to be honest, I think that Biker isn't really there per se. I think he's dead. All of the people in Hank's are dead/going to die. I think he died after he drove off into the night at the end at HM1. It is known that he was on drugs, and had a head injury from Jacket, so I think he died in a motorcycle accident. He also has no impact on the story, and only appears in one secret cutscene and makes a single appearance at that courthouse.

As for the conflicting endings, in one scene where you visit beard ( the shopkeeper ) biker is on the ground presumably dying but beard says that what he sees isn't real. This means both beard isn't real and biker isn't dead. In hotline miami 2 biker has a scar on his face which means they had a fight but both got out alive.

I have a theory stating that Biker died during the scuffle at PhoneHom. Not only are the janitors alive during Release, but Biker's presence is questionable during HM2. Though, my idea revolves more around the characters he appears near than the circumstances in which we talk to him. He shares something in common with the only character he ever interacts with. Both he and Evan dug their own graves by looking for meaning in the massacres caused by 50 Blessings. We all know what happens when Evan tries to pursue the truth instead of go back to his family, as Richard suggests to him. I think that Biker is a ghost. Not an omnipotent being like Richard, but the ghost of someone who died trying to chase an unreachable truth. To Evan, Biker wasn't supposed to be a loose end in the mystery. He was supposed to be an omen; to show what's left of people who try to fight organizations like 50 Blessings in the search of reason.
