      Yes, 1. It seems the base of the whole thing revolves around the gun first. 2. Then when to use it, when it's appropriate to draw it etc., then 3. The accuracy comes last. Then you are easily able to move into A category and it feels great when that has been accomplished. Have you taken my class in the past?

    Im a G armed security officer, Florida FS493. 📂 Im also a US Army veteran, 4yr 1990s. MP, 95B(31B). Florida has strict new Armed Guardian requirements. Most school boards, counties use SROs, sworn deputies. MSD Parkland was a huge shake up. Id add 1A auditors, You Tube grifters are a problem in Florida, other places. They want $, social media views 👀 . Many are felons, registered sex offenders, have drug-alcohol issues. I had a 2023 1A audit incident at a FEMA-DHS office. Attacked by a 1A auditor 2x. He was charged, felony but took a plea. 📂 These creeps go to school board offices, areas that are "gun free".

      I was a Sheriff's Deputy from 1996 until 2010 when the UPD was established. In 2010, the former Sheriff Jim Winder worked with the legislature in creating the new law, which designated the SHERIFF as CEO of the UPD; he did this for good reason, so he still kept his authority as Sheriff under the new model. Sheriff Winder had ALL of his 330 Deputies sworn in to the UPD, BUT because he was the CEO of the UPD, he still had control to protect them, if he needed to change things, in the event the legislature tries their shenanigans, trying to say the Sheriff Can't run "two" departments" very misleading to the public, not really two separate departments. IF I had been in Sheriff Rivera's shoes, I would have pushed back to the legislature and I would have told them IF they want to RENEG on the deal, on the agreement they made with Jim Winder in 2010, to remove me as CEO of the UPD, then fine, Give me back ALL of my 330 deputies, I will swear them in as deputies and the UPD will be dissolved and it will be EXACTLY like it was when I was a deputy in 2009, and we liked it better under the Sheriff's Office! NOW all of the Mayors under the UPD board, have the power with a strong police force that former Sheriff had and Rosie was bullied into giving up.

    It sounds like Utah police is cool and I agree one should always be carrying and the ability to defend yourself and your family or property is vital every time I have contact with police I try to make them feel safe like going as far off from the edge of the rode also turn on all my inside lights and roll down all the windows also I have a pouch with my registration drivers license and insurance ready to go and also I keep my hands visible

      All police are not cool no matter where you live. Some are just dicks and like to throw their weight around. I believe MOST are good, but we only remember the bad one. Believe me when I say that no one dislikes a bad cop more than a good cop. This video is intended to help things go better AND if there are problems how to handle that.

    First off, no one needs to beg the government for permission to conceal carry. It is a fundamental right and protected by the Second Amendment of the United States Constitution for the United States. No, we do not have a duty to tell the police that we are carrying. Why is it that we can't put our hands in our pockets when the police do it all the time during a stop. I've seen it over and over again.

BTW in my video, I did NOT say that we had a duty to inform in Utah as your comment said. In Utah, whether or not you decide to tell the officer, is your individual choice to make, as explained in the video. Putting your hands in your pockets when in contact with officers is NOT a good idea for obvious reasons; bad guys carry pocket guns in pockets, knives in pockets and if an officer has reason to believe you are reaching for a weapon on a contact and they feel threatened, you just may, NOT ALWAYS, have a gun drawn on you! Put yourself in the officer's shoes just for a moment, YOU also would want to go home to your family wouldn't you?

      I knew that you didn't have a duty to inform. I was just saying that no one anywhere should have a duty to inform. Here in Ohio, we have Constitutional carry. We no longer have a duty to inform. We do have to tell the officer if he asks. I had a Concealed carry license before the law was changed. I was arrested twice for concealed carry even though I had a license because I didn't inform the officer immediately. The law stated to inform the officer promptly. Those two words are very different. The cop told me that 1 minute and 30 seconds had passed then arrested me. That was absolutely ridiculous!

      I am assuming you are talking about civil rights violations by officers? for example an illegal search? The remedy would be a civil rights lawsuit, commonly known as a 1983 case.

      Under Utah law, and most other states, You CAN sue the officer personally if you can convince the court why the officer should not be protected with qualified immunity. Officers don't have qualified immunity, when they break the law, policy and otherwise violate civil rights of others, it can be done.

