Texas Backyard Chicken Bill (HB 276) Passes 2nd Reading in House
*UPDATE* This bill and every other 2023 chicken bill died in the Senate Local Government Committee.
The exact bill passed the House last session with 143 votes, including the vote of Representative Terry Canales, who this session appears to be furious and calls it a "bad bill".
HB 276 is identical to HB 1686 from the 87th session in 2021, on which Mr. Canales and 142 of his colleagues voted yes. He is not the only Representative to have changed his or her mind, just the loudest.

I have a question. I'm reading about the TCS and I have a question. I have seen a lot of people sell plates and bowls of homemade food on social media. I'm in Texas and these people I see are also in Texas. Now, if the TCS foods are chicken, meat fish, potatoes and the rest, does that mean they're selling cooked food that are not in compliance with the cottage law?
Oh my goodness! My mom has 2 acres which i moved onto with my tiny home last year...and she has naturally raised free range chickens, about 45-50 chickens... there are 2 coops that none stay in. Occasionally hens lay in the boxes. But we dont collect eggs and they just do whatever they want and they roost in a really tall tree behind the house. So im trying to find ways to satisfy all the flock members.. and its technically many flocks i think... there are about 7 roosters that each have their own groups of hens. But they do all sleep in same tree. But since moving here im having to do it backwards. I'm not building things to put chickens... im having to build things that make them happy and secure also that appeals to them. I have been looking everywhere for ideas for my chickens. And everything's main focus is eggs. Best way to get the eggs, train them to lay here and all that. I can barley find anything on just happiness and health for them. This is the first one I have seen where you adapt to the chickens and their habits.. change the environment to make it what they need instead of just giving them the traditional options and saying that's the end. I wish I could speak to you and pick your brain and get some advice on best way to help the situation I am in.. especially being Texas with the heat and the same predators. I'm currently looking to build a treehouse coop for 3 chickens coming up to laying age soon! I hatched them from some eggs that I found that no hen came back to sit on. I left them and just watched daily for almost 3 weeks before they started to hatch thanx to the incubator known as central texas heat. I am their mom. They still rely on me for everything but they sleep in a tree outside my front door. Which is only a few trees away from the big tree the others sleep in. Owls are an issue at night and these chickens do not like to sleep anywhere else. So I'm building a tree coop around where they roost. I'm going to use many features you have shown😂

No "backyard chicken" bills passed in 2023 sadly. Every bill that passed the House died in the Senate, Paul Bettencourt, chair of the Senate Local Government committee would not even give them a hearing.

Canales was really pushing for that question to be answered, and honestly it's a fair question for someone who doesn't want to be next to chickens, but if you look at HB 1191, he did vote in favor of the bill.
Canales is more dense than a Christmas fruitcake.
I am thrilled at the timing of finding this post!! It’s 4 am and I can’t sleep lol. I am excited about starting my pop up cart market. I have the wagon and had a design in mind, but love the A frame you shared. My husband and I are traveling to a neighboring ( Texas) town with a Home Depot for wood. I am a Cottage baker as well, I’m confused about the eggs even though it’s not cottage approved, we can still sell legally with the labels that indicate they are not pasteurized? Anyway, I love this and appreciate you for sharing. More edited now!! Thank you
Your coop is similar to mine. The two sides both have plastic tarps (I think from signage tarps) that I can push down and pull up when it rains. There are poly ropes that hold the tarps in place. I put kitty litter boxes on the floor and they like those for laying. My coop is only about 5x8, but works well enough. I set up several easy-ups outside, with 100' of moveable electric fencing all around. I like the idea of putting those poop catching board under their roosting bars.
Pleaaase! There can be more than reasonable regulations to this. That quack worshipping his HOA probably doesn't recognize he is in a big form of government, and HOAs.....are the last and smallest form. This is a reasonable bill, especially when there's an egg shortage or a hatchery mysteriously catches fire again killing 25 million chickens

