'm in Placer county and it has an option for remote attending the court hearing I see, I think. Is this something that is worth trying? This is a super helpful video thank you!
Hi! I'm so glad that this video can be helpful! To answer your questions in order: 1. In California, getting gender-affirming care is no longer a requirement in order to qualify for a name/gender change. You won't need to attach your declaration anywhere; you'll just need to file the packet of documents detailed in the video! 2. The NC-200 & NC-210 are outdated versions of the documents described in the video & linked in the description. I'd recommend looking at and downloading the updated court forms either from the ID, Please packet (transgenderlawcenter.org/id-please/) or directly from the CA courts' self-help site to make sure that you have the most current version of the documents; the clerks will not accept any outdated forms! 3. Different counties have different rules about e-filing their documents. I took a quick look at Placer County's rules (www.placer.courts.ca.gov/online-services/efiling), and it looks like you should be able to e-file the packet if you go through an electronic filing service provider to do so. If you want to make 100% sure, I'd call the clerk's office and ask if they'd be amenable to an e-filed name/gender change packet! 4. You won't have to publish your name/gender change in a newspaper or attend any court hearing if your name/gender change is for a gender-affirming purpose! As long as you put "better match for my identity" in the "reason for change" section of the NC-110, the court should process your paperwork without giving you much trouble. Let me know if that answers everything. We're glad to be of service!
if i was born in another state (or Canada actually!) I shouldn't check "and issuance of new certificates" right?
Hi, and thanks for reaching out! You're correct -- you won't have to check that box when you're filling out your forms. The judge's decree will be able to change Californian birth certificates, but the process will vary by state (or by country!) if you're looking to get your non-Californian birth certificate changed.
@@nameandgenderchangeworksho6463 thank you very much and for your video :) i dont think i could have done it without you!!! the last part im still trying to solve is how to file it. I live near the Burbank Court, but on the e-filing websites if I choose "civil unlimited" it shows the court houses in the cities around me but it doesnt say Burbank :(
Some of your links are 404. And the county website says we DO have to do a newspaper announcement, but you're saying we don't. Any guidance on where to find the real answer?
Hi, and thanks for reaching out! We'll get the 404 links updated to reflect their current URLs on the California Self-Help website. If you're filing a name and gender change for the sake of affirming your gender, you don't have to make a newspaper announcement; if you're getting one for most other reasons, you do. That information can be found on this site, under a dropdown: selfhelp.courts.ca.gov/name-change. I hope that helps!
Thank you so much for this video! I've been putting it off because it felt so daunting.
Hello, after submitting all my documents, having them returned, amending them, and sending them back through the mail, I received an envelope back with copies of all my submitted documents, but no instructions on what steps to take next, or any information at all. The forms appear to be marked as Filed, witha case number, and the form NC-125 appears to be signed by a Judge. I received these copied forms nearly two months ago. What should I do right now? Am I waiting on the court, or are they waiting on me? Who can I contact to get information or ask questions about the state of the case? (Side note- I did not file for a fee waiver; I paid the full cost when I first filed the forms in person)
Hi, and thanks for reaching out! After the court's returned your name change documents and the NC-125 to you, there's a six-week waiting period before the judge makes a decision on your case. If it's been six weeks, I'd definitely reach out via phone to the clerk's office in the court that you filed your initial name change packet in. Tell them your case number, inform them that it's been six weeks since you filed your initial packet, and say that you're wondering about when you should pick up a certified copy of the signed judge's decree (Form NC-130) so that you can change the rest of your identification documents. Once you have a certified copy of the decree, that's the form that you should take to all the different identification agencies (the social security office, DMV, etc.) to actually change your name/gender on your different IDs. There's a $40 fee for each certified copy that you request, but in practice, you only really need one or two; most of these agencies will return the certified copy to you once they've finished processing the name/gender change in their systems. Good luck, and feel free to reach out to us if you have any other questions or concerns!
@@nameandgenderchangeworksho6463 Thank you so much!!
@@nameandgenderchangeworksho6463 Thank you so much!! As it turns out, it seems that it was already granted and I just didn't realize that the forms I was sent was the certified copy 😅
I’m trying to find out how to do it with one parent as a minor 😓
Hi, and thank you for your question! In general: the process will begin very similarly. You'll have to file a slightly different set of court forms than the one described in this video, but the information required will be largely the same. If you only have one parent to sign off on the forms, however, you'll have to provide notice of the name change to the other parent (if they're still alive) & attend a court hearing in order to receive the final judge's decree. More information about the process is detailed step-by-step in the following link: selfhelp.courts.ca.gov/gender-recognition/gender-name-child-one-parent The Name and Gender Change Workshop is also happy to help with any more specific questions that you might have. Please feel free to contact us at ngcw@ebclc.org, and best of luck!
You say to fill the case number in the same each time, but what should it be filled in as?
Hi, thank you for your question! Once your petition has been approved and you receive a judge-signed court order, there should be a case number stamped in the "CASE NUMBER" box near the top of the page. That's the case number that you should use if, for example, your birth certificate amendment application asks you to fill in a case number. I hope that helps!
Can you do birth certificate forms ?
Hi, we do not currently have plans to make a birth certificate video but we will consider it for the future. You can refer to page 29 of this guide for information on how to amend your California birth certificate: tlcenter.app.box.com/s/3da7afk3p7dn1ngoxcz3tuy18q3u1dco.
Where do you sign the documents in which there's no designated line like in the NC125 and second page of NC330?
Hi, thank you for your question. You do not sign the NC-125 or the NC-330--these forms are for the judge to sign when they approve your name change. You still fill out the forms with your name and/or gender change information, but only the judge will sign these pages. Best of luck.
Ok, thanks so much!