The cops in my state that I have spoken to (and my own opinion) is that we love it when law abiding gun owners are able to protect themselves, YES, I am sure that you will find cops that don't care if you want to protect yourself. There are BAD cops, no doubt! Most of them are good, at least what I have seen. You are correct that police don't have an obligation to protect you! that has been ruled by the appellate courts. I also agree that ALL police need to uphold their oath first and foremost, no politics, just do your job you swore to do! Stay safe out there!

      If that person lawfully enters, through a house mate, you don't have a defense under defense of habitation, you DO have right however to defend yourself against unlawful immediate force through the force in defense of a person statute, and 76-2-402 would apply in that scenario

    RUclips is no place for legal advice. But how does one define an unlawful user? If a person smoked a joint back in 1973 are they an unlawful user in 2024? What about if someone smoked a joint a month ago? I would say that as long as you are not using, addicted to, or under the influence of a controlled substance at the moment of filling out the 4473, one could say in good faith that they are not an unlawful user. But that's just my opinion.

      Public intox laws vary by state. In Utah 76-9-701, Intoxilyzer is not necessary, officers only need to show that the person was intoxicated AND to a degree they presented a danger to themselves, and/or another person

    In your example of reasonable suspicion and probable cause with the guy leaving the bar having a hard time walking, etc. You said you would probably wait until you observed a traffic violation to pull him over. Do you have a specific reason for this rather than stopping him from getting into his car and driving off? Seems the ultimate end of those 2 would be him getting a dui or having to find another ride home. 2 vastly different outcomes. Assuming in this example youd be viewing him the whole time he was driving so the chance of having an accident is slim. This just brought up another thought. Say you did view him walking like he was potentially impaired and decided to wait until you observed a traffic violation, but he does get into an accident right after he takes off. Would there be any liability to the officer for not making contact before the potentially drunk guy drove his car? Not that an officer or anyone else would tell someone I saw him staggering to his car I was just waiting to see him commit a traffic violation, but if somehow that became known. Thanks for the talk. Good info and brought up some interesting questions for me.

      Yes, there could be some liability in the case of letting them drive away, IF you had reasonable suspicion BEFORE they drove away. Problem is that RS is a broad term that's not easily defined, hence would be the argument for allowing them to drive a short distance to observe a traffic violation. It's a discretionary decision and would depend on the desired outcome the officer wanted to see. An officer on the contrary, could argue, they wanted to give the benefit of the doubt this letting them drive to confirm suspicion

    Interesting listening to you say that you don't have to read Miranda rights yet when I went through the academy many years ago, we were told as soon as you make the arrest mirandize the arrestee because if you don't and somebody makes a mistake of not informing him of his Miranda rights you can get into serious trouble or issue.

    "Laws of evidence are necessary to keep police from abusing their authority..." Necessary, but not sufficient. They can do whatever shady bs they want to search your house (criminal trespass, often a felony while armed) with no exigency, warrant or other exception etc, then arrest (kidnap) you for obstruction or based on the evidence they find. Then the can strip/cavity search you (Sexual Assault/rape). If they resist they can use force(Battery/Murder) on you. Then if you're lucky, they'll throw out the evidence from the blatantly illegal search/arrest based on these laws of evidence. You can beat the rap, but you can't beat the RAPE. To be a sufficient condition to stop police from abusing their authority, charges must be brought against the officers for all their crimes (see in paren). Then convicted sentenced and serve time for their CRIMES. Only when they are in prison as a LEO who abused their authority will their safety be really threatened. Since the number 1, 2, 3... thing LEOs think about is "Officer Safety" this might deter other officers from doing similar acts again. The real battle needs to be fought in the voting booths. Only elect DAs who will prosecute LEOs for their CRIMES. If the State Attorneys are appointed, only elect other officials who will appoint such prosecutors. Robbing the taxpayers for the CRIMES of LEOs is only more injustice piled on the original injustice.

      It's unrealistic to expect cops to EDUCATE as I am doing. It IS their job to uphold your constitutional rights, They swore under oath to protect when they pinned that badge on their uniform. NO EXCEPTIONS.

      @gunclassutah you should read blacks stone commentary on the Laws of England, A Treatise of Arrest, and False Imprisonment. Lex parliamentary americana, the law of nations or the principles of the law of nature as well to have a better understanding that a deputy was not meant to be a full-time emolument, but only when the sheriff was in need of help at that point in time. Thats why the 2nd amendment was drafted because the people are supposed to police themselves, not a standing army at the command of a despotical government.
