It says in the Council’s statement: “Secondly: The agent stipulates that the customer must deal through him, which leads to combining both giving a loan for something in return and paying commission, which is akin to combining giving a loan and selling at the same time, which is forbidden in the Shari’ah because the Messenger (peace and blessings of Allah be upon him) said: “It is not permissible to give a loan and sell at the same time…” The hadith was narrated by Abu Dawud (3/384) and al-Tirmidhi (3/526), who said it is a hasan sahih hadith. In this case, he has benefited from his loan, and the fuqaha are unanimously agreed that every loan that brings a benefit is haram riba.” 3- There is no hand-to-hand exchange with regard to that in which hand-to-hand exchange is stipulated, such as currencies and gold and silver. This comes under the heading of riba an-nasiah. The Council said: “Buying and selling currencies is usually done without the hand-to-hand exchange prescribed in shari‘ah which makes it permissible to dispose of them (after buying them).” 4- It causes harm to the economy. In the Council’s statement it says: “Fourthly: This transaction involves economic harm to the parties involved, especially the customer (investor), and to the economy of the society in general, because it is based on borrowing to excess and taking risks. Such matters usually involve cheating, misleading people, rumours, hoarding, artificial inflation of prices and rapid and strong fluctuation of prices, with the aim of getting rich quickly and acquiring the savings of others in unlawful ways. Hence it comes under the heading of consuming people’s wealth unlawfully, in addition to diverting wealth in society from real, fruitful economic activity to this type of risk that has no economic advantage, and it may lead to severe economic turmoil that will cause great loss and harm in society.”

Thank you for sharing the video. I think Forex Trading is haram due to the following key reasons: 1. In Forex trading also known as spread betting, there is no ownership of the underlying forex and it is also mentioned in the broker's agreement that the trader will not get the forex when he opens the trade. 2. Profit/Loss is the result of halal or haram activity. Hence if you earn a fixed profit or loses money in fixed portion, this will not make the trading halal as the basic fundamental of owning the forex is not met. 3. In the example you made related to property or vehicle buy/sell. Please note that in such business activity, the promise to deliver the asset is made at the outset, while in forex trading, the broker clearly mentioned in his agreement that there shall be no delivery of the forex when the trade is opened. Hence the exchange of files (property/vehicle) will act as an asset because legally the party has to deliver the asset to the customer. 4. In forex trading, a contract is made with the broker, such contract cannot be transferred to another broker and the trader has no other choice but to settle the trade with his broker only. 5. In forex trading, the trader opens the trade in dollars (for example) and in return he gets a contract shown on the screen. There is no exchange of actual currencies, rather both broker and trader are placing bet against each other. And after some time, the trader closes the trade and get back his original currency with profit or loss. Such sort of arrangement where the trader get the money after some time without any promise of getting the asset is called Riba ul Naisah. 6. Forex trading is a zero sum game, where the loss of one party equals to the profit of other party. This is pure gambling. 7. In real trading, both parties are not against each other, rather both parties are interested in the value they will receive after the exchange of the assets. Like if someone buys the real car, one party gets the real car, and other party gets the money. In forex trading, both parties (trader and broker) are against each other. Loss of one party equals to the profit of other party. This is pure gambling. May Allah guide us the straight path. Ameen.
