Now that the alleged victim stopped taking custody and the state arrested me for violate exparte that was remeved but I was so nice I expunged it 3 hours later. Seeing my name chester man arreseted for fighg on boat for something the state expunged not soon enough not even bothers me, or I could have sued them. Nope I just wanna own a rifle. Are you serious??? If I were to refuse a field sobriety test here in Kentucky, they would drag me out of my car and beat me blind. In KY, they would laugh and spit in my face for real I was interrogated 4 hours by a police officer that was trying to get me to take the blame for someone else's drugs. It truly was one of the most humiliating and annoying things I've ever been subjected to. Bottom line this Ole boy from Kentucky never have or never will take another man's fall that truly was one night of hell cops are allowed to do whatever they want to citizens. Sad but true

Passing a field sobriety test WILL NOT prevent you from being arrested. They can STILL arrest you with only suspicion.

In California, the flashlights are equipped with breathalyzers. Also, if you refuse to take an FST, they will take you to jail to force you to take a test.

"My attorney has advised me to politely decline field sobriety tests, as they are unnatural body movements." And they fucking are. As someone said below, most people can't "pass" even if they've never touched a drop of alcohol in their life.

All a FSB is, is an eliminator. If you refuse to take the test you are more than likely to be arrested. If you take it and pass you are more than likely to be on your way home or to another bar.

As a professional my opinion is that police officers are unqualified to give these tests. I would venture to say that 100 have no idea how to give a field sobriety test. Never agree to take one.

Have you , your Law Firm or any other citizens taken the Field Sobriety Test . As for what it is, what is it’s main aim as a tool is for, whether it is legal or does it fall under what is known here in Australia as “ENTRAPMENT “. If it were to be found to be legal after being tested for what it might be or is with proper legislation and the lawful way to which can only be used , determined and what is needed by those who are permitted to use such said tool. Which would outline the Qualifications minimums requirements, the reason, the setting and any and all penalties to all actors who may flaunt the legislation as it was legislated. The BAS system used here in Australia is has scientific backing and is non discriminatory, the same can not be treated or seen in the same light as there is a human and could decide on feelings discrimination race disability or sex type. And has no real value scientifically as it stands and should be discontinued totally. But I will return you to the opening question and if not are you doing a dis-service to your clientele for not doing so.

The other one I've seen a number of times is when they have a dog sniff your car. The dog will walk around for a bit, and then the cop will say "Our dog has alerted for the presence of drugs". Really? I didn't see the dog do a damn thing? What do you mean by "alerted"? Did he bark? Did he point? Did he sit down? Maybe he sat down because he was tired. They use the dog to give them "probable cause to search" but I've never seen a dog give open testimony in court stating what he or she smelled, or what he or she suspected was in the car. Makes it a bit hard to question your accuser.

How about not answering any questions at all. If you talk the officer can say your speech was slurred and then he would have sufficient reason to detain you. You've committed no crime, they have no reason to suspect you have so you don't have to answer any questions, right?

If you're slurring your words, answering "NO" is not gonna help.🤣😂🙂 If you smell of alcohol to high heaven, maybe you can tell the officer it's a new brand of after shave lotion that's supposed to drive women insane?😅🤣😂

These lawyers and sidewalk lawyers who make these anti cop videos are not helping anyone. They say you don't have to do this or that. That's the best way to find yourself in the back of a patrol car. Officers want to know who they just stopped for a crime and the law says they can find out.

Because a suspect refuses the field sobriety test doesn't mean he gets to drive off. The officer will write in the DUI report that the suspect refused the sobriety test. The officer will note the demeanor of the suspect. Example, slurred speech, strong oder of alcohol on breath, eyes bloodshot. The suspect is still charged with DUI. The judge will not like the suspect refusing to take the sobriety test or the breath test. The officer's testimony will usually find the suspect guilty. Video cameras the officers now use are great to show the court the actions of the suspect.

Buy my own body cam, follow off duty cops to the bars, film them drinking like fish. Then record them leaving !! Yes driving. Did that for a month, sent it to local news. 🤔 Yep nothing.

If you refuse the test in Texas it is supposed to be an automatic 6 months driver's license suspension. However a lawyer can beat the suspension easier than a failed test in court

These are agility tests and just a slight deviation from the instructions can cause for failure. As for the "blow test", the officer can mark down any number without your knowledge.

As a retired Florida Judge who went to law school in Maryland, I can say it used to be considered unethical to advertise or solicit business. Now it’s common and is lawful by Supreme Court ruling. But in my opinion the best way to find a good lawyer is by word of mouth or Bar association referral not likely by watching RUclips.