Shoot, chickens are quieter than one or more barking dogs.
For those who do not live in a HOA… we should be allowed to grow food and have a few chickens. The HOA residents should bring that up with their HOA’s. Residents should follow the procedures to get rules changed. This should be left up ti the residents NOT legislators
Adding: food that is commercially sold is now Genetically Modified. We must fight for our right to have a choice. To have a choice requires the ability to grow and raise your own food.
I understand the address is necessary- but, I’m todays environment- another option needs to be agreed upon. It’s dangerous to have the home address on items sold at a fair or festival. It literally opens the door for people with nefarious actions on their mind.
Thank you ladies for your hard work and supporting Cottage Food industries. I know I’m pushing the envelope: since I can sell fried fruit pies- I wish something like that could be done on site. Example: the pies are made and kept frozen. I fry and package them the night before an event. It would be great if I could fry them on site. Am I asking too much? Probably- but, it doesn’t hurt to push .. 😉
HB 1191 2023 chicken freedom act started by Briscoe Cain died after being "referred to local government". Basically they didn't vote on it in time and just let it die. So disgraceful. What do these people even do?
I know this is over a year old, so hopefully someone will answer. When you mentioned the cake pop/labeling example.... I'm thinking of the large bags of fun size candy bars/5lb bags of suckers/etc.... Each of those items are individually wrapped but not individually labeled. I just don't read it (the statue) that way feasible... label each cookie, cake pop, etc if they're packaged in a box with all the required labels. Any updates, clarifications, or other input?

@@homemadetexas boo. I just saw this video/info. Bettencourt is my senator and I know him well. I'm not happy he did not allow this bill to be voted on. I will be saying something to him for sure. I know Tom Oliverson well also. He was my state rep till lines were redrawn, and he and I are friends. He was very supportive of the bill.

A raccoon could make short work of your lock, i've heard if a 2 yr old could slide the lock so could a coon. My coop could be used as a brinks truck if something gets my girls he's gona have to work at it.
I've done fairly much the same thing. Except one side has a sheet of plywood, about 4' off the ground, to 8', and then one side has 20", so, they have a corner wind break. Honestly, it seemed like they would use it, but they do not, they like the breeze, even at night.

I am near Austin. Chickens are very cold-hardy. As long as you give them a dry place out of the wind, they will be fine. It's the heat you have to worry about killing them.
@@homemadetexasI’m near Austin, too… Lake Travis / Volente area. This will be our first winter with chickens here. We had a small flock in S. Houston a few years back. It’s my understanding that as long as you give them a well-ventilated place and limit the drafts, chickens handle our kind of cold just fine. Also… ensure access to water that isn’t a block of ice!
Hi, I have a question. Let's say a city generally requires any type of vendor to take out a permit to sell at special events (think 4th of July). If they have an ordinance (not specific to cottage food productions) that requires vendors in general to take out that permit, would a cottage food operation also be required to have that permit or would they be exempt?
Excellent question, I hope you'll receive an answer. My personal research leans in the direction of probably not, but yes to a temporary permit if local ordinance says you must in order to set up on the side of the road, etc.
In general HOAs arent established by property owners but rather corporations the build these large neighborhoods. They put generic rules down that rarely get removed and the HOAs bureaucracy lives on for eternity. They are a monopoly in TEXAS especially. Its not until state laws change restricting these organizations power do the actual home owners and residents get their power back. It was actually very similar for solar power on roofs

Oh the arguments against this make me so angry. So glad we are one step closer. Chickens aren't any worse noise wise than my neighbors 2 pitbulls. Lol, and I don't think I even need to bring up the rabbit argument. The guy who said it's a bad bill, who is this? They need to be voted out.

I'm in the panhandle of Fl. and I have an 3 sided open air coop as well 8x 8 coop 8x24 run all covered 8x32 total, but my girls and roo sleep out in the run no matter how cold it gets here. Go figure. To deal with the heat I put sun sails up for Shade and keep the free range are wetted down in the summer. This is my first year and have not lost a bird yet. My nesting boxes and free freed tube are in the coop area.
I definitely think "6" is a high number for a small backayrd flock and we might be able to squeze out half the hens into law. I'd shoot for 4. That's a healthy balance for people to be more prone to accept. Heck, I'd take 2.
The problem with 2 is most places will not sell chicks two at a time. You have to buy 3 or 4, which is understandable, as they are flock animals.

There is no statewide law allowing the keeping of up to 6 hens. It depends on where you live, what city rules or HOA rules apply to you. It's completely prohibited by most HOAs, or some cities have rules that have the effect of prohibiting it (such as requiring 300 feet distance between the chicken coop and a neighboring home). This bill would apply a statewide standard.
