But researching a bit it seems to be this throttle body (part no. 13541433414) that come as standard in all 3 series from 320i and up since 1998 something to keep in mind. Like install but in reverse. Just disconnect the cable from the actual brake pedal and remove the assembly. You might have to look how the install is made as there are many ways of going about it if the previous owner drilled anything new or anything like that. Another possibility might be it is a factory install as those are possible but rare... it is a hydraulic system and i have no idea without seeing it how to remove it.

As for the CC not working you might want to check if you have connected it to the right plug and pin. Does anyone if this works on a E39 as well?

Yes it should but not necessarily with the same kit depending on the age of your e39 it is either a separate "motor" that controls the cable to the throttle body or e-gas like in the 2001 and later e46 cars. I'm not sure how it is in the diesels but should be possible! Here is a Finnish chap (video with english subtitles) who did it to a early e39 if it of any help. ruclips.net/video/XS0lOydOaAE/видео.html
