I agree! One pet peeve for me is witnesses only answering yes to cross questions. Even when the witness is not on our side it still bugs me! Another is when an opposing attorney tells my witness to only answer yes and no on a cross, and then interrupting my witness when they try to explain their answer!!! AHHHH!!!!

Im a little confused. Dr Doe Raymie testified that he was an expert witness, but I thought it was the attorneys job to prove that he is an expert witness, and it cant be established beforehand, especially by the witness.

Admission by a party opponent is NOT an exception to the hearsay rule as you stated @ 1:56 in the video. Rule 801d says that "admission by a party opponent" is NOT HEARSAY. No exception needed, It is simply not hearsay.

I have been having this debate in my Mock Trial class about what is and what is not a leading question on direct. Are these open ended questions? 1. Example: Witness mentions having a job and brings up a date. Attorney: Did you go to work on July 3, 1876? 1. Example: Witness mentions knowing about equitment. Attorney: Did you check the equitment? My reasons for them NOT being leading is becuase they don't imply a certain stance on the answer (e.g. there is no implied yes or no) and they are not "leading the witness." It is just a standard "did" question and not: You went to work on July 3, right? or You didn't check the equitment, correct? I would love your input! Thank you!

I would be VERY curious about your opinion of Charlie Adelson’s attorney Daniel Rashbaum, who represented him during the trial related to the murder of Dan Markel, the Florida State University Professor that was murdered by a hitman (by his brother in law, Charlie Adelson).. In my unprofessional opinion I believe Rashbaum lost credibility when he started getting intense and confrontational during cross on a witness. How to do a proper memorandum of law in opposition to defendants motion to summary judgement.

I am a witness on a homicide trial and I am terrified. In February 18th 2025 will be the second trial and I will be crossed examined. They murder is my boyfriend and I am super afraid we can’t loose it. This guy is insane he needs to be in prison. He is in jail for the last 2 years. I do have an attorney helping me me but I need some more advice. I don’t have more budget for another attorney that’s why I am watching your videos. Thank you

Never ever say to a jury, “this case is simple”, never. As a juror, I would think if this case is so simple then why am I here.? I’ve heard this argument used by many attorneys, and it is the worst thing. I think you can say, especially in an opening block of a closing argument.

Should I be worried if my lawyer has to watch you tube videos to prep for a trial? Just curious because it would seem that your law school education would or at least should be sufficient correct?

Luke, I'm struggling with when leading questions are acceptable on direct examination. I get that if it doesn't add anything or isn't prejudicial and simply moves along the narrative it's okay. I just got through watching Vince Bugliosi direct examine Buell Wesley Frazier on the Oswald on Trial video, and it seemed he asked quite a few leading questions. Is there a hard and fast rule on what's ok and what is not? How about a video?

Hi Luke! I love your witness videos. Do you think you could make one on portraying very young/very old witnesses? This year it looks like I’m going to be playing a witness who is a freshman in college (and was a high school junior when they witnessed the crime), and I’m not sure how to remain polite and professional while standing out from all of the other witnesses who are 35+ (since, of course, all of us are actually around the same age). Any advice would be appreciated!

I have been a trial lawyer for many years. Of course, I think the defendant’s lawyer, Ella, is much better than I. She is a great story teller. Fortunately, law is much more than argument style at closing, but she is incredible.

What in the official kindergarten is going on here

As someone who currently is victim to ongoing fraud on the court, we really, really, really, really, really need to have all party attorneys to take the #attorneyoath as to close the ability to "plantiffs" lawyer's to engage in #maliciousprosecution by allowing those corrupt attorneys to run amok and shield actual opposing party statements (1st exemption discussed FRE). Each case I was victim-defendant I raised and insisted the opposing party attorneys take the oath, and of course was denied and later found out the court was using illegal referees or the attorney-arb judge was insolvent and illegally allowed to take case with my rights of appeal denied by my state's supreme court (Minnesota)
